Petitionerwasconvictedofautomobilelarcenyin1990andsentencedtosixyears.Afterbeingreleasedonparole,petitionerwaschargedwithandconvictedofthreecountsofburglary.Asaresult,hereceivedthreeconsecutivefouryearsentences.InAugust1995,petitionerwashousedattheTurneyCenterIndustrialPrisonandFarminOnly,Tennessee. On7August1995,ariotbrokeoutattheTurneyCenter.Thereafter,prisonofficialsplacedpetitionerininvoluntaryadministrativesegregationbecauseofhisparticipationintheriot.Later,petitionerrequestedalldocumentsinthepossessionofthewardenatTurneyCenterthatrelatedtotheAugust1995riot.Whenpetitionerfailedtoreceivethesedocuments,heturnedtothecourts. On14December1995,petitionerfiledapetitionintheChanceryCourtforHickmanCountyrequestingaccesstodocumentsrelatingtotheAugust1995riotpursuanttosection107503ofthePublicRecordsAct.Thecourtissuedanorderrequiringrespondentstoshowcausewhythecourtshouldnotgrantpetitioner'srequest.RespondentsmovedtodismissthepetitionandallegedthatpetitionerlackedstandingtobringanactionunderthePublicRecordsAct.Petitionerrespondedtothemotion.InFebruary1996,thechancerycourtgrantedthemotionanddismissedthepetition. Thesoleissuebeforethiscourtiswhetherthechancerycourtcorrectlyfoundthatpetitioner,aconvictedfelon,lackedstandingtobringanactionundersection107503ofthePublicRecordsAct. TennesseeCodeAnnotatedsection107503(a)providesthatpublicrecordsshallbemadeavailableto"anycitizenofTennessee"forpersonalinspection.Tenn.CodeAnn.107503(a)(Supp.1995).Moreover,a"citizenofTennessee"mayfileapetitionforaccesstopublicrecords. Id. 107505(a)(1992).Thewesternsectionofthiscourthasheldthatapersonconvictedofafelonywhichrendershimorherinfamousisnota"citizenofTennessee"withinthemeaningofTennesseeCodeAnnotatedsections107503or107505andlacksstandingtobringanactionforaccesstopublicrecords. InretheRecordsSoughtbyDanielB.Taylor ,No.01A019211CH00439,1993WL73905,at*2*3(Tenn.App.17Mar.1993) .   ; Bradleyv.Fowler ,C.A.No.1387,1991WL25929,at*1(Tenn.App.4Mar.1991).Bystatute,apersonconvictedofanyfelonyisinfamous.Tenn.CodeAnn.4020112(1990)(amendedby1996Tenn.Pub.Actsch.675,33).Becausepetitionerwasconvictedofafelony,heisnotacitizenforthepurposeofthePublicRecordsActandlacksstandingtobringanactionundertheAct. Thiscourthasdecidedseveralothercaseswhichinvolvedsimilarissues;however,allofthesecasesaredistinguishablefromthepresentcase.Toexplain,in1995thiscourtdecidedacaseinvolvingapetitionfiledbyaconvictedfelonrequestingcopiesofcertaindocuments. Alcornv.State ,No.01A019507CH00315,1995WL699964(Tenn.App.29Nov.1995).In Alcorn ,thiscourtheldthataconvictedfelondidnothaveastatutoryrighttoreceivecopiesofcertainpublicrecords. Id. at*2.Itdidnotdeterminewhetherthefelonwasentitledtoaccesstothedocuments.Inthiscase,thepetitionerisnotrequestingcopiesoftherecords;heisonlyrequestingaccess. Intwooftheothercasesthepetitionerswereattorneyswhorepresentedfelons. CapitalCaseResourceCtr.,Inc.v.Woodall ,No.01A019104CH00150,1992WL12217(Tenn.App.29June1992); Freemanv.Jeffcoat ,No.01A019103CV00086,1991WL165802(Tenn.App.30August1991).Also,thecourtdidnotdirectlyaddressthestandingissueaspresentedinthependingcaseineitheropinion.Moreover,becausetheissueofwhetherafelonhasstandingwasnotnecessarytothedecisionineithercase,anydiscussionofthatissuewasdicta. In Freeman ,thecourtaddressedtheissueofwhetheracaseis terminatedwhenthereisapostconvictionappealpending.In Woodall ,thiscourtaddressedtheissueofwhethertheattorney/petitionerhadstanding.Thecourtrecognizedthat Freeman didnotdirectlyaddresstheissueofwhetheraconvictedfelonhasstanding,butwentontostatethat JudgeToddimplicitlyrejectedthepropositionthattheclienthimself,aconvictedfelon,shouldbebarredfrommaintaininganactionunderthePublicRecordsAct. Woodall ,1992WL12217,at*7.Afterbrieflydiscussingthisconcept,thecourtmovedontotheissuebeforeit,whethertheattorneyhadstanding,andconcludedthatany citizenhasstandingincludinganattorneyrepresentingafelonregardlessofwhethertherequestisforthebenefitofanoncitizen.Thisisnottheissuecurrentlybeforethecourt.
