Thisdisputearoseovertheuseofaroadwayseparatingthepartiesproperties.TheChancellordeterminedthatdefendantshadreconstructedtheroadwayandrendered impassable theremainingportionoftheoldroadway.TheChancellorwasoftheopinionthat thereisacommoneasementbetweentheparties andconcluded:0 0 sincethedefendantshavemadetheimprovements,itisnotonlyfairbutpertinentthattheplaintiffshavetherightofingressandegressovertheroad,buttheywillberequiredtocontribute$1,500.00tothedefendantsfortheworkthelatterpeopledidinmakingsuchrepairs.Theplaintiffsshallcontinuetosharetheirpartofthemaintenanceexpenseoverthepartoftheroadusedbythem.  Onappeal,defendantsinsisttheevidencedoesnotsupportthefindingsbytheChancellor.Thefindingscometouswithapresumptionofcorrectness,unlesstheevidencepreponderatesagainstthefindingsbytheTrialJudge.T.R.A.P.Rule13(d).  Inreviewingtheevidencedenovowefindthatthedisputedoriginalroadwaywasonehalfoneachofthepartiesland,withtheboundarylineessentiallybeingthecenteroftheroadway.Theevidencealsoestablishesthattheroadhadbeenusedbytheownersandotherslonginexcessoftwentyyears.  Defendantselectedtobuildorreconstructtheroadway,andwhilethereisnosurveyintherecordestablishingtheexactboundarybetweentheparties,theevidenceestablishesthatthemaintraveledportionofthereconstructedroadwayisessentiallyondefendantsland,butsubstantiallyincludestheportionoftheoldroadwaywhichwasondefendantsland.Theevidencealsoestablishesthatfilldirthasspilledontoplaintiffshalfoftheoldroadway,anddrainageditchesandpipesencroachontheremainderoftheoldroadbed.TheChancellorfoundthatthenewconstruction nowrendersthelowersectionoftheroadwayimpassable .Oneoftheplaintiffswitnessestestified,withoutobjection,asfollows:0 0 Q.0 Andexceptforputtinginculvertstocrossthecreek,youcanbuildaroadonyourpropertyjustastheWilliamsdidtoaccomplishthesamepurposethatyouvejustdescribed;isthatcorrect?0 0 A.0 Isupposethatcouldbedonewithagreatamountofexpense.Butwehadaccesstohalf,bythepropertyline,oftheoldroadbedwhichhasnowbeendestroyedbytheiractions.  TheTrialJudgeisinthebestpositiontojudgethecredibilityofthewitnesses,andtheevidencedoesnotpreponderateagainsthisfindingonthisissue.T.R.A.P.Rule13(d).  Next,defendantsinsistthatplaintiffsdidnotestablishaneasementtousetheoldroadway,becausetheydidnotdemonstratethattheiruseoftheoriginalroadwaywasadverse.Wecannotagree.WeheldinKnightv.Utz,673S.W.2d161(Tenn.App.1984)thatmutualusebyadjacentpropertyownersofaroadwayseparatingthepropertiesandlyingpartiallyoneachproperty,wouldbeadversetotheseparateorexclusiveusebyeither.Accordingly,weconcludethatplaintiffsestablishedarighttousetheoriginalroadway.  Thefactthattheconstructionofthenewroadwaypreventstheuseoftheoldroadwayandthefurtherfactthatthenewroadwayliesinpartontheeasementondefendantssideofthepropertyline,establishesanadequatebasisfortherelieffashionedbytheChancellor.Wefindtheremainingissuestobewithoutmerit,andaffirmthejudgmentoftheϜChancellor.
