Heinsiststhattherearematerialissuesoffactrenderingsummaryjudgmentimproper.   Mr.Beaty'scomplaintcontainsthefollowingallegationsrelativetohisinjuriesand,aspertinenttothisappeal,relativetotheDefendants'wrongdoing:        7.OnoraboutDecember17,1993atapproximately1930hours,thePlaintiff,whileapresentencedetaineeattheMonroeCountyJail,wasreturningtohisbunkfromusingthebathroomandsteppedonbarewiresfromanelectricalextensioncord. 8.ThePlaintiffreceivedasevereelectricalshockwhenhesteppedontheelectricalcord.TheshockcausedthePlaintifftobeviolentlythrownabout,resultinginseriousheadandbackinjuries. 9.BecauseoftheelectricalshockandresultingfallbythePlaintiff,hehasreceivedamassivedischerniationandnerverootencroachment.Plaintiffhasbeenadvisedbymedicaldoctorsthatheisinneedofananteriorcervicaldiskectomyandfusion. 10.ItwasthedutyoftheDefendantR.H.Johnson,asSheriffoftheMonroeCountyJail,tomaintainandkeepthejailinasafecondition. 11.ItisalsothedutyofMonroeCountytomaintainasafeenvironmentfortheinmatesandpresentencedetaineesoftheMonroeCountyJail. 12.TheDefendantR.H.Johnson,asSheriffofMonroeCountyJail,breachedhisdutyofcarebyfailingtomaintainthejailinasafecondition. 13.MonroeCountybreachedtheirresponsibilityanddutyofcarebyfailingtomaintaintheMonroeCountyJailinasafecondition.         TheTrialCourt'sorderofdismissalstatesthefollowing:        ThesuitisbaseduponthefailuretomakeaninspectionofthecellinwhichthePlaintiffwasconfinedandthefailureofthedefendanttoobtainmedicaltreatmentforplaintiff'sinjuries. FailuretomakeaninspectionisexceptedfromthestatuteremovinggovernmentalimmunityinaccordancewithT.C.A.2920205.ItalsoappearsfromthePlaintiff'sdepositionthathereceivedmedicaltreatmentatSweetwaterHospital.         AsweunderstandMr.Beaty'sbrief,heconcedesthattheDefendantsareimmunefromanycauseofactionarisingfromthefailuretoinspectinaccordancewiththeCodeSectionmentionedintheTrialCourt'sorderabovequoted.  Thecomplaint,asalreadynoted,alsosoughtdamagesbecausetheDefendantsfailedtoprovideMr.Beatymedicalcareafterbeinginjured.Theproof,however,isundisputedthatsuchwasprovidedwithoutcosttoMr.Beatyandnoissueismadeastothispointonappeal.  Mr.Beatydoes,however,insist,undertheprovisionsofT.C.A.2920204(a) m   ׀thatimmunityofgovernmentalentitieshasbeenremoved"foranyinjurycausedbythedangerousordefectiveconditionofanypublicbuilding,"andthatthefailuretomaintainthejailfacilitiesinasafeconditionisaseparateclaimfromtheoneallegingfailuretoinspect.  TheDefendantscounterthisargumentbyfirstinsistingthattherewasnoproofthattheyknewoftheunsafeconditioncausedbythefrayedelectricalcordandthatindiscoverydepositionMr.Beatytestifiedhiscauseofactionwaspredicateduponfailuretoinspect.   Beforeaddressingourresolutionsofthecompetingcontentions,weobservethatalthoughtheDefendantsrelyuponthediscoverydepositionofMr.BeatyandtherecordwassupplementedtoincludehisdepositionitwasnotmadeanexhibittotheDefendants'motion,theonlymaterialaccompanyingthemotionbeingtheDefendants'briefinsupportthereof.  Nevertheless,weareinclined,asdidtheparties,totreatthediscoverydepositionasapartofthemotion,aswellastheaffidavitandothermaterialsfiledwithMr.Beaty'sresponse.  