This appeal involves a dispute arising out of an oral contract to
manufacture compact disks and audio cassettes. The manufacturer filed
suit against the purchaser in the Chancery Court for Davidson County
seeking payment for undelivered disks and cassettes that were still
being held by the manufacturer. The trial court heard the case
without a jury and involuntarily dismissed the producer's complaint at
the close of its case-in-chief. On this appeal, the manufacturer
takes issue with the exclusion of evidence concerning the parties'
later credit agreement and with the evidentiary foundation for the
trial court's findings concerning the terms of their contract. We
have concluded that the trial court overlooked the uncontradicted
evidence that the parties modified their original agreement and
accordingly vacate the judgment.

This appeal involves a controversy surrounding the appointment of a
local city official. The mayor and the city manager of the City of
Berry Hill filed a defamation action in the Circuit Court for Davidson
County against two city residents who publicly questioned the
circumstances surrounding the interim appointment of a member of the
Board of Commissioners. The trial court granted the residents' motion
for summary judgment and dismissed the city officials' complaint. On
this appeal, the city officials assert that the trial court should not
have granted the summary judgment because the record contains evidence
that the residents knew or should have known that their critical
statements made to a local newspaper were false. We affirm the trial
court.
