TheTennesseeSupremeCourtneverreviewedtheRayv.Stantondecisionoranyofitsprogeny.ThiscourthasfollowedRayv.Stantononthreeoccasions 0   כbuthasalsoindicated,atleastindictum,itswillingnesstodepartfromthedecision.In1991,wenotedthat itwouldbeentirelyunjustandunacceptabletodenytoapersondirectlyinterested(theaccused)aprivilegegrantedtoallothermembersofthepublic.Freemanv.Jeffcoat,App.No.01A019103CV00086,1991WL165802,at*6(Tenn.Ct.App.Aug.30,1991),perm.app.denied(Tenn.May18,1992)(NotRecommendedforPublication).WealsonotedthattheFreemanv.Jeffcoatdecision implicitlyrejectedthepropositionthat...aconvictedfelon,shouldbebarredfrommaintaininganactionunderthePublicRecordsAct.CapitalCaseResourceCtr.ofTenn.,Inc.v.Woodall,App.No.01A019104CH00150,1992WL12217,at*7(Tenn.Ct.App.Jan.29,1992).Withinthelastyear,westatedthatevenifaninmatehastherighttoinspectpublicrecords,thepublicrecordsstatutedidnotrequirethecustodianoftherecordstoprovidetheinmatewithcopiesoftherecordsatgovernmentalexpense.Alcornv.State,App.No.01A019507CH00315,1995WL699964,at*2(Tenn.Ct.App.Nov.29,1995),perm.app.deniedconcurringinresultsonly(Tenn.Mar.25,1996). ThisdecisionaluncertaintyshouldpromptustogiveRayv.Stantonasecondlook.Werewetodoso,wewouldconcludethatthedecisioncannotwithstandrenewedscrutinybecauseitimposesgreatercivildisabilitiesonconvictedfelonsthanarepermittedbystatute. Tennesseeisnotoneoftherelativelyfewremainingstateswitha civildeathstatuteonthebooks.Acivildeathstatuteisablanketprovisionthatdeprivesconvictedcriminalsofallcivilorcitizenshiprightswhileservingtheirprisonsentence.SeeSpecialProject,TheCollateralConsequencesofaCriminalConviction,23Vand.L.Rev.929,95051(1970).Instead,Tennesseehasaseriesofspecificdisabilitystatutespertainingtoconvictedfelons.Uponbeingconvictedofanyfelony,apersonloseshisorherrighttovote,seeTenn.CodeAnn.4020112,hisorherrighttoholdpublicoffice,seeTenn.CodeAnn.4020114(1990),andhisorherrighttoserveasafiduciary.SeeTenn.CodeAnn.4020115(1990).Personsconvictedofcertainviolentcriminaloffensesarealsoprohibitedfromcarryinghandguns.SeeTenn.CodeAnn.39171307(b)(1991).AllthesecivilrightscanberestoredusingtheproceedingauthorizedbyTenn.CodeAnn.4029101,105(1990&Supp.1996). Thepolicyimplicitincivildeathstatuteshaditsorigininthe fogsandfictionsoffeudaljurisprudenceandisinconsistentwiththespiritofourmodernspiritofgovernment.Byersv.SunSav.Bank,139P.948,949(Okla.1914).Thus,despitethe80yearolddictumthatfelonsarenotcitizensbecausetheyhavebeenadjudgedinfamous, 1   ׀wecannotexpandthecollateralconsequencesofacriminalconvictionbeyondthoseclearlyprescribedbytheGeneralAssembly.NothinginthelanguageofthepublicrecordsstatutesortheirlegislativehistoryprovidesabasisforconcludingthattheGeneralAssemblyemployedtheword citizeninTenn.CodeAnn.107503(a)inordertopreventincarceratedfelonsfromgainingaccesstopublicrecords.Accordingly,IwouldholdthatMr.ColehasstandingtoseekaccesstothepublicrecordsconcerningtheAugust1995riotattheTurneyCenter.      ____________________________      WILLIAMC.KOCH,JR.,JUDGE
