LaurenceE.Armour( claimant)filedsuitproseagainsttheStateofTennessee( defendant)beforetheTennesseeClaimsCommissionseekingdamagesforinjuriestohisleftthumbduetotheallegedmalpracticeoftwomedicalresidentphysiciansattheUniversityofTennesseeCenterforHealthCareSciencesinMemphis.Defendantfiledamotionforsummaryjudgment,whichtheCommissionergranted.Forreasonswewillrefertoinamoment,thiscourtpresumestheissuepresentedonappealiswhethertheClaimsCommissionerredingrantingsummaryjudgment.Wefindnoerrorandaffirm.̀ Claimantsbriefinthiscourtconsistsofthefollowingdocument,exceptforafewcopiesofhismedicalrecordsattachedinthenatureofexhibits:8  TheAppellant,Mr.LaurenceE.Armour,wishestoadvisethecourtthathewantsthiscaseplacedontheacceleratedcivilappealdocket.8  Mr.Armourhasnonewinformationorevidencethatcourtrecordsinyourfilealreadycontain.Therefore,inordertoexpeditejustice,Mr.Armourwillrelyupontherecord.Mr.Armourisstillhandicappedandsufferspaindailyfromthesurgicalactthatcausedinjurytohishandandwasdeliberatelyomittedfromallmedicalreportsonthedayofsurgery,March13,1992.Also,therecordshowthatcontinuedhiswillfulomissionunderoathduringdeposition,thuscommittingperjury.8  Dr.Eikermanalsocommittedtheactofwillfulomission.Bothdoctorsconspiredinordertograduatefrommedicalschoolwithoutablemishedrecord.Theomissionwasdeliberate,willful,andforpersonalgain.8  Upondeposition,Dr.Eikermantoldthetruth.Definingthewillfullyomittedsurgicalerroneousact.Therecordspeaksforitself.  Thiscourtisthoroughlyfamiliarwiththeresponsibilitiesaproselitigantassumeswhenthelitigantattemptstorepresenthimself.Weareawareoftheliberalityofconstructionwithregardtopleadingstowhichproselitigantsareentitled.Wearealsoawarethatproselitigantsmustfollowthesameproceduralandsubstantivelawastherepresentedparty.SeeIrvinv.CityofClarksville,767S.W.2d649,65253(Tenn.App.1988). Notwithstandingthenatureandsubstanceofclaimantsbrief,wehavereviewedthisrecordanddeterminedthatnotonlyhasclaimantfailedtofollowtheapplicableprocedurallaw,butalsothesubstantivelawinthiscase,particularlyasitrelatestohisclaimformedicalmalpracticeandsummaryjudgment.ClaimantfailedtoofferanyevidenceotherthandamagestoestablishaclaimformedicalmalpracticeunderT.C.A.2926115(a)(1980).Moreover,claimantfailedtointroduceanyevidencetorefutedefendantsevidencesubmittedinsupportofitsmotionforsummaryjudgmentthattheinjurytoclaimantsthumbcouldresultintheabsenceofnegligence,andthatthetreatingphysicianfollowedtheapplicablestandardofcareintreatingclaimant.Accordingly,thejudgmentoftheClaimsCommissionisaffirmed.Costsinthiscauseonappealaretaxedtoclaimant,forwhichexecutionmayissueifnecessary.      ________________________________________      TOMLIN,Sr.J.      ________________________________________      FARMER,J.
