House Passes 'Loser Pays' Bill

After more than two hours of debate, the Tennessee House voted 58-38 yesterday for a "loser pays" system that allows judges to assess fees of up to $10,000 on plaintiffs who bring suits determined to have "no basis in fact or law." Opponents contend the bill, HB 3124, will intimidate average citizens from going to court against big corporations. Several amendments were offered and defeated, including one that would have required defendants to pay plaintiff’s costs if their motions to dismiss are denied.
