àThe€sole€issue€presented€in€this€appeal€is€whether€theÏWife/Appellant€is€entitled€to€post„judgment€interest€on€a€judgment€ofÏ$50,000€awarded€her€by€the€decree€of€divorce€entered€December€28,€1992.Ìà àThe€pertinent€facts€are€that€this€matter€arose€out€of€a€divorceÏaction€from€the€Williamson€County€Chancery€Court.€€The€divorce€decree,Ïòòinteróó€òòaliaóó,€awarded€the€residence€to€the€Husband€and€a€business€known€asÏFranklin€Jewelry€and€Loan€Company,€Inc.€€The€trial€court€awarded€the€WifeÏcertain€real€estate€upon€which€were€located€three€apartments€and€as€partÏof€the€equalization€of€the€equities€between€the€parties,€a€money€judgmentÏagainst€the€Husband€of€$50,000€cash.€€Wife€appealed€on€two€issues:€€(1)Ïthe€award€of€the€marital€residence€to€the€Husband,€and€(2)€the€duration€ofÍthe€rehabilitative€alimony.€€She€raised€no€issue€concerning€the€$50,000Ïjudgment.€€Husband€did€not€appeal;€however,€he€did€petition€the€trial€courtÏsubsequently€to€allow€sale€of€the€residence€awarded€to€him€by€theÏjudgment.€€The€court€held€it€lacked€jurisdiction€due€to€the€pending€appealÏby€Wife.€€On€October€7,€1994,€the€Court€of€Appeals€affirmed€the€trialÏcourt's€ruling€in€the€divorce€decree.€€Subsequently€on€December€14,€1994,ÏHusband€filed€a€petition€to€require€Wife€to€comply€with€divorce€decree€byÏexecuting€a€quitclaim€deed€to€the€residence€and€to€transfer€stocks€sheÏowned€in€the€jewelry€and€loan€company€to€the€Husband.€€HusbandÏconcurrently€paid€into€the€court€the€$50,000€award.€€Wife€filed€a€counter„petition€asking,€òòinteróó€òòaliaóó,€post„judgment€interest€from€the€date€of€theÏdivorce€decree,€December€28,€1992,€until€date€the€$50,000€was€paid€intoÏcourt,€December€13,€1994.€€On€March€15,€1995,€the€trial€court€heard€theÏpetition€and€counter„petition€and€filed€a€memorandum€that€denied€theÏWife's€claim€for€post„judgment€interest€among€other€things.€€TheÏpertinent€portion€of€the€chancellor's€ruling€dealing€with€the€post„judgment€interest€claim€of€the€Wife€is€as€follows:ÌÓÓà8 àà8 àT.C.A.€Ô€$ÔððÔ€Ô€47„14„122€relied€upon€by€Mary€Beaty€setsÏout€the€method€of€computation€of€interest€inÏjudgments.€€It€does€not€provide€that€interest€runsÏon€all€judgments.ÌÌÇà8 àà8 àFrom€a€consideration€of€the€definition€of€'interest'Ïin€T.C.A.€Ô€$ÔððÔ€Ô€47„14„102(7),€the€rationale€set€out€inÏòòPrice€v.€Priceóó,€472€S.W.2d€732,€and€all€theÏcircumstances€in€this€case,€the€court€is€of€theÏopinion€that€the€$50,000€judgment€did€not€bearÏinterest€at€any€time€prior€to€the€filing€of€JackÏBeaty's€petition€and€the€concurrent€payment€to€theÏclerk€and€master€of€the€$50,000€principal€amount.€ÌÌÌÓÓThe€petition€and€counter„petition€as€amended€were€dismissed€by€theÏchancellor.€€Ìà àThe€Husband€supports€the€chancellor's€decision€and€argues€that€theÏ$50,000€was€awarded€to€the€Wife€for€the€purpose€of€equalizing€theÏequities€between€the€parties.€€But€the€payment€by€the€Husband€of€theÏ$50,000€was€contingent€upon€the€Wife€executing€a€quitclaim€deed€to€theÏmarital€residence€awarded€to€the€Husband€and€her€transferring€to€himÏcertain€stocks€she€owned€in€the€jewelry€and€loan€company€also€awarded€toÏthe€Husband.€€That€because€she€appealed€the€judgment,€thus€delaying€theÏexecution€of€the€judgment,€she€was€not€entitled€to€the€immediate€use€ofÏthe€money€from€the€date€of€entry€and€under€authority€of€òòPriceóó,€òòidóó.,€she€isÏnot€entitled€to€post„judgment€interest.Ìà àWe€respectfully€disagree€and€reverse.