OPINION  Thecomplaintinthiscasecontendsthatthetransferoffundsrepresentedbya$37,500certificateofdepositbyMr.Carricktohimself,renderedthefather'sestateinsolventandthereforewasfraudulentastocreditors.  ThesuitseekstosetasidethetransfertoaidtheCoAdministratorsoftheestateofLonnieMaeLaneincollectingMs.Lane'sclaimagainsttheestateofMr.Carrick'sfatherintheamountof$19,500,whichhadbeenpreviouslysustainedbytheProbateCourtinacontestedhearing.  AlthoughthecertificateofdepositwasinthejointnamesofMr.Carrickandhisfather,thefundswereentirelythoseofhisfather.  TheTrialCourtsustainedMr.Carrick'smotionforsummaryjudgment,findingthesuitwasbarredbythetenyearstatuteoflimitationssetoutinT.C.A.283110(3)andalsobythedoctrineofresjudicata.  TheCoAdministratorsappeal,insistingtheTrialCourtwasinerrorinbothinstances.  Astothestatuteoflimitations,wefirstnotethatbothpartiesagreethetenyearstatuteisapplicabletothissuit.  ItappearsfromthedepositionsandaffidavitsintherecordthatwhenthecertificateofdepositmaturedonSeptember6,1984,Mr.Carrickendorsedthecertificate,receivedtheproceeds,andusedthemintheconstructionofhishome.BecausethepresentsuitwasnotfileduntilOctober3,1994,theTrialCourtfoundtenyearshadexpired,thusbarringtheclaim.ThecriticalquestioninresolvingthisfeatureoftheappealiswhenMs.Lane,ortheCoExecutors,kneworshouldhaveknownofthetransferandthefurtherfactthatthetransferhadrenderedthefather'sestateinsolvent.Hoffmanv.HospitalAffiliates,Inc.,652S.W.2d341(Tenn.1983);McCroskeyv.BryantAirConditioningCompany,524S.W.2d487(Tenn.1975);Gosnellv.AshlandChemical,Inc.,674S.W.2d737(Tenn.App.1984).  Ourinquiry,then,iswhethertherecorddiscloseswithoutdisputethatMs.LaneortheCoExecutorskneworshouldhaveknownoftheircauseofactionpriortoOctober3,1984,tenyearspriortothedatethepresentsuitwasfiled.  ThecomplaintallegesthatMs.Lanedidnotknowofthetransfer,muchlessthatitrenderedthefather'sestateinsolvent,andthereisnothingintherecordtothecontrary.Indeed,adocumentfiledbyMr.CarrickintheProbateCourt X ќwouldleadonetobelievetheestatewassolvent.WesaythisbecausethePetitionofProbate,filedApril2,1987,listed"realpropertyownedbythedecedent$220,000."Moreover,theNoticeofInsolvencypursuanttoT.C.A.305102wasnotfiledintheProbateCourtuntilJune18,1991.  Clearly,theundisputedproofdoesnotshowthatMs.LaneortheCoExecutorskneworshouldhaveknownofthetransferrenderingthefather'sestateinsolventbeforeOctober3,1984,(adatetenyearspriortothefilingofthepresentsuit),whichwaslessthan30daysafterthefact.  Astotheissueofresjudicata,therecorddisclosesthattherewasapriorsuitbetweenthesamepartiesseekingtosetasidethreeseparaterealestateconveyancesandallegingthattheywerefraudulentbecausethesetransfersrenderedtheestateinsolvent.Inthatsuit,theTrialCourtfoundinfavorofMr.Carrickonthegroundthatatthetimeofthetransferofrealty,thefatherstillownedthecertificateofdepositwhichiscentraltothissuit.  Thepriorsuitinvolvedthreetransfersofrealtyandnotthecertificateofdeposit.ItappearsthatinthepriorsuittheCoAdministratorswereallowedtoreopentheirproofandexplorethecircumstancessurroundingthetransferofthecertificateofdepositasitimpactedtheirsuitseekingtosetasidetheconveyancesofrealestate,whichpromptedthemtoseekanamendmenttotheircomplaintalsoallegingitsfraudulenttransfer.TheTrialCourt,however,deniedtheirmotiontoamend,findingthattheCoAdministratorswereattemptingto"addanewcauseofaction."  Itthusappearsthattheissueinquestioninthiscasewasneithertriednor,inlightoftheTrialCourt'sruling,couldhavebeentriedintheprioraction.
