ðtheÏCityðð),€from€the€decision€of€the€Rutherford€County€Circuit€Court€awardingÏ$27,036.10€to€plaintiff/appellee,€Bonnie€Mae€Bain,€for€injuries€suffered€by€Ms.ÏBain€as€a€result€of€negligence€on€the€part€of€two€of€the€Cityððs€police€officers.€€TheÏfacts€out€of€which€this€matter€arose€are€as€follows.€ÌÌà àMurfreesboro€Police€Officer€Lannye€Winnett,€now€deceased,€was€onÏfoot€patrol€at€the€January€Street€Housing€Projects€on€15€February€1992.€€OfficerÏWinnett€went€to€Ms.€Bainððs€apartment€because€nearby€residence€wereÏcomplaining€of€noise.€€Officer€Winnett€was€unable€to€convince€Ms.€Bain€toÏcooperate€and€determined€she€was€under€the€influence€of€an€intoxicant.€€OfficerÏWinnett€called€for€backup.€€Officer€Billy€Gay€arrived€on€the€scene€and€stoodÏsome€distance€from€Ms.€Bainððs€front€door.€€Ms.€Bain€stood€in€the€doorway€andÏsupported€herself€by€holding€onto€the€handle€of€the€screen€door.€€Officer€GayÏobserved€Ms.€Bain€and€heard€her€yelling€and€screaming,€but€was€unable€toÏdetermine€whether€Ms.€Bain€was€intoxicated.€€Officer€Winnett€was€standing€ten€toÏfifteen€feet€to€Ms.€Bainððs€right.€€Officer€Winnett€did€not€tell€Officer€Gay€that€Ms.ÍBain€was€drunk.€€In€addition,€neither€officer€knew€Ms.€Bain€suffered€a€mentalÏdisability€or€lack€of€coordination.ÌÌà àWithout€discussing€it€with€Officer€Winnett,€Officer€Gay€decided€toÏarrest€Ms.€Bain.€€He€went€to€the€door,€pulled€the€screen€door€open,€and€took€Ms.ÏBain€by€the€left€arm.€€Ms.€Bain€fell€and€sustained€injuries€to€her€face€andÏshoulder.€€The€officers€testified€Ms.€Bain€did€not€attempt€to€break€her€fall€byÏputting€her€right€arm€forward€or€by€bending€her€knees.€€Officer€GayÏinstinctively€pulled€back€on€Ms.€Bainððs€arm€as€she€fell€to€break€her€fall.€€OfficerÏGay€took€Ms.€Bain€to€the€emergency€room€where€doctors€treated€Ms.€Bain€for€aÏbroken€nose€and€dislocated€shoulder.€€The€emergency€room€physician€performedÏa€blood€alcohol€test€which€revealed€Ms.€Bainððs€blood€alcohol€level€was€.18.€ÏOfficer€Gay€then€transported€Ms.€Bain€to€the€local€jail.€€A€court€later€convictedÏMs.€Bain€of€public€drunkenness€and€disorderly€conduct.ÌÌà àSubsequently,€a€number€of€doctors€treated€Ms.€Bain€at€MiddleÏTennessee€Medical€Center,€Baptist€Hospital,€and€Vanderbilt€Medical€Center.€€HerÏmedical€bills€totaled€$12,594.80.€€Doctor€John€Lamb€performed€surgery€on€Ms.ÏBainððs€shoulder.€€Doctor€Lamb€rated€Ms.€Bainððs€disability€to€her€arm€before€theÏincident€at€œten€to€twelve€percent›€and€at€œten€to€fifteen€percent›€after€the€surgery.ÌÌà àMs.€Bain€filed€her€complaint€on€11€February€1993.€€She€named€the€CityÏof€Murfreesboro,€Officer€Winnett,€Officer€Gay,€and€Officer€John€Doe€asÏdefendants.€€She€alleged€the€officers€were€negligent€and€the€City€was€liable€forÏthe€officersðð€negligence.€€The€City€and€Officers€Winnett€and€Gay€filed€an€answer.€ÏThe€answer€included€an€assertion€that€the€City€did€not€employ€an€Officer€JohnÏDoe.€€The€answering€defendants€claimed€they€were€immune,€the€GovernmentalÍTort€Liability€Act€limited€Ms.€Bainððs€recovery,€and€Ms.€Bain€was€comparativelyÏnegligent.€€By€agreed€orders€entered€29€January€1996,€the€court€dismissed€theÏclaims€against€Officers€Winnett€and€Gay€individually.€€ÌÌà àThe€court€entered€a€detailed€order€after€hearing€the€case.€€The€courtÏmade€the€following€œfindings:›ÌÓÓà8 àIt€appears€to€the€Court€that€as€the€Plaintiff€stood€at€the€door€œto›Ïher€residence,€with€the€screen€door€partially€open,€œholdingÏonto€that€door,€that›€she€was€in€fact€using€the€door€to€supportÏherself.