Decedent,AvisBass,diedonApril16,1990,leavingaLastWillandTestamentthatnamedhisdaughter,DonnaBassGroff,asthebeneficiary.RuthBassfiledaPetitionofSurvivingSpouseforElectiveShare,YearsSupportandExemptPropertyandApplicationforHomestead.Thedecedentsestatecontainedassetstotaling$33,665.21.RuthBasstestifiedthatherannuallivingexpenseswere$14,288.73,andthatshereceived,outsideoftheprobateestate,$30,000.00inlifeinsurance,atrailerworth$9,000.00,andmotorhomeworth$24,000.00,atruckworth$7,675.00,certainrealestateworth$23,000.00,andbankaccountsworth$6,139.35. ThepertinentissueattrialwaswhethertheversionofT.C.A.302102thatwasineffectatthetimeofthedecedentsdeathappliedtothepresentaction,orwhetherthe1993amendmenttoT.C.A.302102applied.In1990,atthetimeofthedecedentsdeath,T.C.A.302102(a)provided:8 8 [T]hesurvivingspouseofanintestate,oraspousewhodissentsfromadecedentswill,isentitledtoareasonableallowanceinmoneyoutoftheestateforhisorhermaintenanceduringtheperiodofone(1)yearafterthedeathofthespouse,accordingtohisorherpreviousstandardofliving,takingintoaccounttheconditionoftheestateofthedeceasedspouse.8 8 ̜In1993,T.C.A.302102(a)wasamendedtoaddthefollowingsentenceattheendoftheaboveprovision:8 8 Thecourtmayconsiderthetotalityofthecircumstancesin7  XXdXXd7fixingtheallowanceauthorizedbythissection, includingassetswhichmayhavepassedtothespouseoutsideprobate. T.C.A.302102(a)(Supp.1995)(emphasisadded). Thetrialcourtruledthatthe1993amendmenttotheyearssupportstatuteaffectedsubstantiverightsandshouldnotbeappliedretrospectively.ThetrialcourtfurtherruledthatthestatutethatwasineffectatthetimeofthedecedentsdeathpreventedthecourtfromtakingintoconsiderationthepropertyandassetsthatRuthBassreceivedoutsideoftheestate.Accordingly,thetrialcourtawardedRuthBass$14,000.00asayearssupport. Appellanthasraisedtwoissuesforourconsideration,whichare:(1)whetherthetrialcourterredinrulingthatthe1993amendmenttoT.C.A.302102affectedsubstantiverightsandshouldnotbeappliedretrospectively;and(2)whetherthetrialcourterredinawarding$14,000.00asayearssupportbasedonT.C.A.302102asitexistedatthetimeofthedecedentsdeath. WefindappellantsfirstcontentiontobewithoutmeritbasedonthedecisionofthiscourtinInre:EstateofFrakerv.Blount,No.01A019411GS00528,1995WL134514(Tenn.App.March29,1995).InFraker,thecourtheldthatthe1993amendmenttoT.C.A.302102couldnotbeappliedretrospectively,andthatthesurvivingspousesrighttoayearssupportshouldbedeterminedpursuanttothestatuteineffectatthetimeofthedecedentsdeath.Id.at*2. Appellantarguesthatifthiscourtdeterminesthatthe1993amendmentshouldnotbeappliedretrospectively,theevidencepresentedattrialandthestatuteinexistenceatthetimeofthedecedentsdeathdonotsupportthetrialcourtsawardofayearssupport.Accordingtoappellant,thesizeoftheestateobviatesRuthBassneedforsupportandtoallowsuchsupportwouldseverelydepletetheestate.Werejectappellantscontentionsinthisregard. InPhippsv.Watts,781S.W.2d863(Tenn.App.1989),thecourtstated:8 8 [T]heexecutorarguesthat,sincethewidowisabletoprovideforherselfoutoffundsthatpassedtoherasconsequenceofthedeathofthedecedent,thecourtshouldreducetheamountawarded.Wecanseenothinginthestatutethatwouldallowtheresultsoughtbytheexecutor.Thecasesinterpretingthestatutehavesaidthatthestatuteistobeconstruedliberallyinfavoroftherightofthewidow.Acuffv.Daniel,215Tenn.520,387S.W.2d796(1965).WefindnoauthorityinTennesseeforconstruingthestatutetomeanthattheprobatecourtshouldnotallowayear'ssupportifthesurvivingspouseisabletosupporthimselforherself.Id.at867. TheCourtinPhippsalsostatedthatthetrialcourt,indeterminingyearssupport,shouldconsiderwhethertheestatewouldbeseriouslyimpairedordepleted.Id.at867.Inthepresentcase,however,theyearssupportawarddoesnotcompriseevenhalfofthedecedentsestate.
