àHowever€the€òòñïñœñïñAshbyñïñ›ñïñóó€case€involved€the€proper€application€of€theÐ Ø6Ð/3 ÐSentencing€Reform€Act€of€1989€to€a€defendant€who€had€been€sentenced€under€thatÐ ¸8°15 ÐAct€on€November€15,€1989.€€The€Supreme€Court€asserted€that€the€question€of€prisonÏovercrowding€should€have€been€part€of€the€equation€considered€by€the€trial€court€inÏits€original€sentence.€€That€case€did€not€involve€the€assertion€of€a€right€to€beÏñïñœñïñresentencedñïñ›ñïñ€because€of€a€change€in€the€law.€€Thus€the€opinion€in€òòñïñœñïñAshbyñïñ›ñïñóó€does€notÐ
