Thisappealarisesfromadivorcecase.Allissueswerestipulatedexcepttheissueofappellant'srightofvisitationwiththeparties'minorchild.Thetrialcourtgrantedrestrictedvisitationprivilegestotheappellant.Wereversethejudgmentofthetrialcourtandremandthecaseforafurtherhearing. Theappellantchallengesthetrialcourt'sjudgmentinrestrictingtheevidencewhichshewasallowedtopresentinthetrialofhercase. Webelievethatthecasemustbereversedfortworeasons.Firstly,thecourtheardonlythetestimonyofthepartiesanddeniedtheappellant,overtheobjectionsofherattorney,anopportunitytopresentthetestimonyofotherwitnesseswhichwerepresenttotestifyinthecase.Whiletherewasnoofferofproof,wefeelthat,underthecircumstancesofthecase,wherethetrialcourtdeclinedtohearanyproofotherthanthatoftheparties,noofferofproofisnecessary.Itisevidentfromcommentsofcounselthatthetestimonyofthewitnesseshadadirectbearingontheissuebeforethecourt.Wefeel,therefore,thatthesubstanceoftheevidencewasapparentfromthecontext.SeeRule103,paragraphs(a)(2)and(d),TennesseeRulesofEvidence. Secondly,thejudgmentfromwhichthisappealistakenisnotafinaljudgmentfromwhichanappealasofrightlies.SeeRule54.02,TennesseeRulesofCivilProcedureandRule3,TennesseeRulesofCivilProcedure.Thecourt'sfinaldecreespecificallyprovidedthat"[a]lladditionalvisitationpreviouslyagreedtobythepartiesissuspendedpendingbothpartiesattendingparentingclassesandafurtherreviewbeforethecourt...."Obviously,aninterlocutoryappealundereithertheprovisionsofRule9or10oftheTennesseeRulesofappellateprocedurewouldbetheappropriatevehicletobringthisactionbeforethiscourtforreview. Thejudgmentofthetrialcourtisreversedandthecaseisremandedtothetrialcourtforafullhearingofallrelevantandmaterialevidence.Insodoing,weneitherexpressanopiniononanyissuerelatingtothemeritsofthecasenordoweintendforthisopiniontorestrictinanywaythediscretionofthetrialcourtinrefusingtolimitcumulativetestimony.
