àOn€May€28,€1992,€Allstate€answered€admitting€$25,000€uninsured€motorist€coverage€ofÏplaintiffs,€but€denying€that€either€of€the€named€defendants€were€uninsured.€€ÌÌà àOn€September€30,€1992,€Ms.€Davis€answered€stating:ÌÓÓà8 àà8 à.€.€.€€Defendant€admits€that€she€was€driving€the€aforesaid€vehicleÏwhen€she€suddenly€lost€control€of€the€vehicle,€went€off€the€roadÏand€struck€an€embankment.€€Defendant€denies€she€was€negligentÏin€any€way€including€that€she€failed€to€maintain€a€due€and€properÏlook€out€ahead,€that€she€was€operating€her€vehicle€at€a€speedÏwhich€was€excessive€under€the€conditions,€that€she€drove€herÏvehicle€in€a€willful€and€wanton€disregard€for€the€safety€ofÏpersons€or€property,€and€denies€that€as€a€direct€and€proximateÏresult€of€defendant's€alleged€negligence,€the€plaintiff€AngieÏBrooks€received€serious€painful,€disabling€and€permanent€bodilyÏinjuries.ÌÌÌÓÓà àOn€October€27,€1994,€plaintiffs€moved€for€a€new€trial€on€grounds€that€the€Trial€CourtÏerroneously€allowed€Ms.€Davis€to€amend€her€answer€at€the€close€of€plaintiffs'€proof€to€assertÏthe€fault€of€an€unknown€driver€and€erroneously€admitted€evidence€of€the€unknown€driver.ÌÌà àOn€November€7,€1994,€Allstate€moved€to€alter€or€amend€the€judgment€to€delete€theÏname€of€Allstate€from€the€judgment€for€the€reasons€already€stated.ÌÌà àOn€February€24,€1995,€Allstate€filed€an€amended€motion€to€alter€or€amend€on€theÏground€that€no€physical€contact€between€the€unknown€vehicle€and€that€of€Ms.€Davis€and€thatÏthe€existence€of€the€unknown€motorist€was€not€proven€by€clear€and€convincing€evidence€otherÏthan€that€furnished€by€the€occupants€of€the€Davis€vehicle€as€required€by€T.C.A.€Section€56„7„1201(e)(1)(B).ÌÌà àOn€May€11,€1995,€the€Trial€Court€overruled€the€motion€for€new€trial€of€plaintiffs€andÏstruck€the€name€of€Allstate€from€the€judgment.ÌÌà àOn€May€18,€1995,€the€Trial€Court€entered€an€amended€judgment€order€stating:ÌÓÓà8 àà8 àThe€transcript€records€that,€on€October€19,€1994,€before€defendants€presented€theirÏevidence,€plaintiffs€moved€to€exclude€any€evidence€of€an€unknown€motorist€because€not€pled;Ïthat,€the€Trial€Judge€orally€stated:ÌÓÓà8 àà8 à€€The€rule€on€amending€pleadings€to€conform€to€the€proof€is€toÏbe€liberally€construed.€€In€the€deposition€of€Kimberly€J.€Davis,Ïwhich€has€been€filed€with€the€court€on€October€14th,€filed€withÏthe€clerk€and€made€a€part€of€File€No.€C8„557,€Ms.€Davis'Ïdeposition€was€taken€December€17,€1992.€€Mr.€Welker,€counselÏfor€the€plaintiff,€was€present,€along€with€two€other€attorneys,ÏMr.€Batson€and€Mr.€McCoy.ÌÌà8 àà8 à€€On€page€18,€I€believe€this€is€Mr.€Welker€asking€the€questions.€ÏIt€appears€to€be.€€Question€„„€pardon€me.€€It€starts€on€the€bottomÏof€page€17€line€25.ÌÌà8 àà8 àQ.€€"All€right.€€Okay.€€All€right.€€Now,€just€in€your€own€words,Ïtell€me€what€happened,€how€this€accident€happened."ÌÌà8 àà8 àA.€€"We€were€going€down€Tiny€Town€Road.€€There€was€anotherÏcar€over€in€my€lane,€and€I€went€over€to€move€„„€you€know,€toÏmiss€it.€€And€we€went€off€in€the€ditch."ÌÌà8 àà0 àà àà8 à.€.€.€.ÌÌà8 àà8 à€€Now,€this€deposition€indicates€to€me€that€the€issue€of€anotherÏcar€being€involved€is€certainly€not€„„€this€is€not€the€first€time€thatÏthe€plaintiff€has€been€aware€of€this.€€.€.€.ÌÌà8 àà8 à€€But€since€it's€not€a€surprise,€and€the€plaintiff€has€had€ampleÏtime€to€deal€with€the€issue€one€way€or€the€other,€then€I'm€going€„„€assuming€that€she€testifies€similarly€to€how€she€did€in€herÏdeposition,€then€I'm€going€to€allow€the€defendant€to€amend€„„€toÏamend€the€answer€to€conform€to€the€proof€in€the€case.ÌÌÌÓÓà àThere€were€no€special€requests€for€instructions,€but€the€Trial€Court€did€instruct€the€juryÏas€follows:ÌÓÓà8 àà8
