Tennessee Local Government Forum 2016

Government law is an ever-changing area of practice with its unique blend of constitutional law, statutory law, and case law. This year's program will cover general provisions of the Tennessee's Open Records Act and discuss common records requests and issues working with school boards. Court Upholds Suspension for Nashville Attorney

The Tennessee Supreme Court today unanimously affirmed a six-month suspension of Nashville attorney Paul J. Walwyn’s law license for failure to act diligently in his representation of clients. The Board of Professional Responsibility suspended Walwyn in 2012 for six months, with 30 days active suspension and five months’ probation, for violating certain Rules of Professional Conduct. Walwyn appealed to the Chancery Court for Davidson County and later to the state Supreme Court, claiming there had been multiple constitutional errors. 2015 Amendments to the Federal Civil Rules (Effective December 1)

On December 1, 2015, significant amendments to the Federal Civil Rules will take effect. The amendments include changing the definition of discoverable information in Rule 26 by eliminating the phrase “reasonably calculated to lead to the discovery of admissible evidence” and incorporating an express requirement that the discovery sought be “proportional” to the needs of the case. The amendments also address sanctions for discovery abuses, handling of electronically stored information (ESI), and other issues that frequently arise in civil litigation.
