STATE OF TENNESSEE v. EDWARD TALMADGE MCCONNELL
Court:TCCA
Attorneys:
Julie A. Rice, Knoxville, Tennessee, Jeff Kelly and Debbie Huskins,
Johnson City, Tennessee, for the appellant, Edward Talmadge McConnell.
Paul G. Summers, Attorney General and Reporter, Michael J. Fahey, II,
Assistant Attorney General, Joe Crumley, Assistant District Attorney
General, for the appellee, State of Tennessee.
Judge: OGLE
First Paragraph:
The appellant, Edward Talmadge McConnell, appeals his convictions by a
jury in the Washington County Criminal Court of aggravated rape and
failure to appear. For the offense of aggravated rape, the trial
court sentenced the appellant as a repeat violent offender to life
imprisonment without parole in the Tennessee Department of Correction.
For the offense of failure to appear, the trial court sentenced the
appellant as a career offender to a consecutive term of six years in
the Department. On appeal, the appellant presents the following
issues for our consideration: (1) Whether the evidence adduced at
trial is sufficient to support the appellantÕs convictions of
aggravated rape and failure to appear; (2) Whether the trial court
erred in declining to grant the appellant a mistrial; (3) Whether the
trial court erred in ruling that the appellantÕs prior convictions
would be admissible for impeachment purposes if the appellant chose to
testify; (4) Whether the trial court erred in sentencing the appellant
for the offense of aggravated rape. Following a review of the record
and the partiesÕ briefs, we affirm the judgment of the trial court as
modified.