€€When€Officer€Gay€approached€the€Plaintiff€withoutÏotherwise€making€his€presence€known,€it€appears€that€theÏPlaintiff€was€startled,€the€screen€door€was€moved€forward€byÏthe€officer,€and€the€officer€took€the€Plaintiff€by€the€arm.€€AsÏpreviously€stated,€the€Court€finds€that€the€evidenceÏpreponderates€in€favor€of€a€finding€that€the€officer€œalso€pulled›Ïthe€Plaintiffððs€arm€slightly€forward.€€All€of€these€factors,Ïcombined€with€the€Plaintiffððs€disabilities€which€manifestÏthemselves€in€lack€of€coordination,€œplus›€the€effect€of€alcoholicÏbeverages€which€the€Plaintiff€had€consumed,€all€contributed€toÏthe€Plaintiffððs€fall.€€The€Court€finds€that€there€was€no€intentionÏwhatsoever€on€the€part€of€either€of€the€officers€to€inflict€anyÏharm€or€injury€to€the€Plaintiff.€€The€Court€finds,€however,Ïbased€upon€the€œevidence,›€that€the€officer€was€œnegligent›€in€hisÏdealing€with€the€Plaintiff.ÌÓ&` Ü` ä <œ ’X&Óà8 àà àIt€is€not€the€finding€of€the€Court€that€the€City€or€itsÏpolice€officers€are€insurers€of€the€safety€of€a€person€who€isÏplaced€under€arrest.€€œAt›€the€same€time,€officers€workingÏtogether€at€the€scene€where€an€individual€is€placed€under€arrestÏhave€a€duty€to€communicate€with€each€other€in€a€mannerÏconsistent€with€the€circumstances€which€are€found€at€the€scene,Ïfor€the€safety€of€each€other,€the€safety€of€the€individualÏarrested,€and€the€safety€of€such€victims€and€bystanders€as€mayÏbe€present€at€the€scene.€€In€addition€to€a€duty€to€communicateÏwith€each€other,€officers€have€a€duty€to€observe€suchÏcircumstances€as€may€be€apparent€and€in€their€plain€view.€ÏThey€have€a€duty€to€draw€such€conclusions€from€the€evidenceÏbefore€them€as€might€be€drawn€by€a€reasonable€police€officerÏwith€the€experience€and€training€possessed€by€the€officerÍwhose€duties€are€being€determined.€€Further€such€officers€haveÏa€duty€to€recognize€circumstances€in€which€a€person€arrestedÏmay€face,€including€drunkenness,€incapacity,€or€infirmities€ofÏeither€advanced€age€or€tender€years€to€the€extent€that€œsuch›€mayÏbe€open€and€obvious.€€Officers€further€have€œ›œthe›€duty€not€toÏtake€actions€which,€under€all€of€the€circumstances,€reasonablyÏwould€place€the€arrested€individual€in€a€position€of€potentialÏdanger.€.€.€.€[I]n€the€present€case,€it€appears€that€the€officer€inÏquestion€had€a€duty€to€recognize€the€Plaintiffððs€condition€beingÏunder€the€influence€of€an€intoxicant,€and€consider€that€givenÏthe€agitated€state€in€which€he€found€the€Plaintiff,€she€might€inÏfact€have€been€unstable€on€her€feet,€and€that€she€might€beÏinclined€to€fall€were€the€door€which€she€was€holding€to€beÏpulled€forward€and€a€hand€however€gently€placed€upon€herÏarm€pulling€her€forward,€however€slightly.ÌÓ€ÓÌÓ€ÓIn€the€end,€the€court€concluded€both€parties€had€acted€negligently€and€allocatedÏsixty„five€percent€of€the€fault€to€the€City€and€thirty„five€percent€of€the€fault€toÏMs.€Bain.€€As€a€result€of€these€findings,€the€court€awarded€Ms.€Bain€$27,036.10Ïin€damages.€€The€court€also€ordered€Ms.€Bain€to€provide€a€proper€individual€forÏthe€court€to€entrust€with€Ms.€Bainððs€damages€for€Ms.€Bainððs€benefit.€€The€CityÏfiled€a€timely€notice€of€appeal.šÌÌà àThe€œCity›€has€raised€six€issues.€€œWe›€are€of€the€œopinion,€however,›€œthat€the›Ïevidence€fully€supports€the€findings€of€the€trial€œcourt.€€There›€is€no€error€in€theÏfindings€of€œfact,›€œand›€œthere›€is€no€error€in€the€courtððs€determination€of€the€law.€€œÌÌà àTherefore,€we›€affirm€the€judgment€of€the€trial€court€in€all€œrespects€andÏremand€the€case€to€the€trial€court€for€further€necessary€proceedings.€€Costs€onÏappeal€are€taxed€to€defendant/appellant,€the€City€of€Murfreeboro.€€€€à
