ðPetition€for€Contempt€and/orÏAdditional€or€Supplemental€Relief€and/or€Request€for€a€Hearing€to€ShowÏCauseðð€to€hold€Husband€in€contempt€for€his€failure€to€pay€her€òòpendente€liteÏóómonthly€car€payments,€which€resulted€in€the€automobile€being€repossessed,Ïand€his€failure€to€pay€her€òòpendente€liteóó€attorneyððs€fees.€€Also€in€this€petition,ÏWife€avers€that€Husband€represented€to€the€court€in€an€August€16,€1989Ïhearing€that€he€was€paying€$500€per€month€on€a€mortgage€for€the€partiesððÏreal€property€located€in€Texas.€€Wife€avers€that€Husband€was€not€makingÏthese€payments€as€he€represented€to€the€court.€€She€requests€that€the€courtÏorder€Husband€to€begin€making€payments€on€this€real€estate,€to€pay€anyÏand€all€arrearages€on€the€property,€and€to€take€the€necessary€steps€toÏprevent€foreclosure€or€sale€of€the€property.€€On€September€20,€1989,€theÏtrial€court€entered€an€order€requiring€Husband€to€show€cause€why€heÏshould€not€be€held€in€contempt€for€violating€the€courtððs€August€23,€1989Ïorder€by€failing€to€pay€the€monthly€note€on€Wifeððs€automobile.€€Ìà àOn€October€17,€1989,€Wife€filed€a€motion€requesting€the€court€toÏamend€its€August€23,€1989€order€to€increase€the€amount€of€òòpendente€liteÍóóalimony€or€to€require€Husband€to€hold€Wife€harmless€for€the€maritalÏdebts.€€In€this€motion,€Wife€informed€the€court€that€Husband€filed€forÏbankruptcy€in€the€United€States€Bankruptcy€Court€for€the€Middle€DistrictÏof€Tennessee€on€September€21,€1989.€€On€October€25,€1989,€Wife€filed€aÏpetition€in€the€bankruptcy€court€seeking€relief€from€the€automatic€stay€toÏthe€extent€that€the€stay€affected€her€alimony€and€child€support€rights,€andÏon€October€27,€1989,€the€bankruptcy€court€entered€an€order€granting€herÏrelief€from€the€stay.€€Ìà àOn€February€26,€1990,€the€trial€court€entered€an€order€on€HusbandððsÏð ðMotion€for€Partial€Relief€from€Previous€Orderðð€and€on€Wifeððs€petition€forÏcontempt.€€The€trial€court€reserved€the€issue€of€contempt€pending€a€finalÏhearing€and€did€not€modify€its€August€23,€1989€order.€€The€court€orderedÏHusband€to€deliver€possession€of€his€car€to€Wife,€to€pay€the€note€on€thisÏcar,€and€to€pay€the€$500€per€month€mortgage€on€the€Texas€property€toÏprotect€the€partiesðð€property€from€foreclosure.€Ìà àOn€July€18,€1990,€Wife€filed€for€bankruptcy€in€the€United€StatesÏBankruptcy€Court€for€the€Western€District€of€Oklahoma.€€A€trial€tookÏplace€on€July€23€and€24,€1990.€€On€August€13,€1990,€the€trial€court€enteredÏa€decree€granting€Wife€a€divorce€on€the€grounds€of€cruel€and€inhumanÍtreatment,€dismissing€Husbandððs€complaint€for€divorce,€and€orderingÏHusband€to€pay€alimony€òòin€futuroóó€in€the€amount€of€$1,000.00€per€month,€asÏwell€as€child€support.€€The€trial€court€awarded€Wife€the€automobile€then€inÏher€possession€and€made€Husband€responsible€for€the€monthly€carÏpayments.€€The€court€took€the€issue€of€the€division€of€the€marital€propertyÏunder€advisement€pending€completion€of€the€bankruptcy€proceedings.€€TheÏcourt€also€held€the€award€of€attorneyððs€fees€to€Wife€in€abeyance€pendingÏthe€submission€of€affidavits€to€the€court.€€Ìà àWife€filed€a€second€contempt€petition€on€November€16,€1990.€€TheÏpetition€avers€that€Husband€failed€to€make€alimony€and€child€supportÏpayments€for€September€and€October€1990€and€that€he€also€failed€to€makeÏher€car€payment€for€the€month€of€September.€€Wife€requests,€òòinter€aliaóó,€thatÏthe€trial€court€hold€Husband€in€contempt€for€his€failure€to€pay€childÏsupport€and€alimony€and€that€he€be€incarcerated€until€he€purges€himself€ofÏcontempt.