Inthisdivorcecase,GlendaBenning(wife)challengesthetrialcourt'sawardofpermanentalimonytoJamesBenning(husband).Afterthewifefiledfordivorceandthepartiesseparated,thehusbandmovedintothesameapartmentwithoneJayleneDeen.Onappeal,thewifearguesthatthetrialcourterredinfindingthatthestatutorypresumptionfoundatT.C.A.365101(a)(3)hadbeenrebuttedbytheevidencepresentedbythehusband.Weaffirmthejudgmentofthetrialcourt.  @8,9   ThepartiesweremarriedonNovember27,1982.Sometimein 1983,thehusbandbegansufferingfromadebilitatingconditionknownaschronicphlebitis.Atsomepointintimeduringthemid1980s,notpreciselyrevealedbytherecord,thehusbandwasdeclaredonehundredpercentdisabledbytheSocialSecurityAdministration.    Thehusbandisagraphicartist.Startingin1989,hebeganpainting"firstdaycovers"forstampcollectors.Afirstdaycoverisessentiallyanenvelopeuponwhichcollectorsplacestamps,typicallythosestampswhichhavebeenreleasedonthefirstdayoftheirpublication.ThehusbandtestifiedthathisphysicalconditionhasmadeitimpossibleforhimtopaintfirstdaycoverssinceAprilof1997.  OnJuly8,1997,thewifefiledacomplaintfordivorce.InAugust,thehusbandmovedoutofthemaritalresidenceandbegansharinganapartmentwithJayleneDeen.Attrial,thewifearguedthatthestatutorypresumptionfoundatT.C.A.365101(a)(3)shouldapplyandprecludethehusbandfromreceivingalimony.&   T.C.A.365101(a)(3)providesasfollows:8  8`   (3)Inallcaseswhereapersonisreceiving' *alimonyinfuturoandthealimonyrecipientliveswithathirdperson,arebuttableϐpresumptionistherebyraisedthat: ` x` x 8  8`   (A)Thethirdpersoniscontributingtothesupportofthealimonyrecipientandthealimonyrecipientthereforedoesnotneedtheamountofsupportpreviouslyawarded,andthecourtthereforeshouldsuspendallorpartofthealimonyobligationoftheformerspouse;or ` x` x   6*7 8  8`   (B)Thethirdpersonisreceivingsupportfrom thealimonyrecipientandthealimonyrecipientthereforedoesnotneedtheamountofalimonypreviouslyawardedandthecourtthereforeshouldsuspendallorpartofthealimonyobligationoftheformerspouse. ` x` x   ThehusbandtestifiedthatthereasonhemovedinwithMs.Deenwastoreducehisexpenses,andthattheysharetherentandutilitiesexpenses.Hetestifiedthattheapartmenthasseparatebedroomsandbathrooms,andthathehasneverhadanykindofromanticorsexualrelationshipwithMs.Deen.Hestatedthattheykeeptheirfinancesentirelyseparate,andthatneithercontributesfinancialsupporttotheother.Thehusbandpresentedthetestimonyoftwoofhisacquaintanceswhohadfrequentlyvisitedwithhimathisapartment.Both,whotestifiedtothesameeffect.Thewifepresentednoevidencetendingtocontradictthehusband'sassertionsinthisregard. 6 +. Ї  ThehusbandarguesonappealthatT.C.A.365101(a)(3)doesnotapplytothecircumstancesofthepresentcase,becauseatthetimeoftrial,hewasnotreceivingalimonyinfuturoandthestatuteappliesonly"[i]nallcaseswhereapersonisreceivingalimonyinfuturo."Whilethehusband'sargumentissemanticallycorrect,weareoftheopinionthatthestatuteshouldbereasonablyconstruedtoapplytosituationssuchasthepresent,whereapartywhoislivingwithanotherpersonisseekingalimonyinadivorcecase.Toholdotherwisewouldyieldinconsistentandjudiciallyinefficientresults.Forinstance,ifthestatuteisnotconstruedtoincludethepresentsituation,theostensiblealimonypayorwouldundoubtedlysimplywaitforthealimonyaward,thenreturntocourtseekingtheapplicationofthestatute.Weconstruethestatutetoapplytothosesituationswhereapartytoadivorcecaseislivingwithathirdpersonandisseekingalimonyinfuturofromhisorherexspouse.  Turningtothemeritsofthecase,thewifearguesinherbriefthat"[t]heproofintherecordshowsthatMr.BenningmovedintotheapartmentwithMs.Deentoengageinameretriciousrelationshipwhichshouldnotbehonoredbyourcourts."Thereissimplynoevidenceintherecordwhichsupportsthisallegation.AllofthetestimonyintherecordistotheeffectthatthehusbandandMs.Deenmovedintoanapartmenttoshareandreduce 6 +. expenses,andthattheydonotfinanciallysupporteachother.Further,thewifedoesnotallegethatthehusbandcommittedadulterywithMs.Deenoranyoneelse,andthereisnoevidencesuggestingadultery.  Wenotethat,althoughtheargumentsintheparties'briefsfocusonwhethertherewasaromanticrelationshipbetweenthehusbandandMs.Deen,thestatutedoesnotrequireanyspecifickindofrelationshipforitsapplication.Itappliesinallcaseswhereanalimonyrecipient"liveswithathirdperson,"regardlessoftherelationship,orthegenderofthethirdperson.TheonlyinquirydirectlyrelevanttoT.C.A.365101(a)(3),byitsownclearterms,iswhetherthealimonyrecipientiseitherprovidingto,orreceivingfinancialsupportfrom,thepersonwithwhomheorshelives.   #  1      ׀Thetrialcourtcorrectlyfoundthatthehusband's %@ uncontradictedevidenceeffectivelyrebuttedthestatutorypresumptionthatthehusbandwasgivingorreceivingfinancialsupportfromMs.Deen.
