Q   InByrdv.Bradley,913S.W.2d181(Tenn.Ct.App.1995),thisCourtheld .~  thatMr.Byrd,thePetitionerherein,whohadbeensentencedtolifeimprisonmentin1976,wasnotentitledtoashorteningofthetimehemustservebeforebecomingeligibleforparolebecauseoftheoperationofTenn.CodeAnn.403613(1975),whichwasineffectatthetimeofhisconvictionandsentencing.Thatstatuteprovidedthatanyonesentencedtolifeimprisonmentwouldbeeligibleforparoleonlyafterserving30fullcalendaryears.Therefore,theCourtconcluded,Mr.Byrdwasnoteligible,fromthedateofhisincarcerationuntilhesignedawaiverunderTenn.CodeAnn.4121236(1985),foranysentencereductioncreditswhichwouldmakehimeligibleforparolepriortohisservingthirtyyears. ThetrialcourtquitecorrectlydeterminedthatanyclaimbyMr.ByrdforearlierparoleeligibilitywhichwasbasedontheDepartmentofCorrectionsfailuretoawardhimsentencereductioncreditsforthetimeperiodbetweenhisincarcerationandhisexecutionofasection236waiverwasbarred,underthedoctrineofresjudicata,bytheByrdv.Bradleyholding.Asimpledefinitionof 2!.* resjudicataisthatitisa"rulethatafinaljudgmentrenderedbyacourtof 4N0, competentjurisdictiononthemeritsisconclusiveastotherightsofthepartiesandtheirprivies,and,astothem,constitutesanabsolutebartoasubsequentaction X940 involvingthesameclaim,demandorcauseofaction".Black'sLaw 1 Dictionary1172(5thed.1979),asquotedinRichardsonv.TennesseeBd.of  b Dentistry,913S.W.2d446(Tenn.1995). C   Mr.Byrdassertsonappealthatthetrialcourtfailedtoaddressotherissuesraisedinhispetition.Infact,thetrialcourtspecificallyfound:-Y 8 80 ! !Giventhelegalprincipleofresjudicataandthatan &  inmateisnotentitle[sic]toearnsentencereductioncreditsuntilhehassignedthewaiveraswellasthe V absenceinthecomplaintofanyshowingwhythepetitionerisbeingdetainedinviolationoffederalandstateconstitutions,theCourtdeterminesthatthe N respondentsmotiontodismissshallbegrantedonthegroundsthecomplaintfailstostateaclaimuponwhichreliefcanbegranted.(Emphasisadded.) 0 0  Y - ThetrialcourtclearlyconsideredthePetitionersotherclaimsandfoundthemwanting.Weconcurinthetrialcourtsjudgmentinthisregard.Mr.Byrdspetitionisclearlyandexclusivelydirectedtohiscurrentcontinuingincarceration.Further,thereappearstobenodisputeregardinghiseligibilityforcreditsafterMr.ByrdsexecutionofawaiveronMarch1,1986asauthorizedinTenn.CodeAnn.4121236(1985).MMr.ByrdhasnotchallengedtheDepartmentscomputationofsentencecreditsforwhichheiseligible,butratherchallengedtheDepartmentsinterpretationofeligibility. Mr.Byrdsclaimsregardinghisentitlementto thebenefitsofallegedlyshortersentencesaffordedtopersonssentencedunderthe1989SentencingReformActarewithoutmerit.TheconstitutionalandstatutoryargumentspropoundedbyMr.Byrdhavebeenconsideredandrejected.SeeWilsonv.State, 410, 980S.W.2d196(Tenn.Ct.App.1998),perm.toappealdenied(Tenn.1998); 7b2.
