àOn€July€13,€1995,€the€proposed€conservatee,€then€93€year€old€CarltonÏœBlessing,€acting€through€his€attorney€Honorable€Thomas€C.€Binkley€of€theÏNashville€Bar,€responded€denying€his€need€for€a€conservator€and€pointing€out€thatÏhis€daughter€was€a€resident€of€North€Carolina€and€could€not€serve€as€conservatorÏof€his€estate€because€of€the€restrictions€of€Tennessee€Code€Annotated€section€35„¼50„107.€€While€no€order€appears€in€the€file€appointing€a€guardian€ad€litem,ÏHonorable€Shawn€J.€McBrien€("Mr.€McBrien")€of€the€Wilson€County€Bar,€on€JulyÏ31,€1995,€filed€an€interim€report€generally€asserting€that€Carlton€Blessing,€whileÏaged,€hearing€impaired€and€confused,€preferred€to€live€in€his€own€home€under€theÏcare€of€his€stepson,€John€Orville€Blessing€and€John's€wife€Brenda€Blessing.ÌÌà Ø àOn€September€7,€1995,€John€Orville€Blessing€("John€Blessing"),€actingÏthrough€his€attorney,€Honorable€Vester€Neal€Agee,€Sr.€of€the€Wilson€County€Bar,Ïfiled€a€motion€to€intervene€in€the€conservatorship€proceeding.€€In€his€proposedÏintervening€petition,€John€Blessing€denied€any€need€for€a€conservator,€but€assertedÏthat€in€the€event€the€court€determined€a€conservator€to€be€necessary€for€CarltonÏBlessing,€that€he,€John€Blessing,€should€be€named€as€such€conservator.€€By€orderÏof€September€27,€1995,€the€chancellor€allowed€the€intervening€petition€of€JohnÐ Ø8(4@ ÐBlessing.€€On€January€10,€1996,€John€Blessing€filed€a€motion€to€be€appointedÏtemporary€conservator€of€Carlton€Blessing€pending€final€disposition€of€theÏconservatorship€case,€alleging€medical€necessity€as€a€basis€for€temporaryÏconservatorship.€€A€hearing€on€this€temporary€petition€was€held€on€January€10€andÏan€order€was€entered€January€23,€1996,€appointing€John€Blessing€temporaryÏconservator€to€authorize€medical€treatment€and€setting€the€case€for€final€hearingÏon€March€7,€1996.ÌÌà Ø àOn€February€5,€1996,€Mrs.€Ward€filed€a€motion€to€amend€her€petition€toÏsuggest€that€Honorable€James€H.€Rock€of€Coffee€County,€Tennessee,€be€appointedÏas€co„conservator€with€her€of€the€person€and€estate€of€Carlton€Blessing.€ÏFollowing€this,€on€March€7,€1996,€Mr.€McBrien€filed€what€is€termed€his€"final"Ïreport€as€guardian€ad€litem,€recommending€that€Carlton€Blessing€be€allowed€toÏremain€in€his€home€for€as€long€as€possible,€and€that€John€Blessing€be€appointedÏhis€conservator€under€proper€bond€and€instructed€to€prepare€a€propertyÏmanagement€plan.€€This€final€report€of€the€guardian€ad€litem€was€accompanied€byÏletters€from€Sandra€Phillips,€P.H.D.,€Clinical€Director€of€Cumberland€MentalÏHealth€Services,€Inc.,€and€from€Joseph€E.€Hurt,€M.D.€who€opined€that€due€toÏdementia€and€vascular€disease,€Carlton€Blessing€was€incompetent€to€makeÏpersonal€decisions€or€manage€his€own€affairs.€€On€March€26,€1996,€an€order€wasÏentered€allowing€the€amendment€to€the€original€petition€alleging€that€John€RockÏshould€be€appointed€co„conservator€with€Mrs.€Ward.ÌÌà àFollowing€a€hearing,€an€order€was€entered€by€the€court€on€April€15,€1996,Ïwhich€provided€in€its€opening€paragraph:€€"This€matter€having€come€before€theÏcourt€on€the€petition€to€appoint€a€conservator€on€March€7,€1996€and€upon€hearingÏthe€proof€of€the€parties,€witnesses,€exhibits€and€the€reports€of€the€guardian€adÏlitem,€Dr.