àThe€claim€was€denied€by€the€Board€upon€the€following€findings€of€fact€and€conclusionsÏof€law:ÌÓÓà àà àFINDINGS€OF€FACT:€€Claimantððs€€most€€recent€employment€€prior€€toÌà àà àfiling€this€€claim€€was€€for€€the€VA€€Medical€€Center,€Murfreesboro,€TN€Ìà àà àfrom€€October€€13,€€1989€€until€€February€€8,€1994€when€she€voluntarilyÌà àà àresigned.€€€The€€claimant€€quit€€her€€employment€€because€of€€stress€and€Ìà àà àdepression.€€She€made€doctorððs€appointments€in€Nashville€for€2:00€p.m.Ìà àà àon€two€separate€days.€€The€claimant€and€her€supervisor€disagreed€aboutÌà àà àhow€much€sick€leave€time€the€claimant€could€take€for€the€appointments.à àà àà àThe€Ïclaimant€€wanted€€to€take€all€day€and€the€supervisor€wanted€her€to€Ìà àà àtake€€one„half€€day€€of€sick€leave,€and€if€she€wished€to€be€absent€all€day,€Ìà àà àto€€take€€the€remaining€hours€as€annual€leave.€€This€conformed€with€the€Ìà àà àemployerððs€policy€and€with€normal€practice.€€The€claimant€felt€stressedÌà àà àand€€harassed€€about€this€and€filed€an€EEO€complaint€against€her€super„Ìà àà àvisor€€and€€against€€several€€other€€employees.€€When€she€began€to€give€Ìà àà àinformation€€about€€her€€complaint€€to€the€employerððs€€EEO€officer,€the€Ìà àà àclaimant€€began€sobbing€loudly,€said€that€she€couldnððt€take€it€any€more,€Ìà àà àand€€threw€€herself€€against€€walls€€and€€windows.€€€A€€staff€€psychiatrist€Ìà àà àsedated€her€and€referred€her€to€her€own€psychiatrist€as€soon€as€possible.€€Ìà àà àThe€€claimantððs€€own€€psychiatrist,€€after€consultation€with€the€claimant€Ìà àà àand€€her€€husband€€about€€the€€claimantððs€work,€€health,€€and€€the€family€Ìà àà àfinancial€€condition,€€recommended€€that€€the€claimant€€not€continue€her€Ìà àà àemployment.€€The€psychiatrist€diagnosed€the€claimant€as€suffering€from€Ìà àà àstress€and€depression,€and,€based€on€his€conversations€with€he€claimant,€Ìà àà àsaid€€that€€her€€work€€was€€possibly€a€factor.€€Claimant€then€submitted€a€Ìà àà àresignation.ÌÌÌà àà àCONCLUSIONS€€€OF€€€LAW:€€€After€€€carefully€€considering€€the€entireÌà àà àrecord€in€this€case,€the€Board€of€Review€finds€that€this€claim€for€benefitsÌà àà àshould€be€denied€under€TCA€ðð€50„7„303(a)(1).€We€find€that€the€claimant€Ìà àà àleft€€her€employment€voluntarily€and€without€good€cause€connected€with€Ìà àà àwork.€€She€quit€her€employment€on€the€advice€of€her€psychiatrist€because€Ìà àà àof€€stress€€and€depression.€€While,€as€noted€by€her€psychiatrist,€work€may€Ìà àà àhave€€been€€a€€factor,€€the€€stress€from€work€appears€only€to€have€been€an€Ìà àà àaggravating€€factor€rather€than€the€primary€cause€of€the€claimantððs€condi„Ìà àà àtion.€€€The€€claimant€€was€€very€€upset€because€her€supervisor€would€onlyÌà àà àallow€€her€€one„half€day€of€sick€leave€for€a€doctorððs€€appointment€at€2:00€Ìà àà àp.m.,€€and€€if€€the€claimant€€wanted€€to€€take€€the€entire€day,€was€going€to€Ìà àà àrequire€her€to€take€the€remainder€as€annual€leave.€€In€€our€opinion,€it€wasÌà àà ànot€unreasonable€for€the€supervisor€to€require€the€claimant€to€do€this.