This program on the new Provisional Waiver regulation which will include a discussion about preparing a waiver case for submission to the USCIS. The Provisional Waiver regulation has generated some confusion with regard to who is eligible to take advantage of this program. Below are some of the key eligibility factors:

· The foreign national beneficiary is physically present in the United States;

Workplace bullying remains a major area of concern for employers. Many employers, however, are uncertain over whether to dismiss teasing or insults as innocuous or to treat complaints of such conduct as harassment. Although anti-discrimination laws do not protect a victim who was bullied for a reason other than his/her status as a member of a protected class, employers should not ignore this conduct, as it could become the basis of an employee’s claims for negligent hiring, negligent supervision, intentional infliction of emotional distress, assault, etc.
