àMr.€Dalton€had€a€parole€hearing€on€February€1,€1995.€€The€hearingÏofficer€recommended€œagainst›€parole€because€Mr.€Dalton€had€not€completed€aÏtreatment€program€for€sex€œoffenders.€€The€parole€board€concurred€with€theÏhearing€officerððs€recommended€disposition,€and€Mr.€Dalton€was€informed€onÏFebruary€27,€1995€that€he€would€not€be€paroled€and€that€his€case€would€beÏreviewed€again€in€February€1998.€€One€of€the€concurring€board€membersÍincluded€a€comment€on€the€disposition€form€that€Mr.€Dalton€had€threatenedÏhis€victim€if€she€disclosed€his€behavior.ÌÌà àMr.€Dalton€filed€a€pro€se€petition€for€common„law€writ€of€certiorari€inÏthe€Chancery€Court€for€Davidson€County€on€March€20,€1995.€€He€asserted€thatÏthe€boardððs€decision€to€deny€him€parole€because€he€had€not€completed€aÏtreatment€program€for€sex€offenders€was€inconsistent€with€the€consent€decreeÏin€òòDean€v.€McWherter,óó€No.€1„90„0027€(M.D.€Tenn.€filed€Aug.€18,€1994).€ÏThe€board€moved€to€dismiss€the€petition€on€the€ground€that€it€failed€to€state€aÏclaim€upon€which€relief€could€be€granted€and€supported€its€motion€with€anÏaffidavit€of€its€staff€attorney€as€well€as€a€copy€of€its€record€of€the€dispositionÏof€Mr.€Daltonððs€case.€€The€trial€court€granted€the€boardððs€motion€andÏdismissed€Mr.€Daltonððs€petition.ÌÌà@ ð[s]uccessful€participation€and€completion€of€suchÏtreatment€program€shall€be€a€requirement€of€parole€from€the€correctionalÏinstitutions€by€such€offenders,ðð€Mr.€Dalton€asserts€that€the€board€could€notÏapply€the€statute€to€him€under€the€terms€of€the€federal€consent€decree€in€òòDeanÏv.€McWherteróó.ÌÌà@ àò òA.ó óÌÌà àòòDean€v.€McWherteróó€involved€a€class€action€filed€in€the€United€StatesÏDistrict€Court€for€the€Middle€District€of€Tennessee€on€behalf€of€all€convictedÏsex€offenders€in€the€custody€of€the€Tennessee€Department€of€Correction.€€TheÏinmates€challenged€the€constitutionality€of€Tenn.€Code€Ann.€ðð€33„6„302€(1984)Ïwhich€defined€sexual€offenders€as€ð àThereafter,€on€June€3,€1994,€the€parties€stipulated€that€the€sexual€abuseÏtreatment€program€required€in€Tenn.€Code€Ann.€ðð€41„21„235(a)€had€ð ðnot€beenÏfully€developed€and€instituted€by€the€Tennessee€Department€of€Correction.ðð€ÏTheir€stipulation€also€provided:ÌÓÓÌà8 àà8 àà à2.à àThe€Tennessee€Board€of€Paroles€will€notÏapply€the€provisions€of€Tenn.€Code€Ann.€ðð€41„21„235(b)€until€such€time€that€the€sex€abuse€treatmentÏprogram€is€fully€instituted.ÌÌà8 àà8 àà à3.à àThe€provisions€of€Tenn.€Code€Ann.€ððÏ41„21„235(b)€will€be€applied€only€to€those€sexÏoffenders€who€are€committed€to€the€custody€of€theÏDepartment€of€Correction€after€the€sex€abuseÏtreatment€program€is€instituted.ÌÌà8 àThe€plain€wording€of€the€stipulations€approved€by€the€United€StatesÏDistrict€Court€limits€the€boardððs€ability€to€rely€on€Tenn.€Code€Ann.€ðð€41„21„235(b).€€Under€no€circumstances€can€it€use€an€inmateððs€failure€to€complete€aÏtreatment€program€for€sex€offenders€as€grounds€to€deny€parole€until€it€hasÏfully€developed€and€instituted€the€treatment€program€required€by€Tenn.€CodeÏAnn.€ðð€41„21„235(a).€€Even€after€it€institutes€this€program,€it€can€only€applyÏTenn.€Code€Ann.€ðð€41„21„235(b)€to€inmates€who€were€incarcerated€after€theÏprogram€was€instituted.€€The€boardððs€parole€decisions€with€regard€to€inmatesÏto€whom€Tenn.€Code€Ann.€ðð€41„21„235(b)€does€not€apply€must€be€consistentÏwith€Tenn.€Comp.€R.€&€Regs.€1100„1„1„.06.€€ÌÌÌà àThe€board€did€not€merely€ð ðrecommendðð€that€Mr.€Dalton€participate€in€aÏtreatment€program€for€sex€offenders.€€Its€own€records€and€the€affidavit€of€itsÏstaff€attorney€show€clearly€that€it€declined€to€parole€Mr.€Dalton€because€heÏhad€not€completed€a€treatment€program€for€sex€offenders.€€Thus,€the€boardÏvisited€upon€Mr.€Dalton€the€very€injustice€that€the€United€States€District€CourtÏaddressed€in€òòDean€v.€McWherteróó.€€Since€there€is€no€evidence€that€theÏdepartment€had€fully€implemented€the€treatment€program€by€February€1995,Ïthe€board€imposed€an€impossible€condition€on€Mr.€Daltonððs€parole,€namely€theÏcompletion€of€a€treatment€program€that€did€not€exist.ÌÌà àThe€Department€of€Correction€had€not€instituted€the€treatment€programÏrequired€by€Tenn.€Code€Ann.€ðð€41„21„235(a)€when€Mr.€Dalton€wasÏincarcerated€in€1988.€€Thus,€Mr.€Dalton€is€not€one€of€the€inmates€whoseÍparole€can€be€denied€pursuant€to€Tenn.€Code€Ann.€ðð€41„21„235(b).€€TheÏboard,€therefore,€acted€arbitrarily€and€illegally€when€it€refused€to€abide€by€theÏconsent€decree€in€òòDean€v.€McWherteróó€and€declined€to€parole€Mr.€DaltonÏbecause€he€had€not€completed€a€treatment€program€for€sex€offenders.€ÏAccordingly,€Mr.€Daltonððs€petition€stated€a€cause€of€action€upon€which€reliefÏunder€a€common„law€writ€of€certiorari€could€be€granted,€and€the€board€hasÏfailed€to€demonstrate€that€it€is€entitled€to€a€judgment€of€dismissal€as€a€matterÏof€law.ÌÌà@