€Sandra€Phillips€and€Dr.€Hurt€and€the€statements€of€counsel€finds€that€theÏward€is€in€need€of€a€conservator€over€his€the€person€and€his€the€property."€€TheÏcourt€thereupon€appointed€John€Blessing€and€his€wife€Brenda€as€co„conservatorsÏof€the€person€and€property€of€Carlton€Blessing.€€The€record€contains€neither€aÏverbatim€transcript€nor€a€Tennessee€Rules€of€Appellate€Procedure€24(c)€statementÏof€the€evidence€heard€by€the€chancellor€at€this€March€7,€1996€hearing.€€ÌÐ àOn€April€22,€1996,€Mrs.€Ward€filed€an€extensive€motion€to€reconsider€theÏMarch€7,€1996€ruling€supported€by€affidavits€from€both€herself€and€Dr.€Joseph€E.ÏHurt€with€extensive€factual€allegations€therein.€€On€May€3,€1996,€€the€conservatorsÏfiled€an€inventory€and€property€management€plan€along€with€a€response€to€theÏApril€22€€motion€of€Mrs.€Ward,€this€response€being€accompanied€by€an€affidavitÏof€John€Blessing,€asserting€certain€facts.€€On€May€15,€1996,€an€order€was€enteredÏapproving€the€inventory€and€management€plan€of€the€co„conservators€and€settingÏbond€at€$30,000.00.€€On€May€21,€1996,€an€order€was€entered€acknowledgingÏpending€petitions€but€taking€little€action.€€On€May€31,€1996,€the€co„conservatorsÏfiled€an€answer€to€the€motion€of€Mrs.€Ward.€€On€June€7,€1996,€the€guardian€adÏlitem€filed€an€answer€to€the€motion€of€Mrs.€Ward,€recommending€that€same€beÏdismissed.€€ÌÌà Ø àBy€order€of€October€21,€1996,€the€case€was€set€for€trial€on€November€14,Ï1996.€€On€November€14,€1996,€the€guardian€ad€litem€filed€his€"second€finalÏreport"€which€is€extensive€in€its€allegation€of€facts€and€which€concludes€with€the€Ïguardian€ad€litem's€opinion€that€it€was€best€for€the€conservatee€to€maintain€theÏexisting€status.€€On€December€6,€1996,€the€guardian€ad€litem€filed€a€petition€forÏemergency,€temporary€custody,€again€asserting€facts€and€recommending€that€theÏauthority€of€the€co„conservators€be€suspended€until€a€hearing€could€be€held.€€OnÏthat€same€date,€December€6,€1996,€an€order€was€entered€providing€in€part:ÌÓ€Óà8 ÐÌÓ€ÓÐ Ò9"5< ÐIn€conjunction€with€Appellants'€issues€five€and€six,€the€court€will€consider€issueÏnumber€two€presented€by€Appellees,€John€Blessing€and€Sarah€Jones.€€Appellees'Ïissue€number€two€states:€"Whether€or€not€this€court€and€the€trial€court€(chanceryÏcourt)€have€subject€matter€jurisdiction€of€this€cause€since€the€cause€was€neverÏrevived€by€either€Appellant€or€Appellee€in€the€Probate€Court€of€Wilson€County,ÏTennessee,€which€is€a€separate€court€being€Part€II€of€the€General€Sessions€CourtÏof€Wilson€County,€Tennessee."€€Resolution€of€these€issues€depends€on€which€courtÏhas€post„death€jurisdiction€of€the€estate€of€Carlton€Blessing.€€Is€it€the€ChanceryÏCourt€of€Wilson€County,€wherein€the€conservatorship€proceedings€occurred€or,Ïis€it€the€Probate€Court€of€Wilson€County,€wherein€the€estate€of€the€testate€decedentÏis€being€administered?ÌÌà Ø àThe€split€of€authority€in€sister€jurisdictions€is€so€sensitive€to€the€particularÏstate€statute€that€court€decisions€from€other€jurisdictions€are€of€only€marginalÏvalue.