(#(#  `  Essentially,theCityarguesthattheTrialJudge,byquestioningwitnesses interferedwiththepresentationofitscase.OurreviewoftherecorddoesestablishthattheTrialJudgewasproactiveinquestioningwitnesses. `  TennesseeRulesofEvidence,Rule614(b),permitstheJudgetointerrogatewitnesses,anditdoesnotappearthattheJudgesquestioningpreventedcounselfromaskinganyquestionsofthewitnesses,norwasanyobjectionmadetotheprocedures.Judgeshavebroaddiscretioninconductingtrials.However,thebetterpracticeistopermitcounseltopresenthisorherevidencewithoutinterruption,andiftheCourtthenfeelsfurtherinformationshouldbedeveloped, 811 theJudgethencanfurtherinterrogatethewitness. `  SincetheCitywasnotdeniedtherighttoofferevidenceorquestionitswitnesses,wefindthisissuetobewithoutmerit. `  TheHammockscalledJ.T.Shrumasanexpertwitness,andtheCityassertsthatitwaserrorfortheCourttoallowShrumtotestifyasanexpert,andfurtherthat excessiveweightwasgiventohistestimony. `  Theweighttobegiventotestimonyisessentiallyforthetrieroffacttodetermine.SeeKellermanv.FoodLion,Inc.,929S.W.2d333,335(Tenn. H@ 1996). `  Thewitnesstestifiedthathehadfifteenyearsexperienceasarealestatebroker4 6%  1      כinMaconCounty,hadpersonallyboughtandsoldrealestateinthat `X countyforseveralyears,andthathehadlongbeenfamiliarwiththeparticularpieceofpropertyownedbytheHammocks.Healsostatedthathehadpreviouslytestifiedandbeenacceptedasanexpertwitnessonlandvaluationsbynumerouscourts,includingthattrialcourtandothertrialcourtsinthedistrict,aswellastheFederalDistrictCourt.TheTrialJudgeproperlypermittedthiswitnesstoofferopinionsonvalueontheissuesbeforetheCourt. `  TheCityreliesonTennesseeCodeAnnotated6239103,asabasistodisqualifyShrumfromtestifyingbecausehedoesnotholdarealestateappraiserslicense.Wecannotagree.T.C.A.6239335allowsarealestatebrokertoofferanopinionofvalueinthecourtsofthisState. `  Astothefinalissue,theamountofjustcompensationisaquestion 3,, offactforthetrieroffacttodetermine.Schook&FletcherSupplyCo.v.Cityof  Nashville,47Tenn.App.339,338S.W.2d237,238243(1960).    `  Weconcludetheevidencedoesnotpreponderateagainstinfavoroftheawardsofdamages,T.R.A.P.Rule13(d). `  Thepropertyownertestifiedthatthefairmarketvalueofthepropertyactuallytakenwas$2,000.00andtheCitysappraisertestifiedthatthevaluewas$550.00.񛀛̛ h  h Theownerstestifiedthattheremainderoftheirpropertywasdamagedbetween$20,000.00and$30,000.00andtheirexpertShrumofferedhisopinionthattheremainderoftheirpropertyhaddiminishedinvalueof$19,500.00,whichamountdidincludethepropertyactuallytaken.TheCitysappraiserwasoftheopiniontherewerenoincidentaldamages,althoughplaintiffofferedproofofseverefloodinganderosion,duetotheCitysproject,andreducedaccesstotheϜremainderoftheirproperty. `  HammocktestifiedthataftertheCityfinishedtheproject,therehadbeensevereerosion,andsincethecompletionoftheproject,waterhadfloodedhisdrivewayandaccumulatednearatherentalhouseonthepropertyonseveraloccasions.Hetestifiedthatpriortothetakinghehadtwoseparatedrivewaystohisproperty,onetohishomeandtheothertotherentalhouse.Theprojecthadrestrictedaccesstotheproperty,havingi.e.,oneshareddrivewayandtheCityserectionofaguardrailhadessentiallyeliminatedanyroadfrontageontheundevelopedportionofhisproperty,whichcouldhavebeenusedasabuildinglot.WenotethatShrum,inarrivingathisopinionofvalue,tookintoaccountthefloodingtestifiedtobytheowner,andhewasfurtheroftheopinionthatthelackofaccesstothevacantlotrendereditnomorethana gardenspotinhiscalculationofvalues. `  WeaffirmtheawardsofdamagesmadebytheTrialCourtand 700 remandwithcostsoftheappealassessedtotheappellant.̛̜ `     h     ________________________ `     h     HerschelP.Franks,J.̜CONCUR:̜___________________________HoustonM.Goddard,P.J.̜___________________________WilliamB.Cain,J.