€€Wife€also€requests€that€he€be€held€in€contempt€for€his€failure€toÏpay€the€court„ordered€car€payments.€€The€trial€court€entered€an€order€onÏNovember€19,€1990€for€Husband€to€show€cause€why€he€should€not€beÏfound€in€contempt.Ìà àOn€February€14,€1991,€the€trial€court€entered€an€order€stating€thatÍthere€were€multiple€claims€for€relief€and€that,€pursuant€to€Tenn.€R.€Civ.€P.Ï54.02,€the€court€declared€the€parties€absolutely€divorced.€€The€courtÏreserved€the€right€to€divide€the€real€and€personal€property€upon€theÏresolution€of€Wifeððs€bankruptcy.€€The€court€also€vested€title€to€theÏautomobile€in€Wifeððs€possession€in€her€name.€€Ìà àOn€November€12,€1991,€Husband€filed€a€petition€to€reduce€hisÏalimony€payments.€€A€hearing€was€held€on€December€12,€1991€concerningÏWifeððs€November€16,€1990€petition€for€contempt€and€Husbandððs€petitionÏto€reduce€alimony€and€child€support.€€On€January€7,€1992,€the€trial€courtÏentered€an€order€stating€that€Husband€had€paid€Wife€$4,600.00€in€backÏalimony€and€child€support€and€that€he€represented€to€the€court€that€he€hadÏmade€payments€on€the€Wifeððs€automobile€through€October€1991€andÏwould€pay€the€November€and€December€1991€payments€upon€leavingÏcourt.€In€light€of€this,€the€court€stated€that€Husband€purged€himself€ofÏcontempt€and€dismissed€Wifeððs€contempt€petition.€€The€court€alsoÏmodified€the€alimony€and€child€support€awards€to€$500.00€each€per€monthÏuntil€September€1,€1992.€Ìà àHusband€apparently€filed€a€motion€for€further€review€of€hisÏNovember€1991€petition,€and€on€April€5,€1993,€Wife€filed€a€response€inÍwhich€she€advised€the€court€that€both€parties€had€received€discharges€inÏtheir€respective€bankruptcy€proceedings.€€€Wife€further€advised€the€courtÏthat€foreclosure€proceedings€had€been€instituted€on€the€partiesðð€real€estateÏin€Texas.€€The€trial€court€addressed€Husbandððs€motion€in€an€order€datedÏApril€22,€1993€in€which€the€court€found€that€Husbandððs€application€wasÏnot€made€in€good€faith.€€The€order€provides€in€part:€ò òÌÓÓó óà8 àà8 àUpon€testimony€of€the€parties,€argument€ofÏcounsel,€and€the€entire€record€herein,€the€courtÏfinds€that€Dr.€Byrd,€since€the€divorce€was€filed,Ïhas€taken€every€effort€in€his€power€to€defy€theÏorders€of€the€court€and€has€deliberately€becomeÏunderemployed€in€order€to€avoid€paying€childÏsupport€and€alimony€as€heretofore€ordered.€€TheÏcourt€finds€that€Dr.€Byrd€has€a€Medical€degreeÏand€a€Master€of€Public€Health€degree€fromÏHarvard€University€and€the€wherewithal€toÏpractice€his€profession.€€The€court€further€findsÏthat€Dr.€Byrd€insists€on€doing€things€that€do€notÏgenerate€income€even€though€the€court€gave€himÏthe€opportunity€to€rehabilitate€himself€byÏtemporarily€reducing€alimony€and€child€supportÏwhile€he€pursued€his€Masterððs€Degree€at€HarvardÏUniversity.€€The€court€finds€that€this€was€not€aÏgood€faith€application€to€reduce€alimony€andÏchild€support€and€that€he€voluntarily€continues€toÏplace€himself€in€a€position€where€he€asserts€thatÏhe€can€not€comply€with€the€court€order.€€TheÏcourt€finds€that€the€child€support€order€willÏremain€at€$500.00€for€the€month€of€May€afterÏwhich€time€the€child€support€will€be€terminatedÏby€operation€of€law,€since€the€younger€child€willÏbe€18€years€old€on€May€15,€1993,€and€willÍgraduate€form€High€School€during€May€1993.€ÏThe€court€further€finds€that€Dr.€Byrd€has€theÏability€to€pay,€that€he€has€designed€his€ownÏproblems,€and€that€Ms.€Byrd€continues€to€haveÏthe€need€for€alimony€that€she€exhibited€at€theÏFinal€Hearing.€€ÌÌÓÓThe€court€ordered€that€the€alimony€award€increased€back€to€$1,000.00€perÏmonth€beginning€in€June€1993€and€ordered€Husband€to€pay€WifeððsÏattorneyððs€fees.