TRAVELERS INSURANCE COMPANY Court:TSC - Workers Comp Panel Attorneys: James R. Krenis, Hill & Boren, Jackson, Tennessee, for the appellant, Jimmy Hicks Paul Todd Nicks, Walker Law Office, Memphis, Tennessee, for the appellee, Travelers Insurance Company Judge: LOSER First Paragraph: This workers' compensation appeal has been referred to the Special Workers' Compensation Appeals Panel of the Supreme Court in accordance with Tenn. Code Ann. S 50-6-225(e)(3) for hearing and reporting to the Supreme Court of findings of fact and conclusions of law. In this appeal, the injured employee insists the trial court erred in disallowing his claim for failure to give timely written notice. As discussed below, the panel has concluded the evidence preponderates in favor of a finding that written notice was unnecessary because the employer had actual notice. The judgment of dismissal for lack of notice is therefore reversed, the trial court's conditional award of benefits is affirmed, and the cause is remanded for all purposes. http://www.tba.org/tba_files/TSC_WCP/hicksjimmy.wpd PLEASE FORWARD THIS E-MAIL!
