District Attorney General Courts Building, 600 Market St Chattanooga, TN 37402 Judge: Hayes First Paragraph: On June 15, 1992, the appellant, Demetrice Lajuan Baker, pled guilty in the Hamilton County Criminal Court to first degree murder, especially aggravated robbery, aggravated kidnapping, and theft of property. The trial court imposed concurrent sentences of life imprisonment, twenty-five years, twelve years, and four years respectively. On November 21, 1994, the appellant filed a petition for post-conviction relief. The post-conviction court appointed counsel, who, on May 31, 1995, filed an amended petition. On September 6, 1995, the post-conviction court conducted an evidentiary hearing and dismissed the appellant's petition. On appeal, the appellant alleges ineffective assistance of counsel, specifically contending that trial counsel failed to adequately investigate evidence that the appellant was intoxicated at the time of the murder. The State asserts that the appellant has failed to carry his burden of proof. Following a thorough review of the record, we affirm the post-conviction court's dismissal of the appellant's petition.