Ìà àT.C.A.€Ô€$ÔððÔ€Ô€47„14„122€provides:ÌÓÓà8 àà8 àInterest€on€judgments€„„€Computation.€„„€InterestÍshall€be€computed€on€every€judgment€from€the€dayÏon€which€the€jury€or€the€court,€sitting€without€aÏjury,€returned€the€verdict€without€regard€to€aÏmotion€for€a€new€trial.€€ÌÌÌà àT.C.A.€Ô€$ÔððÔ€Ô€47„14„121€provides:ÌÌà8 àà8 àInterest€on€judgments€„„€Rate.€„„€Interest€onÏjudgments,€including€decrees,€shall€be€computed€atÏthe€effective€rate€of€ten€percent€(10%)€per€annum,Ïexcept€as€may€be€otherwise€provided€or€permittedÏby€statute;€provided,€that€where€a€judgment€isÏbased€on€a€note,€contract,€or€other€writing€fixing€aÏrate€of€interest€within€the€limits€provided€in€Ô€$ÔððÔ€Ô€47„14„103€for€that€particular€category€of€transaction,Ïthe€judgment€shall€bear€interest€at€the€rate€soÏfixed.ÌÌÌÓÓà àT.C.A.€Ô€$ÔððÔ€Ô€47„14„102(7)€provides:ÌÓÓà8 àà8 à'Interest'€is€compensation€for€the€use€or€detentionÏof,€or€forbearance€to€collect,€money€over€a€periodÏof€time,€and€does€not€include€compensation€forÏother€purposes,€including,€but€not€limited€to,€time„price€differentials,€loan€charges,€brokerageÏcommissions,€or€commitment€fees.€€For€example,Ïwhen€you€borrow€money,€you€pay€the€lender€simpleÏinterest€(which€is€like€rent)€for€the€use€of€theÏmoney.€€The€amount€of€interest€you€pay€depends€on:€€ÌÌà8 àà8 àà8 à(A)€The€principal,€which€is€the€amountÏyou€borrow;€ÌÌà8 àà8 àà8 à(B)€The€rate,€which€is€a€percent€basedÏon€a€period€of€time,€usually€one€(1)Ïyear;€and€ÌÌà8 àà8 àà8 à(C)€The€number€of€periods€of€time€thatÏyou€have€the€use€of€the€money.€.€.€.ÌÌÌÓÓà àEssentially,€as€we€understand€the€trial€court's€memorandum,€theÏtrial€court€relying€on€òòPriceóó,€òòidóó.,€ruled€that€the€Wife€was€not€entitled€toÏpost„judgment€interest€because€she€appealed€the€decree€of€divorce€andÏwas,€therefore,€not€entitled€to€immediate€use€of€the€money.€€ThisÏreasoning€is€plainly€stated€in€the€trial€court's€memorandum€of€findings€ofÏfact€and€conclusions€of€law€where€it€said:ÌÓÓà8 àà8 àThis€provision€in€the€marital€property€division€andÏthe€duration€of€rehabilitative€alimony€were€theÏparts€of€the€decree€which€Mary€Beaty€sought€toÏhave€changed€on€appeal.€The€property€divisionÏsought€by€Mary€Beaty€would€not€have€involved€anÏaward€of€the€$50,000€equalizing€judgment€in€herÏfavor.€€Her€conduct€in€not€seeking€to€collect€theÏ$50,000€judgment€and€refusing€to€execute€aÏquitclaim€deed€was€entirely€consistent€with€theÏrelief€she€hoped€to€receive€on€appeal.€€AlthoughÏthere€was€no€stay€order,€the€parties€by€theirÏconduct€treated€the€trial€court's€decree€as€òòstayedÏpending€appealóó€(emphasis€ours).€€Otherwise,€MaryÏBeaty€would€simply€not€have€had€a€meaningfulÏappellate€review.€€ÌÌÌÓÓà àAs€previously€shown,€the€trial€court's€memorandum€went€on€toÏconsider€the€definition€of€interest€pursuant€to€T.C.A.€Ô€$ÔððÔ€Ô€47„14„102(7)€andÏthe€rationale€set€out€in€òòPrice€v.€Priceóó,€òòidóó.,€and€denied€and€dismissed€theÍcounter„petition€of€the€Wife€in€which€she€had€moved€the€court€for€post„judgment€interest.€€The€Husband's€petition€was€also€dismissed.€€We€thinkÏthat€the€trial€court's€reliance€upon€òòPriceóó€is€misplaced.€€Ìà àIn€òòPriceóó,€òòidóó.,€the€appellant/wife€was€denied€statutory€post„judgmentÏinterest€because€the€divorce€decree€awarded€a€money€judgment€as€alimonyÏòòinóó€òòsolidoóó€payable€in€future€installments€and€she€was€not€entitled€to€theÏuse€of€any€of€the€money€represented€by€the€judgment€until€eachÏinstallment€was€due.