InthisactionappelleewasgrantedanexparteorderofprotectionpursuanttoT.C.A.363601,etseq.,buttheorderexpiredpriortothemandateddateofhearing.Subsequently,theTrialJudge,uponanevidentiaryhearing,issuedanorderofprotectionagainstappellant.  Appellantsissueisframedthus:0 0 whethertheTrialCourthadsubjectmatterjurisdictionofapetitionforanorderofprotection,whenitfailedtoholdamandatedhearingwithintherequiredtendayperiod.  TheTrialJudgeheldtheunderlyingpetitionfortheorderremainedineffect,andacteduponthepetitionandevidenceingrantingthesubsequentorder.WeagreethattheTrialCourthadjurisdictionofthematter.  AppelleeinsiststhatthematterremainedbytheTrialCourtafterexpirationoftheexparteorderbecausethisinterpretationofthestatuteisconsistentwiththelegislativeintenttoprotectvictimsofdomesticviolence.Thestatuteprovidesinpertinentpart:0 0 363605.ProtectionorderExtensionHearingCostsandattorneysfees. (a)Uponthefilingofapetitionunderthispart,thecourtsmayimmediately,forgoodcauseshown,issueanexparteorderofprotection.Animmediateandpresentdangerofabusetothepetitionershallconstitutegoodcauseforpurposesofthissection.0 0  (b)Withinten(10)daysofserviceofsuchorderontherespondentunderthispart,ahearingshallbeheld,atwhichtimethecourtshalleitherdissolveanyexparteorderwhichhasbeenissued,orshall,ifthepetitionerhasprovedtheallegationofabusebyapreponderanceoftheevidence,extendtheorderofprotectionforadefiniteperiodoftime,nottoexceedone(1)yearunlessafurtherhearingonthecontinuationofsuchorderisrequestedbytherespondentorthecomplainantinwhichcase,onpropershowingofcause,suchordermaybecontinuedforafurtherdefiniteperiodofone(1)yearafterwhichtimeafurtherhearingmustbeheldforanysubsequentoneyearperiod.Anyexparteorderofprotectionshallbeineffectuntilthetimeofthehearing.Ifnoexparteorderofprotectionhasbeenissuedasofthetimeofthehearing,andthepetitionerhasproventheallegationofabusebyapreponderanceoftheevidence,thecourtmay,atthattime,issueanorderofprotectionforadefiniteperiodoftime,nottoexceedone(1)year.̜Noreportedcasehasbeencitedinterpretingthisstatute.ThereisnoindicationinthestatutethatthelegislatureintendedthattheCourtwouldlosejurisdictionifitdidnotactonthematterwithinthetendaytimeframealbeittherestrainingorderwouldloseitsefficacy,noristhereanysuggestionthattheCourtwouldlosejurisdictiontoissueanordersubsequently.Thestatuteprovidesifnoexparteorderofprotectionhasbeenissuedpriortothetimeofthehearing,theTrialJudgeisexpresslyauthorizedtoissuetheorderofprotectionuponproofofabusebyapreponderanceofevidence.Accordingly,weholdthattheTrialCourtretainedjurisdictiontoissuetheprotectiveorder.
