OnJuly17,1995,thepetitionerfiledthesepetitionsattackinghisguiltypleastotheoffensesofrobberyandattempttocommitafelony.ThesepleaswereenteredonNovember19,1974,andJanuary25,1989,respectively.Thepetitionerallegesthatneitherpleawasenteredknowinglyandvoluntarilybecausehewasnotadvisedthattheconvictionscouldbeusedagainsthiminthefuturenorwasheadvisedastotherangeofpunishmentforrobbery.Hefurtheralleges,astotherobberyconviction,thathereceivedineffectiveassistanceofcounselbecausehisattorneyhadaconflictinrepresentingallthreecodefendantsontherobberychargeandthathisattorneyfailedtoproperlyinvestigatethatchargeandfilenecessarypretrialmotions.  Thepetitionscannotbetreatedasonesforthewritoferrorcoramnobisbecausesuchpleadingsmustbefiledwithinoneyearafterthejudgmentunderattackbecomesfinal.T.C.A.277103.Norcanthepetitionsbeproperlytreatedasonesforhabeascorpusreliefsincethereisnoallegationthatthejudgmentsarevoidorthatthedefendantisimprisonedonasentencethathasexpired.Passarellav.State,891S.W.2d619,62627(Tenn.Crim.App.1994).  Fortheabovereasons,thetrialjudgeproperlytreatedthepetitionsfiledasonesforpostconvictionrelief.Moreover,weholdthatthestatuteoflimitationsapplicabletothesepetitionswasthreeyearspursuanttoT.C.A.4030102(1986Supp).Therefore,thestatuteoflimitationswouldhaverunin1989ontherobberyconvictionandin1992ontheattemptconviction.SincethesepetitionswerefiledinJulyof1995,thetrialcourtcorrectlyheld,withoutahearing,thatthepetitionswerebarredbythestatuteoflimitations.  WeacknowledgethatthispetitionfallswithinthepurviewofthenewPostConvictionProcedureAct,T.C.A.4030201etseq.(1996Supp),whichappliestoallpostconvictionpetitionsfiledafterMay10,1995.See1995Tenn.Pub.Act207,3.ThisnewActprovides,inpertinentpart,that"[n]otwithstandinganyotherprovisionofthisparttothecontrary,anypersonhavinggroundforreliefrecognizedunderthispartshallhaveatleastone(1)yearfromMay10,1995,tofileapetitionoramotiontoreopenapetitionunderthispart."Compiler'sNotestoT.C.A.4030201(1996Supp)referringtoActs1995,ch.207,3.AndwerealizethatanotherpanelofthisCourthasheld,withonememberdissenting,thatthenewPostConvictionProcedureActprovides"aoneyearwindow"inwhicheverydefendantmayfileapetition.ArnoldCarterv.State,C.C.A.No.03C019509CC00270,MonroeCounty(Tenn.Crim.App.filedJuly11,1996,atKnoxville).Thatcaseholdsthattheoneyearwindowisavailableevenifthepetitionwouldhavebeenbarredbythethreeyearstatuteprovidedunderthepreviousact.  However,weadopttheviewsetforthinJudgeWelles'dissent,concludingthat 8       thislanguageisonlyapplicabletothosewhowerenotbarredbythestatuteoflimitationsatthetimethisstatutewentintoeffect.Thus,iflessthanthreeyearshadalreadypassedatthebill'senactment,adefendantassumingthathehadthreeyearsinwhichtofileapetitionforpostconvictionreliefwouldnotbeforeclosedfrombringingasuit;instead,hewouldstillhavetheoneyearfromtheeffectivedateofthestatute.̛̜ D   D   ӜLikeJudgeWelles,wedonotbelievethatthenewActprovidestothosedefendantspreviouslybarredanewoneyearperiodinwhichtopetitionforpostconvictionrelief.Atmost,itprovidesthosebarredanopportunitytoreopenapriorpetitionwithinoneyearofthenewAct'seffectivedate.T.C.A.4030217(1996Supp).Theallegationsunderreviewdonotmeetthecriteriaofthissection.
