ðorder€or€judgmentðð€was€notÏentered€until€January€24,€1997€when€the€Board€met€and€approved€the€minutes€of€theÏDecember€20€meeting.€€We€fail€to€find€where€that€appears€in€the€record.€€What€doesÏappear€is€the€application€dated€December€3,€1996€reflecting€a€hearing€date€ofÏDecember€20.€€Various€notices€to€the€public€and€to€affected€landowners€appear€in€theÏrecord€announcing€a€hearing€date€of€December€20.€€The€petition€itself€has€a€sectionÏon€which€to€show€the€action€of€the€Board.€€That€section€reflects€that€the€petition€wasÐ ¨9 26 Ðpresented€to€the€Board€on€December€20,€1996,€and€the€entry,€ð ðRelief€Denied,ðð€isÏcircled€on€the€form.€€It€is€true€that€the€place€on€the€form€showing€how€the€membersÏvoted€is€left€blank,€but€there€is€no€dispute€that€the€Board€voted€unanimously€to€denyÏthe€petition.€€The€form€is€signed€by€the€Board€secretary.ÌÌà Ø àà 0 àWe€think€the€Boardððs€order€or€judgment€was€entered€on€December€20,Ï1996.€€The€applicant€relies€on€the€case€of€òòCarter€v.€Board€of€Zoning€Appeals€of€CityÐ H@  Ðof€Nashvilleóó,€377€S.W.2d€914€(Tenn.€1964)€for€the€proposition€that€the€Boardððs€orderÐ (  Ðor€judgment€in€this€case€was€only€ð ðrenderedðð€on€December€20,€1996€and€not€ð ðenteredððÏuntil€the€Board€approved€the€minutes€in€January€of€1997.€€The€òòCarteróó€case,€however,Ð èà Ðstands€for€an€entirely€different€proposition.€€In€that€case€the€petition€for€certiorariÏalleged€that€the€Board€made€an€oral€ruling€on€February€11,€1963,€but€the€appellantÏfiled€a€petition€to€rehear€and€the€order€of€the€Board€was€not€entered€until€April€24,Ï1963.€€The€petition€for€certiorari€was€filed€on€April€25,€1963.ÌÌà Ø àà 0 àThe€Supreme€Court€held€that€if€the€facts€alleged€in€the€petition€were€true,Ïthe€petition€was€timely€filed.€€The€òòCarteróó€case€does€not€deal€with€the€effect€of€aÐ %  ÐBoardððs€action€in€approving€its€minutes€at€a€later€meeting.€€It€deals€only€with€a€factÏquestion€as€to€when€the€Boardððs€order€was€actually€entered.€€In€this€case€we€think€theÏrecord€before€the€Board€conclusively€shows€that€the€Boardððs€action€was€entered€onÏthe€record€on€December€20,€1996.ÌÌà@zz,êàò âthat€there€was€no€material€evidence€to€support€the€Boardððs€decision€and€that€theÐ È7À04 ÐBoard€acted€arbitrarily€based€on€the€prior€use€of€the€property€and€the€use€of€theÏsurrounding€property.Ìâ âÌà àWe€think€all€the€proof€is€to€the€contrary;€there€is€a€complete€lack€of€proofÏshowing€that€the€applicant€was€entitled€to€the€use€on€appeal.€€Although€the€zoningÏordinance€is€not€in€the€record,€the€parties,€without€objection,€quote€from€it€in€theirÏbriefs.€€They€agree€that€the€use€proposed€by€the€applicant€is€not€allowed€in€an€A„1Ïclassification.€€The€ordinance€does,€however,€recognize€that€the€Board€may€allowÏcertain€ð ðuses€on€appealðð€in€an€A„1€zone.€€These€uses€included€ð ðuses€permitted€orÏpermissible€on€appeal€in€a€C„1€neighborhood€commercial€districtðð€(Section€5.20.03(V))Ïand€ð ðother€similar€uses€as€reviewed€and€approved€by€the€Board€of€Zoning€Appeals.ðð€Ï(Section€5.20.03(W)).€A€C„1€neighborhood€commercial€district€is€described€in€theÏordinance€as€a€ð ðrestricted€commercial€district,€limited€to€a€narrow€range€of€retail,Ïservice€and€convenience€goods€only.ððÌÌà Ø àà 0 ü!àI€noticed€that€a€crane€and€some€hoppers€have€beenÏplaced€on€a€tract€of€land€located€on€Highway€231€South,Ïprior€owner€being€Mr.€Chester€Tidwell›.€€After€checking€theÏtax€records€I€find€you€as€the€new€owner€of€the€property.Ð ü!àThe€property€is€Parcel€27€on€Wilson€County€Tax€Map€114.€ÏThe€property€is€zoned€A„1€Agriculture.€€Mr.€œTidwell›€wentÏbefore€the€Board€of€Zoning€œAppeals›€December€1,€1989,Ïat€which€time€the€Board€granted€the€use€of€a€used€car€lotÏrepair€shop.€€The€property€being€Lot€5€Padgett€Estates.Ð
