à€This€case€involves€a€post„divorce€proceeding€to€modify€child€support.€€The€husband€lost€hisÏjob€and€filed€a€petition€to€reduce€child€support.€€The€trial€court€held€the€husbandððs€petition€inÏabeyance€for€a€period€of€time€and€later€reduced€the€husbandððs€child€support€obligation€retroactiveÏto€the€filing€of€the€petition.€€The€wife€appeals,€arguing€that€the€trial€court€improperly€made€aÏretroactive€modification€of€child€support.€€We€affirm.Ìà  àRespondent/Appellant€Bonita€Lyn€Moore€(ð ðWifeðð)€and€Petitioner/Appellee€Robert€PerryÏSandy€Ausbrooks,€Jr.€(ð ðHusbandðð)€were€divorced,€and€on€March€30,€1994€Husband€was€ordered€toÏpay€$1,600€per€month€child€support€for€the€partiesðð€three€children.€€At€that€time,€Husband€was€aÏregional€manager€with€Allstate€Insurance€Company€(ð ðAllstateðð)€and€child€support€was€based€uponÏhis€income€of€$6,600€per€month.€€On€March€20,€1996,€Husband€filed€a€petition€to€reduce€his€childÏsupport€obligation,€based€on€the€emancipation€of€one€of€the€children€and€a€decrease€in€his€income.Ìà  àThe€parties€dispute€the€facts€regarding€Husbandððs€decrease€in€income.€€At€a€hearing€on€JuneÏ18,€1996,€Husband€testified€he€was€involuntarily€laid€off€from€his€position€at€Allstate€in€July€1995,Ïand€that€he€subsequently€formed€an€independent€insurance€agency.€Wife€argued€that€HusbandÏvoluntarily€left€his€position€with€Allstate€to€form€the€independent€agency.€€In€an€order€entered€onÏAugust€23,€1996,€the€trial€court€found€that€the€oldest€child€had€reached€the€age€of€majority€and€setÏchild€support€at€$1,481€per€month€for€the€partiesðð€two€remaining€minor€children.€€The€child€supportÏaward€was€based€on€Husbandððs€ð ðprior€ability€to€earnðð€$6,600€per€month.€€In€addition,€the€trial€courtÏheld€that€the€issue€of€reducing€child€support€based€on€a€decrease€in€Husbandððs€income€was€ð ðreservedÏas€[it€is]€considered€premature.ðð€€The€trial€court€noted€that€ð ð[t]hese€items€may€be€addressed€in€theÏfuture€by€the€filing€of€an€amended€and€supplemental€petition,€which€would€relate€back€to€the€originalÏpetition€for€possible€retroactive€application.ðð€€The€trial€court€declined€to€award€Wife€attorneyððs€fees.€Ìà  àOn€November€25,€1997,€Husband€filed€an€amended€and€supplemental€petition€to€modifyÏchild€support,€alleging€a€decrease€in€monthly€income€greater€than€fifteen€percent.€€At€a€hearing€onÏJanuary€14,€1998,€Husband€again€testified€that€he€was€involuntarily€laid€off€from€his€position€atÏAllstate.€€œThe€record€reflects›€that€he€received€severance€benefits€from€Allstate€of€$5,794.47€perÏmonth€until€March€1996.€€The€record€œalso€indicates›€that€in€September€1995,€Husband€started€anÏindependent€insurance€agency€and€represented€American€National€Insurance€Company€(ð ðAmericanÏNationalðð)€as€an€independent€agent.€€Beginning€in€October€1995,€Husband€received€a€monthlyÐ ;`6: Ðadvance€on€commissions€of€$2,765€from€American€National;€this€continued€for€four€months.€€ForÏthe€next€two€months,€Husband€received€$2,262€per€month€from€American€National€as€a€draw€againstÏcommissions.€€Subsequently,€in€March€1996,€American€National€suspended€Husbandððs€advancesÏagainst€his€commissions.€€During€the€period€of€time€in€which€Husband€was€receiving€from€AmericanÏNational€advances€against€commissions,€his€earned€commissions€were€not€sufficient€to€cover€theÏadvances.€€Consequently,€by€March€1996,€Husband€owed€American€National€$13,152.74.€€At€theÏœNovember€hearing,›€Wife€again€contended€that€Husband€voluntarily€left€his€position€at€Allstate€andÏsubmitted€into€evidence€Husbandððs€contract€with€American€National,€dated€June€15,€1995.€€HusbandÏtestified€that€he€interviewed€with€American€National€in€May€or€June€1995,€but€did€not€sign€theÏcontract€at€that€time.€€He€testified€that€he€did€not€put€the€June€15€date€on€the€contract.