ðcomplaintðð€under€a€new€case€number.€€Actually€the€ð ðcomplaintðð€should€haveÏbeen€a€motion€or€petition€in€the€original€divorce€case,€since€the€Trial€CourtÏretained€jurisdiction€of€periodic€alimony€under€T.€C.€A.€ðð€36„5„101(a)(1)€and€by€itsÏorder€of€April€26,€1989,€expressly€retained€jurisdiction€ð ðof€this€matter.ðð€€TheÏcomplaint€will€therefore€be€treated€as€an€application€to€enforce€or€alter€the€formerÏorders€of€the€Court€in€the€original€divorce€case.ÌÌà àThe€complaint€alleges€and€prays:ÌÒ 0 àà8 àThis€Court€retains€jurisdiction€of€this€matter€and€defersÏdivision€of€the€retirement€benefits,€until€such€time€asÏthe€benefits€become€payable€òòto€the€partiesóó.ÌÌÌÌà àIt€is€my€desire€that€payments€be€made€to€BettyÏChristine€Brown€pursuant€to€the€terms€of€the€plan€and€myÏobligation€of€alimony€cease.ÌÌÌÌÒ € ÒÒ „ Òà àIt€is€true€that€the€original€divorce€decree€stated:ÌÌà8 àà8 àà àAlthough€the€foregoing€verbiage€does€not€exclude€the€beginning€ofÏpayments€at€a€date€earlier€than€those€designated,€the€expression,€ð ðone„half€ofÏeach€payment€.€.€.€at€the€time€the€payment€is€madeðð€clearly€indicates€thatÏretirement€benefits€should€be€paid€to€both€parties€simultaneously;€that€is,€thatÏpayments€would€not€be€made€to€the€wife€before€the€husband€actually€ceasedÏemployment,€his€salary€ceased,€and€his€retirement€pay€began.ÌÌà àAlthough€this€provision€was€vacated€by€this€Court,€it€is€relevant€becauseÏthe€judgment€under€review€is€based€upon€its€provisions.ÌÌà àMoreover,€by€T.€C.€A.€ðð€36„5„101(a)(1),€the€court€retained€jurisdiction€toÏchange€the€order€for€periodic€alimony€and,€upon€appeal€and€remand,€on€April€26,Ï1989,€the€Trial€Court€reserved€the€division€of€the€retirement€until€such€time€as€theÏretirement€becomes€payable€ð ðto€the€parties.ðð€€Thus,€the€termination€of€alimony€byÏpayment€of€retirement€benefits€was€deferred€until€such€benefits€were€payable€toÏòòboth€partiesóó.€€ÌÌà àIt€is€most€unusual€for€a€retirement€to€provide€benefits€to€the€spouse€of€anÏemployee€while€the€employee€continues€to€work€and€receive€his€salary.€€It€isÏhighly€unlikely€that€the€Trial€Judge€anticipated€such€an€unlikely€development.ÌÌà àViewing€the€verbiage€of€the€original€divorce€decree€as€amended,€it€is€clearÏthat€its€intent€was€to€grant€relief€from€periodic€alimony€at€such€time€as€œthe€›Ïretirement€benefits€became€available€because€of€the€retirement€of€the€husbandÏand€consequent€termination€of€his€salary.€€This€intent€was€emphasized€by€theÏverbiage€of€the€subsequent€order€reserving€jurisdiction€until€the€parties€(plural)Ïbecame€entitled€to€retirement€benefits.ÌÌà àThe€provision€was€based€upon€two€anticipated€changes€of€circumstances:Ï(1)€the€diminution€of€the€ability€of€the€husband€to€pay€alimony€and€(2)€theÏavailability€of€a€new€source€of€income€to€the€wife.€€Number€(2)€has€occurred,€butÏNumber€(1)€has€not.ÌÌà àBoth€of€the€conditions€for€the€activation€of€the€ð ðdistribution€of€the€retirementÏbenefitsðð€has€not€occurred.ÌÌà àTherefore,€the€husband€is€not€at€this€time€entitled€to€a€cessation€of€alimonyÏpayments€as€a€matter€of€law.€€If€and€when€he€sees€fit€to€voluntarily€retire€andÏexchange€his€salary€for€the€retirement€benefits,€he€will€be€entitled€to€an€orderÏð ðdistributingðð€such€benefits€as€set€out€in€the€April€26,€1989,€order.€€Until€that€time,Ïhis€relief€from€alimony,€if€granted,€must€be€granted€on€other€grounds.ÌÌà