€€IfÌà àà àthe€€claimant€€had€€to€€quit€€employment€€because€€of€€such€situations,€the€Ìà àà àproblem€€appears€€to€€have€€been€€more€€within€€the€€claimant€€than€it€was€Ìà àà àconnected€€with€€work.€€We€note€that€the€employer€was€in€the€process€of€Ìà àà àtaking€€information€€from€€the€€claimant€€in€€order€to€investigate€her€com„Ìà àà àplaints€€against€€the€€employer€when€the€claimant€became€so€agitated€that€Ìà àà àshe€required€sedation€and€attention€from€a€psychiatrist.€€This€was€a€good€ÌÓÓà àà àfaith€effort€by€the€employer€to€address€the€claimantððs€concerns.€ÌÌà àThe€memorandum€of€the€Trial€Judge€states:ÌÓÓà àà à€€€€The€€petitioner€€worked€€at€€the€VA€Medical€Center€from€October€13,Ìà àà à1989€€until€€February€€8,€€1994,€€when€she€voluntarily€resigned€upon€herÌà àà àdoctorððs€€advice.€€Ms.€Darden€quit€her€job€due€to€depression€brought€on€Ìà àà àby€job„related€stress.€€ÌÌà àà à€€€€The€petitioner€had€a€history€of€problems€with€her€employer€regardingÌà àà àwhat€she€felt€to€be€harassment€and€discrimination€by€different€employeesÌà àà àat€the€hospital.€€As€the€result€of€an€agreement€with€her€employer€regard„Ìà àà àing€€€the€€€prior€€€problems,€€€Ms.€€€Darden€€was€€assigned€€to€€a€€different€Ìà àà àdepartment,€the€library,€with€a€new€supervisor.ÌÌà àà à€€€€At€€about€€the€€same€€time€€that€€she€€was€€transferred,€the€petitionerððs€Ìà àà àdoctor€€notified€€Ms.€€Darden€€that€€she€€was€€suffering€from€€depression€Ìà àà àresulting€€€from€€€job„related€€€stress.€€€Her€€€doctor€€€prescribed€€an€€anti„Ìà àà àdepressant€€€medicine€€€and€€€scheduled€€an€€appointment€€for€€psychiatric€Ìà àà àcounseling.ÌÌà àà à€€€€She€€and€€her€new€supervisor€then€had€a€dispute€about€how€much€sick€Ìà àà àtime€€she€€could€€take€€on€€the€days€she€had€doctorððs€appointments.€They€Ìà àà àhad€€several€€disagreements€about€this,€and€Ms.€Darden€testified€that€she€Ìà àà àfelt€€her€€supervisor€€refused€€to€€let€€her€€keep€€her€€appointments€on€two€Ìà àà àoccasions.ÌÌà àà à€€€€The€petitioner€had€notified€her€EEO€officer€about€her€problem€gettingÌà àà àtime€€off€€for€€doctorððs€€appointments€€and€€she€€met€€with€the€€officer€on€Ìà àà àJanuary€€27,€€1994.€€€About€€ten€minutes€into€this€meeting,€the€petitioner€Ìà àà àhad€€a€€so„called€€ð ðnervous€€breakdown,ðð€€hammering€€the€€windowpanes€Ìà àà àwith€€her€€hands€€and€€slamming€€herself€into€the€walls,€shrieking€ð ðI€canððt€Ìà àà àtake€€it€€anymoreðð€€and€sobbing€loudly.€€An€emergency€medical€alert€wasÌà àà àcalled€€and€€a€staff€€psychiatrist€€at€€the€Medical€Center€gave€Ms.€Darden€Ìà àà àmedication€to€calm€her.€€Her€husband€then€took€her€home.ÌÌà àà à€€€The€petitioner€saw€her€own€doctor€on€January€28€and€he€diagnosedÌà àà àthat€€she€€suffered€from€manic„depressive€syndrome.€€He€advised€that€Ìà àà àher€breakdown€and€prior€illness€were€job„related€and€that€she€needed€Ìà àà àto€€leave€€her€€job€to€recover.€€The€petitioner€then€faxed€a€resignation€Ìà àà àletter€to€her€supervisor€on€February€8,€1994.ÌÌà àà à€€€€Since€Ms.€Darden€did€voluntarily€resign,€the€only€issue€in€this€caseÌà àà àis€€whether€€the€€petitioner€€quit€her€job€for€ð ðgood€cause€connected€toÌà àà àwork.ðð€€€Tenn.€Code€€Ann.€€ðð€50„7„303(a)(1).