Thisisapaternitycase.Afterbloodtestsshoweda99.999%probabilityofpaternity,thedefendantArnoldWayneMartin(Father)acknowledgedthatheisthefatherofMelissaGailDixon,age16.BaseduponFathersacknowledgment,thetrialcourtenteredajudgmentofpaternity.Aspertinenttothisappeal,thetrialcourtalsoorderedFathertopaytheplaintiffBrendaBondy(Mother)childsupportof$63perweek,effectiveNovember21,1995,thedateonwhichthepetitioninthiscasewasfiled.Motherappealed,arguingthatthetrialcourtshouldhaveawardedhersupportbacktoAugust3,1979,thechildsdateofbirth.Shealsoarguesthatthetrialcourtsawardoffeesforhercounselisinadequate.Finally,sheseeksfeesforservicesrenderedbyherattorneyonthisappeal.  Inapaternitycase,atrialcourt hasbroaddiscretiontodeterminetheamountof...aretroactiveawardof[childsupport],aswellasthemannerinwhichitistobepaid. Stateexrel.Colemanv.Clay ,805S.W.2d752,755(Tenn.1991).  Intheinstantcase,itappearsthatthetrialcourtdidnotproperlyexerciseitsdiscretion.MotherspetitionthatFatherbeorderedto paychildsupport,beginningAugust3,1979"wasmetbythefollowingfindinganddecreeinthetrialcourtsjudgment: 8 Thattherehas,priortothedateofthishearing,beennoOrderofsupportplacedagainsttherespondentandthatnoarrearageofsupportexistsbecausenoOrderhaseverbeenenteredestablishingpaternityorobligationofsupportandthat,therefore,theCourtfindsthatnoarrearageexists,noneisowedandtherefore,noneisforgivenorreduced.Thetrialcourt,insteadofexercisingitsdiscretionanddeterminingwhetherchildsupportbacktothedateofbirthwasorwasnotappropriateand,ifso,inwhatamount,insteadrefusedtoorderanybackchildsupportsimplybecause noOrder[had]everbeenenteredestablishingpaternityorobligationofsupport.Thiswasnottheappropriatecriteriauponwhichthetrialcourtshouldhavemadethisdiscretionarydetermination.Theappropriatestandardissetforthinthe Stateexrel.Coleman case: 8 ...thestatutegivesthejuvenilecourtthediscretiontoorderaretroactivesupportawardbackto...[the]date[ofthechildsbirth],theamountandmethodofpaymenttobedeterminedbythe[trialjudge]inlightofthecircumstancesofthecaseandconsistentwiththestandardswhichnormallygoverntheissuanceofchildsupportorders.(citationomitted).805S.W.2dat755.  Sincethetrialcourtfailedtoexerciseitsdiscretionpursuanttotheappropriatestandard,wefindanabuseofthatdiscretionandconcludethatitisnecessarytovacatesomuchofitsjudgmentasprovidesthatMotherisnotentitledtoanysupportpriortothedateoffilingofthepetition.Weexpressnoopinionastowhetherretroactivechildsupportisappropriateinthiscase.Ourholdinginthiscaseisalimitedone:atrialcourtcannotrefusetoawardretroactivechildsupportsimplybecauseanorderwasnotenteredcoveringtheperiodforwhichbacksupportisrequested.  AstothesecondissueraisedbyMother,wedonotfindthattheevidencepreponderatesagainstthetrialcourtsawardofattorneysfeesof$1,000forservicesrenderedpriortothefilingofthenoticeofappeal.SeeRule13(d),T.R.A.P.Thereisnothingintherecordreflectingthenatureandextentoftheservicesrenderedbyplaintiffscounsel.  Motherspetitionforattorneysfeesforservicesrenderedonthisappealisremandedtothetrialcourtforitsconsideration.See Folkv.Folk ,357S.W.2d828(Tenn.1962).