€€The€order€was€made€final€pursuant€to€Tenn.€R.€Civ.€P.Ï54.02.€€€€€€Ìà àOn€May€3,€1996,€Husband€filed€a€motion€to€finalize€the€divorce€byÏresolving€the€division€of€personal€property,€and€Wife€filed€a€response€onÏMay€9,€1996.€€In€her€response,€Wife€stated€that€the€partiesðð€real€estate€inÏTexas€had€been€lost€through€bankruptcy€and€requested€that€the€courtÏaward€her€a€judgment€for€the€equity€that€would€have€been€available€hadÏHusband€made€the€mortgage€payments.€€Ìà àOn€July€8,€1996,€Husband€filed€a€petition€to€modify€alimony€allegingÏthat€he€was€no€longer€able€to€make€alimony€payments€because€he€sufferedÏfrom€severe€health€problems,€was€unable€to€work,€and€had€incurredÏextensive€medical€bills€because€he€did€not€have€health€insurance€in€that€heÏhad€taken€family€medical€leave€from€his€medical€practice€to€take€care€of€hisÏseriously€ill€father.€€On€August€8,€1996,€Wife€filed€her€response€toÍHusbandððs€petition€to€modify€alimony,€and€on€August€27,€1996,€she€filedÏan€amended€response.€Ìà àThe€trial€court€held€a€final€hearing€on€August€26€and€27ò ò,ó ó€1996€onÏHusbandððs€motion€to€divide€the€marital€property,€his€motion€to€terminateÏor€reduce€alimony,€and€Wifeððs€petition€for€contempt.€€Husband€was€notÏpresent€at€this€hearing€and€his€telephonic€deposition€and€the€deposition€ofÏDr.€Clinton€Battle,€who€was€once€his€treating€physician,€were€admitted€asÏexhibits.€€At€the€hearing,€Wife€argued€that€she€had€a€contempt€petitionÏpending€before€the€court,€but€the€trial€court€stated€from€the€bench€thatÏthere€was€no€pending€contempt€petition.€€The€trial€court€stated€that€theÏJanuary€1992€order,€based€on€the€December€1991€hearing,€dismissed€herÏNovember€16,€1990€contempt€petition€and€that€there€was€no€otherÏcontempt€petition€before€the€court.€€Ìà àOn€September€11,€1996,€the€court€entered€an€order€on€the€issuesÏraised€in€the€final€hearing€held€on€August€26€and€27,€1996€on€HusbandððsÏmotion€to€finalize€the€divorce€by€dividing€the€marital€property€and€on€hisÏmotion€to€terminate€or€reduce€alimony.€€In€the€order,€the€trial€court€statedÏthat€it€had€reviewed€the€deposition€of€Husbandððs€doctor,€Dr.€ClintonÏBattle,€and€found€that€Dr.€Byrd€was€unable€to€travel€to€the€State€ofÍTennessee€to€appear€in€the€proceedings.€€Consequently,€the€court€allowedÏHusbandððs€telephonic€deposition€into€evidence€for€purposes€of€theÏproceedings.€€The€court€found€that€the€only€marital€assets€owned€by€theÏparties€that€had€not€been€previously€divided,€repossessed,€or€lost€in€theÏbankruptcy€proceedings€consisted€of€personal€property€in€storage€in€Texas.€ÏThe€court€found€that€theò ò€ó óremaining€marital€assets€were€lost€through€theÏfault€of€both€parties€and€that€the€parties€had€lived€well€beyond€their€means.€ÏThe€court€awarded€the€partiesðð€personal€property€in€Texas€to€Wife€andÏawarded€to€each€party€the€remaining€personal€property€in€his€or€herÏpossession.€€The€trial€court€also€dismissed€Wifeððs€petition€for€an€increase€inÏalimony€because€it€was€untimely€filed€and€dismissed€Husbandððs€petition€forÏtermination€or€reduction€in€alimony€because€he€failed€to€carry€his€burdenÏof€proof.€€The€order€further€provides€that€it€is€a€final€order€disposing€of€allÏremaining€issues€in€the€case€and€states€that€any€claims€for€relief€filed€byÏeither€party€not€heretofore€or€specifically€addressed€were€denied.€€Ïà àHusband€filed€a€motion€to€alter€or€amend€the€judgment.€€OnÏOctober€9,€1996,€Wife€filed€a€motion€to€alter€or€amend€the€September€11,Ï1996€judgment€as€to€the€award€to€each€party€of€the€personal€property€inÏhis€or€her€possession.