(2) Mediationcommunication  meansastatement,whetheroralorinarecordorverbalornonverbal,thatoccursduringamediationorismadeforpurposesofconsidering,conducting,participatingin,initiating,continuing,orreconveningamediationorretainingamediator.  (3) Mediator  meansanindividualwhoconductsamediation.  (4) Nonpartyparticipant  meansaperson,otherthanapartyormediator,thatparticipatesinamediation.  (5) Mediationparty  meansapersonthatparticipatesinamediationandwhoseagreementisnecessarytoresolvethedispute. X (a)Beforeacceptingamediation,anindividualwhoisrequestedtoserveasamediatorshall:  (1)makeaninquirythatisreasonableunderthecircumstancestodeterminewhetherthereareanyknownfactsthatareasonableindividualwouldconsiderlikelytoaffecttheimpartialityofthemediator,includingafinancialorpersonalinterestintheoutcomeofthemediationandanexistingorpastrelationshipwithamediationpartyorforeseeableparticipantinthemediation;and(2)discloseanysuchknownfacttothemediationpartiesassoonasispracticalbeforeacceptingamediation.
