AMaritalDissolutionAgreementwasapprovedinFebruary1995bywhichtheappelleeagreed,inaccordancewiththeChildSupportGuidelines,topay$528.64permonthforthesupportofhischildren.Hehadbeenemployedbyaguitarmanufacturingcompanyforanannualsalaryof$24,950.00.HewasdischargedJanuary3,1995forexcessiveabsenteeismdespitewarningsoftheconsequencesifhecontinuedhisdefianceoftheemployersrules. InAugust1995,beinginsubstantialarrearagewithhissupportobligation,theappelleefiledapetitiontomodifythejudgmententeredinMarch1995byreducinghischildsupportobligation. Heclaimedamaterialchangeincircumstanceshadoccurredinthathehadlosthisjobandwasfinanciallyunabletopay$528.64permonthforthesupportofhistwochildren.Theproofdevelopedthatheisayoungmaningoodhealth,isahighlyskilledluthierandlivesinaneconomicallyadvantagedcounty,towit,Davidson.Herecitedhiseffortstofindemploymentwhichherecountedasunsuccessful. Thetrialjudgefound:0 IconsiderthatMr.Andersonsearningcapacityistoearnatleast$10anhour.Hewaspreviouslyintheguitarbusinessearningabout$12.50anhour.Hewasearning$500aweekgross.Sotherehasgottobesometypeofjobthatsupportshimandhischildrenatleast$10anhour.Ifhegetsbacktoahigherlevelofemployment,hemustimmediatelynotifythecourtandchildsupportwillbeuppedtothatamount.Accordingly,thesupportobligationoftheappelleewasreducedto$440.00permonth. Wearerespectfullyconstrainedtodisagreewiththetrialjudge. First,theappelleewasunemployedwhenheagreedtopay$528.64permonth.Hehadbeendischargedformisconductsixweeksearlier.Therefore,hefailedtoshowamaterialchangeincircumstancesthatwouldjustifyareductioninhischildsupportobligation.Second,wethinktheappelleeis,forpracticalpurposes,wilfullyunderemployedandthathispotentialincomeasevidencedbyhisskillsandpreviousworkexperienceisthatwhichhewasearningbeforehisdischargeformisconduct.Tenn.Comp.R.&Regs.,Ch.124024.03(3)(d). Wethinkthejudicialsystemshouldlookwiththegravestdisfavoruponparentswhothroughtheirfaultordesignbecomeunderemployedinanefforttoevadetheirlegal,naturalobligationtosupporttheirchildren.SeeHarwellv.Harwell,612S.W.2d182,185(Tenn.App.1980).