€€She€also€contends€that€the€trial€court€never€ruled€onÍher€contempt€petition€filed€on€September€19,€1989€as€to€Husbandððs€failureÏto€make€the€payments€on€the€real€property€in€Texas,€which€the€courtÏordered€him€to€make€on€February€26,€1990.€€On€October€14,€Husband€filedÏa€response€to€Wifeððs€motion€to€alter€or€amend€the€judgment.€€Ìà àThe€trial€court€entered€an€order€on€October€28,€1996€denyingÏHusbandððs€motion€to€alter€or€amend.€€On€November€18,€1996,€the€trialÏcourt€entered€an€order€denying€Wifeððs€motion€to€alter€or€amend€theÏjudgment.€€Ìà àAlthough€Wife€contends€that€the€trial€court€never€addressed€her€firstÏpetition€to€hold€Husband€in€contempt€for€his€failure€to€make€the€mortgageÏpayments,€our€review€of€the€record€indicates€that€this€petition€is€not€aÏpetition€to€hold€him€in€contempt€on€this€particular€issue.€€In€her€firstÏpetition,€which€she€filed€in€September€1989,€Wife€sought€to€hold€HusbandÏin€contempt€for€his€failure€to€comply€with€the€courtððs€August€23,€1989Ïorder€on€òòpendente€lite€óósupport€requiring€him€to€pay€the€car€payments€on€theÏcar€in€her€possession€and€to€pay€her€attorneyððs€fees.€€Also€in€that€petition,Ïshe€requested€that€the€court€order€Husband€to€make€the€mortgageÏpayments€on€the€partiesðð€real€property€in€Texas.€€The€trial€courtÍsubsequently€entered€an€order€requiring€him€to€make€the€mortgageÏpayments,€but€reserving€the€issue€of€contempt€as€to€the€issues€raised€inÏthat€petition.€€Wife€later€filed€a€second€contempt€petition€regardingÏHusbandððs€failure€to€pay€alimony€and€child€support,€and€the€issues€as€toÏcontempt€for€the€failure€to€pay€alimony,€child€support,€and€car€paymentsÏwere€all€dealt€with€at€the€December€12,€1991€hearing€and€in€the€trialÏcourtððs€January€7,€1992€order.× ƒ) ××  ×€€Ìà àWifeððs€argument€that€her€first€contempt€petition€is€a€petition€toÏhold€Husband€in€contempt€for€his€failure€to€make€the€mortgage€paymentsÏon€the€œTexas›€property€is€without€merit.€€At€the€time€she€filed€this€petition,Ïin€September€1989,€Husband€was€not€under€a€court€order€to€make€theseÏpayments.€€The€order€requiring€him€to€do€so€was€not€entered€untilÏFebruary€26,€1990,€several€months€after€she€filed€her€first€contemptÏpetition.€€In€addition,€the€trial€court€dismissed€her€second€contemptÏpetition€in€an€order€entered€January€7,€1992.€€Thus,€the€trial€court€wasÏcorrect€when€it€held€that€there€was€no€contempt€petition€pending€at€theÏtime€of€the€August€1996€hearing.€€€€Ìà àIn€her€second€issue,€Wife€contends€that€the€Texas€real€property€wasÍlost€through€Husbandððs€bankruptcy€proceedings€and€that€she€is€entitled€toÏa€judgment€for€the€losses€arising€from€his€failure€to€keep€the€mortgageÏpayments€on€this€property€current.€€On€the€other€hand,€Husband€contendsÏthat€the€property€was€repossessed€œand€not›€lost€through€bankruptcy.€ÏConsequently,€he€maintains€that€the€property€was€not€part€of€the€assetsÏavailable€for€division€at€the€final€hearing.Ìà àRegardless€of€whether€the€property€was€lost€through€the€bankruptcyÏproceedings€or€repossessed,€the€property€was€not€part€of€the€martial€estateÏat€the€time€the€court€divided€the€martial€property.€€In€addition,€the€trialÏcourt€specifically€stated€in€its€September€11,€1996€order€that€the€loss€ofÏthe€remaining€marital€assets€was€due€to€the€fault€of€both€parties.€ÏMoreover,€Wife€admits€in€her€brief€that€there€is€no€evidence€in€theÏtranscript€concerning€the€fate€of€this€real€estate.€€Therefore,€this€issue€alsoÏwithout€merit.