JoyBadenhopeisthechildofSusanBadenhopeandArthurBlair.SusanBadenhope,aresidentofNorthCarolina,diedwhenthechildwaslessthanoneyearold.Afterherdeath,Joybeganresidingwithhermaternalgrandmother,MarilynBadenhope,inTennessee.ThegrandmotherwasgrantedcustodybyaNorthCarolinacourtinanactionforcustodyshefiledsometwomonthsafterthemothersdeath.ThefathersoonthereaftermovedtoTennesseeandfiledanactioninTennesseetoincreasevisitationandattaincustody.  TheChancellorheldthattherehadbeenaninsufficientchangeofcircumstancestomeritachangeofcustodyandherefusedtoaltervisitation.   Thefathercitescasesshowingthatunderrecentcourtdecisionsinthisjurisdiction,biologicalparentsaregivenpreferenceovernonparentsinmattersofcustody,andarguesthatTennesseeshouldnotfollowtheNorthCarolinadecisionastocustodyofhisdaughter.  Tennesseeisrequiredtorecognizeandenforcethecustodydecreeofasisterstate.T.C.A.366214 %   .NorthCarolinawasthehomestateofJoyBadenhopeandArthurBlair.TheNorthCarolinaCourthadsubjectmatterandpersonaljurisdictionovertheparties.  ItshouldbenotedthatthisisnotaninitialdecisiondeterminingwhoisgrantedcustodyunderTennesseelaw.Thereforethequestionis,hastherebeenamaterialchangeofcircumstancessufficienttoaltertheNorthCarolinaawardofcustody?MatterofParsons,914S.W.2d889,893(Tenn.App.1995). Theburdenisonthenoncustodialparenttoprovechangedcircumstances.Musselmanv.Acuff,826S.W.2d920(Tenn.App.1991).   Theonly materialchange citedinthebodyofthefathersbriefisthat ArthurBlairandJoyhavebuiltarelationshipofloveandtrust .  WereviewtheTrialCourtsdecisiondenovoupontherecordwithapresumptionofcorrectness.T.R.A.P.Rule13(d).TheTrialCourtwasnotpersuadedthattherehadbeenachangeofcircumstancesufficiienttoaltercustody.  Changedcircumstances includesanymaterialchangeofcircumstancesaffectingthewelfareofthechild,includingnewfactorsorchangedconditionswhichcouldnotbeanticipatedbythecustodyorder.Daltonv.Dalton,858S.W.2d324(Tenn.App.1993).WeconcludefromourreviewoftherecordthattheevidencedoesnotpreponderateagainsttheTrialCourtsfindingofnomaterialchange.Theevidencethatthechildhasgrownclosertoherfatherandstepmotherisacircumstancethatishopedforingrantingregularvisitation,notanunexpectedcircumstance.WeaffirmthejudgmentoftheTrialCourt.  Thefatherraisestheissue didtheChancellorerrindecliningtoincreaseappellantsvisitation? Theissueisraisedinthesectiontitled IssuesPresentedonAppeal.