€€The€Court€of€Chancery€of€Delaware€made€the€following€observation:ÌÓ€Óà8 Ø àà 0 àThe€text€writers€and€almost€but€not€all€of€the€Courts€whichÏhave€considered€our€problem€have€concluded€that€after€the€death€ofÏthe€mentally€ill€person€the€trustee,€absent€statutory€authority,€has€noÏpower€to€pay€existing€obligations.€€The€creditors€must€file€theirÏclaims€in€the€estate€proceedings.€€.€.€.€Ð Ø ü!Ø ü! ÐÌà8 Ø àà 0 àWhile€various€reasons€have€been€advanced€for€the€conclusionÏthat€a€trustee€may€not€pay€outstanding€obligations€once€the€mentallyÏill€person€has€died,€I€believe€the€basic€reason€for€the€rule€is€thatÏabsent€statutory€power€the€trustee's€power€arises€from€and€isÏdependent€upon€the€existence€of€the€mentally€ill€person.€€Once€thatÏperson€dies€the€statutory€scheme€applicable€to€decedents'€estatesÏcomes€into€play.€€This,€of€course,€is€what€happens€in€the€ordinaryÏdeath€case.€€It€is€only€the€fact€of€a€trusteeship€that€causes€the€problemÏhere.€€But€as€indicated,€in€the€absence€of€statutory€power,€the€trusteeÏcannot€pay€outstanding€obligations€after€the€death€of€the€mentally€illÏperson.Ð Ø ü!Ø ü! òòòAmerican€Nat'lÐ È738 ÐBankó óóó,€188€S.W.2d€at€974.€€American€National€Bank€was€properly€appointed€asÐ c9³4: Ðher€guardian.€€She€had€little€personal€property€but€owned€148€acres€of€farm€land.€ÏThe€guardian€undertook€its€duties€and€incurred€attorney€fees€and€costsÏnecessitating€a€petition€to€sell€the€land€of€Mrs.€Bradford€in€order€to€pay€for€herÏcontinued€support€at€Central€State€Hospital.€€Her€husband€intervened€as€nextÏfriend€and€filed€a€petition€attacking€the€lunacy€proceeding€and€the€appointment€ofÏthe€guardian.€€ò àIn€the€case€at€bar,€the€chancery€court€had€preauthorized€no€expenditure€forÏattorney€fees€or€anything€else.€€While€the€guardian€ad€litem€had€suggested€the€saleÏof€the€real€property€of€the€conservatee€prior€to€the€death€of€the€conservatee,€theÏcourt€had€taken€no€action€to€effect€such€a€sale.€€Only€after€the€January€20,€1997Ïdeath€of€Carlton€Blessing€did€the€fight€over€attorney€fees€and€the€limited€personalÏestate€of€the€deceased€conservatee€begin€in€earnest.€€As€was€the€case€with€the€pre„¼death€proceedings,€we€are€favored€with€no€transcript€of€the€evidence€nor€RuleÏ24(c)€statement€nor€anything€else€by€which€this€court€may€review€òòde€novoóó€theÐ f!¶$ Ðevidence€under€which€the€chancellor€sustained€all€applications€for€attorney€feesÏby€all€parties€and€reduced€them€to€judgment.€€We€must€again€conclusivelyÏpresume€that€the€evidence,€not€preserved€for€our€review,€supported€the€action€ofÏthe€chancellor.€€ÌÌà Ø àUnless€subject€matter€jurisdiction€abated€upon€the€death€of€the€conservatee,Ïwe€have€no€choice€but€to€affirm€the€chancellor€in€all€respects€in€view€of€theÏextensive€powers€as€to€the€waiver€of€specific€requirements€vested€in€the€chancellorÏby€virtue€of€Tennessee€Code€Annotated€section€34„11„121(1996).€€UnderÏTennessee's€1992€statutory€revision€of€previous€guardianship€and€conservatorshipÏstatutes€as€is€evidenced€in€Tennessee€Code€Annotated€Title€34,€chp.€11„13,€theÏconservatorship€terminates€upon€death€of€the€conservatee.€€Tenn.€Code€Ann.€ðð€34„¼13„108(e)(1996).€€The€conservator€must,€however,€make€a€final€settlement€withinÏ120€days€and€the€conservatorship€court€retains€jurisdiction€for€this€winding€up€ofÏthe€conservatorship.€€It€is€obvious€from€the€May€6,€1997€findings€of€theÐ