Ìà àIn€Husbandððs€issue,€he€contends€that€the€trial€court€erred€in€denyingÏhis€petition€to€terminate€or€reduce€alimony€because€his€inability€to€workÏas€a€result€of€his€health€problems€constitutes€a€substantial€and€materialÏchange€in€circumstances.€€à àOn€application€of€either€party,€the€courtÏmay€decree€an€increase€or€decrease€of€alimony€only€upon€a€showing€of€aÍsubstantial€and€material€change€of€circumstances.€€T.C.A.€ðð€36„5„101(a)(1)Ï(1996).€€The€party€seeking€relief€on€the€grounds€of€changed€circumstancesÏhas€the€burden€of€proving€the€changed€circumstances,€which€must€beÏshown€to€have€occurred€after€the€entry€of€the€divorce€decree€and€must€notÏhave€been€foreseeable€when€the€decree€was€entered€into€or€in€theÏcontemplation€of€the€parties€when€they€entered€into€the€support€andÏalimony€agreement.€€òòò óóó,€798€S.W.2d€244,€245€(Tenn.ÏApp.€1990).€€We€give€a€trial€courtððs€decision€on€these€matters€great€weightÏand€will€only€interfere€with€such€a€decision€when€we€find€an€abuse€ofÏdiscretion.€€òòò òKelly€v.€Kellyó óóó,€679€S.W.2d€458,€460€(Tenn.€App.€1984).€€TheÏtrial€court€is€obliged€to€consider€each€of€the€factors€set€forth€in€T.C.A.€ððÍ36„5„101(d)(1)€when€evaluating€a€petition€to€modify€alimony,€but€theÏprimary€factors€are€the€obligorððs€ability€to€pay€and€the€obligeeððs€financialÏneed.€€ò òòòElliottó óóó,€825€S.W.2d€at€90.Ìà àHusband€argues€that€he€has€suffered€severe€health€problems€since€theÏoriginal€alimony€award€and€that€he€is€unable€to€obtain€gainful€employmentÏas€a€result€of€these€health€problems.€€He€also€argues€that€his€extensiveÏmedical€bills€render€him€unable€to€make€his€alimony€payments.€€The€recordÏindicates€Husband€left€his€employment€to€take€care€of€his€father€who€wasÏseriously€ill€and€that,€as€a€result,€Husband€lost€his€health€insurance€andÏincurred€extensive€medical€bills.€€This€obligation€and€its€attendingÏconsequences€were€voluntarily€assumed€with€full€knowledge€of€hisÏobligations€of€support€to€his€former€wife.€€Voluntarily€assumed€obligationsÏdo€not€constitute€a€change€in€circumstances.€€òòò òDillow€v.€Dillowó óóó,€575ÏS.W.2d€289,€291€(Tenn.€App.1978).Ìà àAs€to€Husbandððs€alleged€inability€to€work,€Husband€submitted€theÏdeposition€testimony€of€the€doctor€who€treated€him€when€he€was€admittedÏto€the€hospital€for€his€health€problems.€€This€doctor€was€not€treatingÏHusband€at€the€œtime›€he€filed€his€petition€to€modify€alimony,€however,€andÏHusband€failed€to€offer€the€testimony€of€the€physicians€who€were€treatingÍhim€at€the€time€relevant€to€this€petition.€€The€only€other€evidence€offeredÏin€support€of€Husbandððs€position€was€his€own€deposition.€€In€addition,Ïthere€was€evidence€in€the€record€that€Husband€could€still€perform€someÏtasks€that€would€lead€to€gainful€employment€consistent€with€his€M.D.€andÏhis€Masterððs€Degree€in€Public€Health€from€Harvard€University,€such€asÏresearch€and€writing.€€Ìà àThe€trial€court€specifically€stated€that€Husband€failed€to€carry€hisÏburden€of€proof€to€show€a€substantial€and€material€change€inÏcircumstances.€€The€trial€court€in€this€case€found€that€Husband€had€theÏability€to€pay€the€award€and€that€Wife€showed€a€need€for€the€continuationÏof€alimony.€€From€our€review€of€the€record,€the€trial€court€did€not€abuse€itsÏdiscretion.€€This€issue€is€also€without€merit.€Ìà àWife€also€contends€that€Husband€should€pay€the€attorneyððs€fees€thatÏshe€has€incurred€in€this€appeal€to€protect€her€alimony.€€In€€ò òòòBaggett€v.ÏBaggettó óóó,€512€S.W.2d€292,€294€(Tenn.€App.€1973),€this€Court€held€that€anÏaward€of€attorneyððs€fees€was€inappropriate€where€both€parties€were€partiallyÏsuccessful€on€appeal.€€We€decline,€in€this€case,€to€award€Wife€attorneyððsÏfees€incurred€on€appeal.Ìà
