J. Thomas Smith, Jr. received his B.A. in 1969, and his J.D. in 1973 from Vanderbilt University. From 1973 to 1982, he served in the corporate legal department of a medium-sized multinational corporation. From 1976, he served as head of the department as Vice-President Law, where he supervised and budgeted the work of outside law firms in the U.S. and many foreign nations. He served as a principal in Donelson, Stokes & Bartholomew, PC, from 1982 to 1987, and from 1987 to 1990, as a shareholder in the first law firm in Tennessee with statewide offices, Heiskell, Donelson, Bearman, Adams, Williams & Kirsch, PC. While a member of those firms, his practice focused on corporate structure and related transactions, business litigation, and international and comparative advice to several multinational clients. A significant part of his corporate practice involved representing emerging entrepreneurs building their companies through angel or venture capital investments. From 1990 to 2006, his practice focused on in-house representation of companies in corporate, administrative and legislative matters in Tennessee and Washington, D.C. From 1994 to 2003, he engaged in prosecuting abortion malpractice lawsuits that secured $15 million in judgments or settlements for women damaged by abortion or their orphans. He has served on the Boards of the Republican Majority Issues Committee, the first conservative 527, America 21, a 501(c)(4) that challenged pastors to engage in the political process, Vision America Action, a 501(c)(4) organization led by Dr. Rick Scarborough, and the Family Action Council of Tennessee led by former State Senator David Fowler. Since 2006, his practice has focused on litigation-mediation in Tennessee on behalf of churches, not-for-profit groups and other clients. In 2008, he was a part of the legal team supported by the U.S. Justice Foundation representing McCain, Baldwin and Keyes electors in a declaratory judgment action seeking a determination of the “natural born” qualifications of all Presidential candidates. Since September of 2010, he has assisted Joe M. Brandon, Jr. as counsel for the plaintiffs in the challenge to the Rutherford County Regional Planning Commission site approval for the Islamic Center of Murfreesboro. He is admitted to practice before the Federal District Court for the Middle District of Tennessee, the Supreme Court of the United States, and has been admitted to practice pro-hac vice before various federal and state courts for specific litigation in a number of states.