€€At€the€end€ofÏœJuly›€1995,€he€received€verbal€notice€that€Allstate€would€eliminate€his€job€position€as€part€of€itsÏreduction€in€force.€Ì€à  àIn€an€order€entered€February€12,€1998,€the€trial€court€held€that€Father€ð ðthrough€no€fault€ofÐ 0€ Ðhis€ownðð€lost€his€employment€in€July€1995.€€In€addition,€the€trial€court€found,€in€part:ÌÒ°ÒÒ°ÒÓÓœ[T]hat›€for€the€period€of€time€from€March€20,€1996,€through€January,€1998,€Father€hadÏsuffered€a€significant€variance€in€his€income€sufficient€to€warrant€a€reduction€in€hisÏchild€support€to€$823.00€per€month€based€upon€his€average€earnings€of€$3,418.00€perÏmonth.€€Accordingly,€from€the€period€of€March,€1996,€through€January,€1998,ÏFatherððs€child€support€shall€be€retroactively€reduced€from€$1,481.00€per€month€toÏ$823.00€per€month.€€Said€retroactive€reduction€results€in€a€$658.00€per€month€creditÏto€œFather›€for€22€months€which€totals€$14,476.00.€€Father€shall€receive€said€credit€inÏthe€form€of€œa€reduction›€in€his€current€child€support€in€the€amount€of€$658.00€perÏmonth€for€the€next€22€months.ÌÒ°vÒÒ°„ÒÌÓÓFrom€this€decision,€Wife€now€appeals.Ìà  àOn€appeal,€Wife€argues€that€Husband€voluntarily€left€Allstate,€resulting€in€€underemploymentÏin€contravention€of€the€child€support€guidelines.€€Wife€contends€that€the€trial€court€erred€inÏcontinuing€Husbandððs€original€petition€to€reduce€child€support,€erroneously€allowed€Husband€to€fileÏa€supplemental€petition,€and€improperly€ordered€a€retroactive€reduction€in€child€support.€€Wife€alsoÏargues€that€the€trial€court€erred€in€declining€to€grant€her€request€for€attorneyððs€fees€œincurred€as€aÏresult€of€the€petitions€and€hearings.›€€In€addition,€Wife€seeks€attorneyððs€fees€for€this€appeal.Ìà àWife€argues€first€that€the€evidence€preponderates€against€the€trial€courtððs€finding€thatÏHusband€lost€his€job€with€Allstate€ð ðthrough€no€fault€of€his€own.ðð€€She€maintains€that€Husband€quitÏhis€job€at€Allstate€in€order€to€start€his€own€independent€insurance€agency.€€In€support€of€herÏcontention,€Wife€relies€on€Husbandððs€contract€with€American€National,€dated€June€15,€1995,€overÏa€month€before€Husband€was€informed€by€Allstate€that€he€would€be€laid€off.€€Husband€testified€thatÏhe€interviewed€with€American€National€in€May€or€June€but€that€he€did€not€sign€the€contract€at€thatÏtime.€€Husband€testified€that€he€did€not€date€the€contract.€€He€noted€that€the€contract€with€AmericanÏNational€was€not€effective€until€September€1,€1995,€and€that€he€was€not€notified€of€his€terminationÏby€Allstate€until€the€end€of€œJuly›€1995.€€In€addition,€it€is€undisputed€that€Husband€received€aÏseverance€package€from€Allstate.€€We€recognize€ð ðthe€well„established€principle€that€the€trial€courtÏis€in€the€best€position€to€assess€the€credibility€of€the€witnesses;€accordingly,€such€determinations€areÏentitled€to€great€weight€on€appeal.ðð€€ò Ð836€S.W.2d€563,€566€(Tenn.€œApp.›€œ1991)).›€€Viewing€the€record€as€a€whole,€the€evidence€does€notÏpreponderate€against€the€trial€courtððs€finding€that€Husband€lost€his€job€through€no€fault€of€his€own.€ÏThe€evidence€supports€the€trial€courtððs€conclusion€that€Husbandððs€job€change€created€a€significantÏvariance€in€his€income€and€warranted€a€modification€in€child€support.Ì€€à  àWife€also€argues€that€the€trial€court€erred€in€holding€open€Husbandððs€first€petition€to€modifyÐ P( #& Ðchild€support,€and,€after€a€second€petition€was€filed,€reducing€Husbandððs€child€support€obligationÏretroactive€to€the€date€of€the€filing€of€the€first€petition.€€Wife€maintains€that€retroactive€modificationÏof€child€support€is€prohibited,€citing€œò òòòRutledge›€v.€Barrettóóó ó,€802€S.W.2d€604€(Tenn.€1991).€€òòÐ ð-@), Ðà  àœóóIn›€ò òòòRutledge,€ó óóóthe€Court€observed€that€ð ð[r]etroactive€modifications€are€plainly€unauthorized;€Ð Ð/ +.