€€All€installments€were€paid€when€due.€€The€SupremeÏCourt€noted€in€òòPriceóó,€òòidóó.,€at€734:ÌÓÓà8 àà8 àIn€the€greater€number€of€cases€dealing€with€theÏquestion,€interest€has€been€allowed€on€unpaidÏalimony.€€Thus,€where€the€problem€arose€inÏrespective€judgments€for€alimony€in€gross,€interestÏhas€been€allowed€from€the€date€payment€was€dueÏunder€the€judgment€until€payment€was€made,€and,Ïas€to€unpaid€installments€interest€has€been€allowedÏfrom€the€date€the€particular€installment€matured.€ÏLikewise,€interest€has€been€allowed€on€unpaidÏinstallments€of€alimony€against€the€estate€of€theÏdeceased€divorced€spouse.€€The€theory€upon€whichÏinterest€is€allowed€in€these€cases€is€that€aÏjudgment€awarding€alimony€is€in€the€nature€of€aÏmoney€judgment.€€òòThe€same€result€has€been€reachedÏeven€where€the€judgment€or€installment€becameÏdue€and€payable€pending€an€appeal€of€the€judgmentÏawarding€the€alimony€on€the€theory€that€the€partyÏawarded€alimony€should€not€be€deprived€of€it€by€theÏprosecution€of€an€appeal.óó€€(emphasis€ours).ÌÌÌÓÓà àWe€do€not€believe€that€òòPriceóó€is€analogous€to€the€facts€in€this€case.€ÏHere,€the€divorce€decree€awarded€a€cash€money€judgment€to€the€Wife.€€SheÏwas€entitled€to€immediate€use€of€the€money€upon€entry€of€the€judgment€onÏDecember€28,€1992.€€However,€she€exercised€her€right€to€appeal€theÏjudgment€of€divorce.€€The€trial€court€denied€jurisdiction€pending€theÏappeal.€€Wife's€appeal€was€subsequently€dismissed€by€this€Court€and€theÏ$50,000€judgment€was€paid€into€the€trial€court€on€December€14,€1994.€€WeÏthink€the€case€of€òòInman€v.€Inmanóó,€840€S.W.2d€927€(Tenn.€Ct.€App.€1992),€isÏdispositive€of€this€issue.€€The€òòInmanóó€facts€were€that€pending€wife's€appealÏthe€husband€withheld,€òòinteróó€òòaliaóó,€payment€of€a€$100,000€cash€award€to€theÏwife€by€a€judgment€of€divorce.€€Subsequently,€upon€the€appeal€becomingÏfinal,€the€wife€by€motion€moved€the€trial€court€for€post„judgment€interestÏfrom€the€date€of€the€entry€of€the€divorce€decree€until€the€$100,000€beÏpaid.€€Her€motion€was€dismissed€by€the€trial€court.€€This€Court,€afterÏciting€T.C.A.€Ô€$ÔððÔ€Ô€47„14„121,€stated:ÌÓÓà8 àà8 àClearly,€the€plaintiff€is€entitled€to€interest€at€10%Ïon€the€$100,000€cash€from€the€date€of€the€decreeÏuntil€paid.€€ÌÌà àà àà àà àà à*€*€*€*ÌÌà8 àà8 àThe€judgment€of€the€Trial€Court€'dismissing'Ï(striking€or€overruling)€the€motion€of€plaintiff€isÏreversed.ÌÌòòInmanóó,€at€931,€933.ÌÌÌÓÓà àRule€41,€T.R.A.P.,€states:ÌÓ  ÓÓÓà8 àà8 àò òINTEREST€ON€JUDGMENTSó óÌÓ  Óà8 àà8 à€€€€If€a€judgment€for€money€in€a€civil€case€isÏaffirmed€or€the€appeal€is€dismissed,€whateverÏinterest€is€allowed€by€law€shall€be€payableÏcomputed€from€the€date€of€the€verdict€of€the€juryÏor€the€equivalent€determination€by€the€court€in€aÏnon„jury€case,€which€date€shall€be€set€forth€in€theÏjudgment€entered€in€the€trial€court.€€If€a€judgmentÏis€modified€or€reversed€with€a€direction€that€aÏjudgment€for€money€be€entered€in€the€trial€court,Ïthe€mandate€shall€contain€instructions€withÏrespect€to€allowance€of€interest.€€ÌÌÌÓÓThe€intent€of€this€rule€is€crystal€clear:€€whether€the€appeal€is€affirmed,Ïmodified,€or€dismissed,€whatever€interest€allowed€by€law€(òòseeóó,€òòe.góó.€T.C.A.ÏÔ€$ÔððÔ€Ô€47„14„121€and€„122)€òòshallóó€(emphasis€ours)€be€payable€from€date€of€juryÏverdict€or€the€equivalent€determination€in€a€non„jury€case.€€Ìà