Aproposofthefirstinsistence,ourcaselawrequireseitheractualorconstructivenoticeinpremiseliabilityactionspredicatedupondefectiveconditions.McCormickv.Waters,594S.W.2d385(Tenn.1980);Bensonv.H.G.HillStores,Inc.,699S.W.2d560(Tenn.App.1985).ThecompleteanswertotheDefendants'argumentisthatonmotionforsummaryjudgmentitwasnotthedutyofMr.BeatytoshowthattheDefendantsknewofthecondition,butratherthedutyoftheDefendantstoshowthattheydidnot.  TheDefendantsrelyuponourunreporteddecisioninthecaseofRicev.KnoxvilleUtilitiesBoard,C/ANo.03A019606CV00209,filedinKnoxvilleonDecember23,1996.TheycontendthatRicestandsforthepropositionthat,inapremisesliabilitycase,aplaintifffacedwithamotionforsummaryjudgmentpredicatedonalackofnoticehasanaffirmativedutytoproveactualorconstructivenoticeofthedefect.TheDefendantintheinstantcasehasmisconstruedourholdinginthatcase.WeheldinRicethatapremisesliabilityplaintiff,whenfacedwithaproperlysupportedmotionontheissueofnotice,hadtobringforthfactstocreateadisputeontheissueofactualorconstructivenotice.InRice,wesustainedagrantofsummaryjudgmenttothedefendantsbecausetheirsupportingmaterialshowedalackofnotice,bothactualandconstructive,andtheinjuredplaintiffdidnotpresentanyfactstobringintodisputethefactspresentedbythedefendants.Riceisnotcontrarytoourholdinginthiscase.  Finallyastothispoint,therecorddisclosesthatpursuanttoT.C.A.414140(a)(3), n   ׀aninspectionofthejailwasmadeonDecember30,1992,andareinspectiononDecember10,1993.Thereinspectionresultedinafindingthat"Therearefrayedextensioncordsandnakedwiresthroughoutthejail."ItappearsthatthisreportwasnottransmittedtotheCountyExecutiveandSheriffuntilMarch2,1994,which,ofcourse,wasafterthedateoftheaccident.Howeverthatmaybe,itisclearthatthereisproofintherecordthatconditionsexistedatleastoneweekpriortotheaccident.Inourviewthisperiodoftimewassufficienttosatisfytherequirementofconstructivenoticewhenapplyingourstandardofreviewforsummaryjudgments.̀  AstotheDefendants'otherinsistence,theproofshowsthatduringthediscoverydepositionofMr.Beaty,thefollowingoccurred:       Now,...it'smyunderstandingthatyou'reclaimingthattheSheriffandtheCountyareliableforfailingtomakeaninspectionormakinganinadequateornegligentinspectionofthatjailarea:isthatacorrectstatementofyourclaim: A Yeah.  MR.LOMONACO:(Nodshead affirmatively.) Q Andyourattorneyisshakinghishead.JustsoIrememberwhathappenedheretoday,thatthat'sthecorrectstatementofyourclaim.AndItakeitthatthatnegligenceisjustthatiftheyhadappropriatelyinspectedit,theywouldhaveseenthecordandreplacedit. A Youwouldthinkso.Idon'tunderstandwhytheydidn'tgetridofitafterIsteppedonit.         Whileitisarguablefromtheforegoingthattheonlyclaimbeingmadewasforlackofinspection,Mr.Beatydidnottestifynordidhiscounselagreethatlackofinspectionwastheonlyclaimhewaspressing.Moreover,weareloathedtoconfinealaypersontoanswersgiventothistypeofquestionswhenthecomplaintspecificallyallegesotherclaims.Wearealsodisinclinedtofindtrialcounselinnoddinghishead,asaboveshown,willbedeemedtohavewaivedoneoftheclaimsallowed.
