MURPHY, II, Blackard & Murphy, Nashville, Attorneys for Defendant/Appellant First Paragraph: Continental Insurance Company (plaintiff) as subrogee of Entertainment Technical Services, Inc. (Entertainment or insured) filed suit in the Circuit Court of Davidson County against M.T. Gossett (defendant) for damages sustained as a result of defendants negligence. Following a bench trial, the trial court awarded plaintiff damages in the amount of $11,308.09 plus attorneys fees in the amount of $2,500.00. Defendant presents three issues for review on appeal: (1) whether the evidence preponderates against the judgment of the trial court that plaintiff was entitled to recover damages from defendant; (2) whether the trial court erred in awarding plaintiff attorneys fees; and (3) whether the trial court erred in allowing plaintiffs first witness to remain in court as its representative following his testimony. Jarrett Harvey, sued Defendants-Appellants, Andrew Guy Fulmer and Rhett Butler Trucking, Inc., for injuries sustained in an automobile accident which occurred in Hamilton County, Tennessee. The lower court directed a verdict against the Appellants on the issue of liability and sent the case to the jury on the issue of damages only. The jury returned with a verdict of $40,000 in favor of Ms. Harvey. The trial court overruled Appellants' Motion for a New Trial and Remittitur. This appeal followed. Plaintiffs sought to prevent their father, Defendant Eugene Lindsey, from bringing foreclosure proceedings on a note and deed of trust covering certain real property located in Blount County, Tennessee. Young, d/b/a City Tile, sued the defendants, Jimmy and Janice Pope, and their contractor, James Brown, to recover the balance due on materials furnished for the construction of the Popes' home and to enforce a mechanic's lien on the Popes' property. Brown cross-claimed against the Popes for the balance allegedly due on the construction contract. Following a hearing on the matter, the trial court entered judgment in favor of Young against Brown in the amount of $6,457.52, held that the Popes were jointly and severally liable to Young for $4,948.30, and held that the Popes were liable to Brown for $7,250.00. The Popes have appealed, alleging that the trial court erred in calculating damages. For the reasons stated below, we affirm the judgment of the trial court.
