First Paragraph:

The defendant, Sonny M. Porter, was convicted by a Lauderdale County
jury of aggravated kidnapping, aggravated criminal trespass and two
(2) counts of simple assault.  For the offense of aggravated
kidnapping, he was sentenced as a repeat violent offender to life
imprisonment without parole.  On appeal, he presents the following
issues for our review: (1) whether the trial court erred in denying
defendant's motion to compel the state to elect which offenses it
would proceed upon; and (2) whether the evidence was sufficient to
sustain the aggravated kidnapping conviction.  We find no error and
affirm the judgment of the trial court.
