Atthetimeoftrial,HusbandandWifewere57and54yearsold,respectively.Wifeisahighschoolgraduatewithfourquartersofcollege.Husbandobtainedhislawdegreein1964andcurrentlyservesasacriminalcourtjudgeinMemphis,earning$87,900annually.PriortohersecondmarriagetoHusband,Wifeworkedasasecretaryforahospitaladministrator.SheresignedinordertomarryHusbandandmovetoMemphis.Wifewasnotemployedoutsidethehomeuntil1991,whenshebeganworkingparttimeasapreschoolandBibleteacheratachurch.Shetestifiedthatsheisnotqualifiedtoteachinanyschoolsystem.Wifesgrossannualincomein1993was$4,500.Sheworksapproximately16hoursperweekandstatesthatsheisunabletoworkfulltimeforhealthreasons. TherecordindicatesthatWifeshealthproblemsincludethoracicoutletsyndrome,frozenshoulder,chronicsinusitisandbronchitis,irritablebowelsyndromeandosteoporosis.Wifetakesmedicationdailyduetotheremovalofherthyroidseveralyearsago.Shewaspreviouslydiagnosedwithuterinecancerforwhichsheunderwentaradicalhysterectomy.Wifetestifiedthathermostrecentpapsmearwasabnormal. Theparties24yearoldson,Greg,hasattentiondeficitdisorder.HeresideswithHusbandwhoalsofurnisheshisfoodandclothing.Gregcompletedhighschoolonscheduleandcurrentlyattendscollegestudyingbiomedicalengineeringtechnology.Husbandtestifiedthat [Greg]takeshiscoursesataslowerpace,duetothedisorder.Greghasattendedcollegeeverysemester,includingsummers,forthepast6years.Hesometimesisabletoenrollinonlyonecourseatatimedependingonthedifficultyofthesubjectmatter.AccordingtoHusband,Gregneedstocomplete fourorfivemorecoursestoobtainhisdegree.HusbandpaysforGregstuition,tutorialservicesasneededandbooks.GregisemployedparttimeattheShelbyCountySheriffsDepartmentearningapproximately$380permonth.HusbandstatesthatGregdoesnotapplyanyofhissalarytowardsschooltuitionandsupplies.AlthoughGreghasneverhadanindependentplacetolive,Husbandbelieveshissoncapableofearningsufficientfundstoprovideforhimself. [w]henhegetshisdegree.HusbandconfirmedthatGregdoesnotsufferfromanyphysicaldisabilityorillnessandisnotmentallyretarded.GregwastreatedwithRitalinforhisdisorderuntiltheageof12. Wifeagreesthathersonneedsassistance inhislivingandexpensesuntilcompletinghiseducation.She [doesnot]arguewithHusbandspaymentofGregsschooltuition,butstatedthatagrantmightbeavailabletoassistherson.ShetestifiedthatGreghadsuchagrant atonetime. Asconcernstheawardofalimony,thetrialcourtruledasfollows:8  TheCourtfindsthatdueto[Wifes]age,health,lackofmarketablejobskillsorexperienceandeducation,rehabilitationofthe[Wife]isnotfeasible.TheCourtfindsthat[Wife]willcontinuetohavelimitedemployability.TheCourtfurtherfindsthat[Husband]presentlymakesanetincomeof$5,350.00permonthandthat[Wife]averagesanincomeof$375.00permonth.TheCourtfindsthat[Husband]andsonhaveanticipatedexpensesof$4,593.00andthat[Wife]hasanticipatedexpensesof$3,425.00.TheCourtfindsthatbothpartieshavesignificantfinancialneedsandneitherwillbeabletoenjoytheirpriorlifestyle.ThecourtalsofoundthatWife,asahomemaker,hadcontributedtothemarriageandtoHusbandstwosuccessfulcampaignsforjudge. '   ׀Individingthemaritalproperty,thecourtawardedapproximately$105,000inassetstoWifeand$100,000toHusband. Ourreviewofthetrialcourtsdecisionis denovo upontherecordaccompaniedbyapresumptionofcorrectnessastothetrialcourtsfindingsoffact,unlessapreponderanceoftheevidenceisotherwise.Rule13(d)T.R.A.P.WefindapreponderanceoftheevidencetosupportthetrialcourtsfindingsregardingWifescontributiontothemarriage,Husbands muchgreaterearningcapacityandWifesinabilitytobeeconomicallyrehabilitated.However,wecannotagreewiththetrialcourtsinclusionwithinHusbandsexpensesallthoseincurredforthebenefitofthepartiesson.TherecordrevealsthatHusbandslistofmonthlyexpensesincludesthoseincurredforGregsdentalanduncoveredmedicalcosts,schooltuitionandsupplies,utilitiesandgroceries.TherecordindicatesthatGregiscapableofsomefinancialcontributionforhiscare.Husbandhasalsoincludedwithinhismonthlyexpensesapproximately$1,600forfirstandsecondmortgagesonthemaritalhome,whichaccordingtotherecord,hasbeensold.Husbandestimatedhismonthlyrentalexpensesat$1,185. Itiswellestablishedthatthemostcriticalfactorsinadjudginganawardofalimonyareneedandtheabilitytopay. See,e.g.,Loydv.Loyd ,860S.W.2d409,412(Tenn.App.1993).TheotherfactorsenumeratedinT.C.A.365101(d)arealsotobeconsidered,whenrelevant.Wifesaffidavitofmonthlyexpensesdenotesthatherhealthinsurancewillincreasetoaminimumof$500afterHusbandsobligationtocontinueheronhisinsurancepolicyissatisfied.Clearly,Wifeisinneedofsomeadditionalassistancetocoverthecostofherhealthinsurance.Weconcludethatbasedupontherecordbeforeus,andhavingconsideredallrelevantfactors,thatWifeisentitledtoanadditional$1,000permonthas alimonyinfuturo . AstoWifessecondissue,wefindanawardofherattorneysfeesforthisappealappropriate.Thiscauseis,therefore,remandedtothetrialcourtwithinstructionstodeterminesuchfeesasreasonable.
