Thepetitionalleges:8 8    FACTSOFTHECASE8 8 OnDecember12,1994,plaintifffiledforadeclaratoryorderagainstTennesseeDepartmentofCorrectionrequestingsentencereductioncreditsbeappropriatelyawarded,calculated,andpostedtoreflecthistrueeligibilitydateforsentenceexpiration.(Exhibit A)8 8 AboutJanuary2,1995,plaintiffreceivedcopyofcertifiedmailreceiptshowingTennesseeDepartmentofCorrectionreceivedplaintiffsrequestfordeclaratoryorderonDecember15,1994.(Exhibit B)8 8 Asofpresentdate(March20,1995)plaintiffhasnotreceivedresponsefromTennesseeDepartmentofCorrection.(Exhibit C)8     󀀀ARGUMENT8 8 AccordingtotheAdministrativeProcedureAct,TennesseeDepartmentofCorrectionisactingillegallybydenyingplaintiffanadministrativehearingfordeclaratoryorderinaccordancewiththeprovisionsof ConductofContestedCaseshearingspursuanttotheAdministrativeProcedureAct45301.8 8 AccordingtotheAdministrativeProcedureAct,TennesseeDepartmentofCorrectionisoperatingillegallybyadoptingrulesthatarenotincompliancewiththeprovisionsofChapterFive(5),governingAdministrativeProcedureAct,whichdoesnotrequireplaintiffspetitionfordeclaratoryorderforacontestedhearingtobesetwithinsixty(60)daysafterreceiptofplaintiffspetition,andtherefore,enforce improperlyadoptedrulespursuanttoTennesseeCodeAnnotated45216.8 8 PlaintiffcontendsthatTennesseeDepartmentofCorrectionisillegallyextendinghisincarcerationapproximatelytwenty(20)yearsbyrefusingtocorrectlyaward,calculate,andpostsentencecreditspursuanttotheSentenceReformActthatwasineffectonAugust9,1972,thedateTennesseeGovernorWinfieldDunncommutedplaintiffssentencefromdeathtoninetynine(99)years.(SeeExhibit A)̛̜ Thepetitionprays:8 8 1.ThatthisHonorableCourtgrantsplaintiffspetition;8 8 2.ThatthisHonorableCourtissueforthanOrdertoTennesseeDepartmentofCorrectionorderingittoimmediatelycomplywithTennesseeSentencingReformActineffectduringAugust9,1972(Exhibit A)andenterplaintiffscorrectsentenceexpirationdate;....̛̜ Thedefendantmovedforsummaryjudgment,supportedbyaffidavitoftheManager,SentenceInformationServices,ofDefendant/Departmentstatingthefollowing:8 8 ThesentencecomputationforthisoffenderhasbeenreviewedattherequestoftheStateAttorneyGeneralsoffice.8 8 Mr.BowenwasconvictedinSullivanCountyJuly25,1970.HewassentencedtoDeathbyElectrocutionforMurder1stDegreeinCase#5183BL.TheDeathsentencewascommutedto99yearsbyGovernorWinfieldDunn,August9,1972.TheTennesseeSupremeCourtaffirmedthejudgmentoftheCriminalCourtascommutedtoimprisonmentforatermof99years.8 8 EffectiveMarch1,1986,Mr.BowenelectedtowaiveintothePrisonerSentenceReductionCreditLaw,fromthePrisonerPerformanceSentenceCreditLaw.ThewaivingfromPPSCtoϜPSRCallowedhimtheopportunitytoearnanextradayeachmonthaslongasheremainedonminimumsecurityanddisciplinaryfree.EffectiveAugust10,1994,Mr.Bowenelectedtorescindthesigningofthecreditwaiverandoptedtoreturntotheoriginalsentencecreditlaw.Whenthishappened,allcreditsearnedunderthecreditsystemfromMarch1,1986,toAugust10,1994,wereconvertedtotheoldlaw(PPSC).Thetotalnumberofsentencereductioncreditsearnedtodateis1,939days.8 8 ThecurrentprobationaryparoledateisJune14,1996;theexpirationdateisJune8,2015.Thesedatescorrectlyreflectthenumberofcreditsearnedbythisoffender.̛̜ Noevidencewasfiledbypetitionerincontradictionofthequotedaffidavit. Asstated,theTrialCourtsummarilydismissedthepetition. Onappeal,plaintiffpresentsasingleissueasfollows:8 8 DidtheTrialJudgeerringrantingsummaryjudgmentinfavorofdefendantbasedonsupport[of]affidavitwhichappearedtohavecorrectlycalculatedMr.Bowenssentencereductioncreditswhengenuineissueofmaterialfactclearlyexisted?̛̜ Asstated,plaintifffilednoevidenceincontradictionoftheaffidavitsubmittedbydefendant.Thequotedissuepresentsthesimplequestionofwhetheragenuineissueoffactispresentedbytherecord. Plaintiffsbriefcitesnoevidenceintherecordtocreateanissue,andnonehasbeenfoundbythisCourt.Allegationsandargumentdonotsupplyevidence. Whenthemovingpartyhasmadeaproperlysupportedmotionforsummaryjudgment,theburdenofproducingevidenceshiftstothenonmovingpartytoproduceevidencewhichwouldestablishafactualdispute.Braswellv.Caruthers,Tenn.App.1993,863S.W.2d722. Inthepresentcase,thefailureofplaintifftoproperlyrespondwithevidenceleftthefactsundisputedandjustifiedtheentryofsummaryjudgment.