€€Since€€the€term€ð ðgood€Ìà àà àcause€€connected€€to€€workðð€€is€€nowhere€€defined€€in€€the€statute,€the€Ìà àà àCourt€€must€€look€to€case€law€to€determine€its€meaning.€€In€òòCawthronÌà àà àv.€€Scottóó,€€€400€S.W.2d€€240€€(Tenn.€1966),€€the€€Tennessee€€SupremeÌà àà àCourt€€interpreted€€€ð ðgood€€cause€€connected€€to€€workðð€in€a€situation€Ìà àà àsuch€as€this€to€mean,€ð ðthat€the€connection€with€the€employment€must€Ìà àà àbe€one€of€cause€and€effect€in€cases€of€illness€and€disability.€€That€is€to€Ìà àà àsay,€a€causal€connection€between€the€employment€and€the€illness€...€is€Ìà àà àrequired.ðð€€€Supreme€Court€held€that€a€woman€who€had€a€preexistingÌà àà àbronchial€condition€which€was€aggravated€by€air„conditioning€at€work€Ìà àà àwas€not€entitled€to€unemployment€benefits.€The€petitioner€in€that€case,€Ìà àà àlike€€Ms.€€Darden,€quit€her€job€on€the€advice€of€her€doctor.€€The€Court€Ìà àà àin€€Cooper€€specifically€found€that,€ð ð[t]he€fact€that€the€air„conditioning€Ìà àà àin€€her€€office€€aggravated€€the€€preexisting€bronchial€condition€is€not€a€Ìà àà àcause€which€can€be€laid€to€her€employment.€€429€S.W.2d€at€427.ÌÌà àà à€€€€This€€Courtððs€€€review€€€is€€limited€€to€€the€€record€€and€€the€€Boardððs€Ìà àà àdecision€€may€€not€be€reversed€if€it€is€supported€ð ðby€evidence€€which€is€Ìà àà àboth€substantial€and€material€in€light€of€the€entire€record.ðð€Tenn.€Code€Ìà àà àAnn.€ðð€50„7„304(I)(2)(E)€(1995€Supp.).€€However,€€the€determinationÌà àà àof€€whether€€the€employee€left€their€employment€òòwithóó€or€òòwithout€óógoodÌà àà àcause€is€a€question€of€law.€€òòCooperóó€at€426.ÌÌà àà à€€€€Unfortunately€€for€the€petitioner,€her€situation€is€almost€identical€toÌà àà àthat€€in€€the€òò€Cooper€óó€case.€€The€petitioner€suffered€from€a€preexisting€Ìà àà àillness,€€manic„depressive€€syndrome,€which€€was€aggravated€by€stress€Ìà àà àat€€work.€€There€€is€€no€evidence€in€the€record€that€the€petitionerððs€jobÌà àà àòòcausedóó€the€manic„depressive€syndrome.€Therefore,€she€does€not€meet€Ìà àà àthe€€test€set€out€in€òòCawthronóó€and€òòCooperóó€to€come€within€the€meaning€Ìà àà àof€€ð ðgood€cause€connected€to€work.ðð€€€ÌÌÓÓà àà à€€€€For€this€reason,€the€decision€of€the€Board€must€be€affirmed.ÌÌà àOn€appeal,€petitioner€presents€the€following€issue:ÌÓÓà àà à€€€€Did€€the€€Court€€err€€in€€its€finding€€that€€the€€Petitioner€voluntarilyÌÓÓà àà àleft€her€employment€without€good€cause.Ìà àÌà àThe€above€quotations€indicate€that€both€the€Board€and€the€Trial€Court€found€against€theÏpetitioner€because€a€preexisting€condition€(manic€depression)€was€aggravated€by€job€stress.€ÏPetitionerððs€physician€did€indicate€underlying€manic€depression,€but€did€not€indicate€that€itsÏorigin€predated€petitionerððs€employment€which€began€in€1989.ÌÌà àThe€applicable€statute,€TCA€ðð€50„7„303(a)(1)€reads€as€follows:ÌÓÓò òà àà à€€€€Disqualification€€€for€€€benefitsó ó,€€„€€(a)€€€Disqualifying€€Events.€€AÌà àà àclaimant€shall€be€disqualified€for€benefits.ÌÌà àà à€€€€(1)€€If€€€the€€commissioner€€finds€€€that€€€the€€claimant€€has€€left€such€Ìà àà àclaimantððs€€€most€€€recent€€€work€€€voluntarily€€€€without€€€good€€€cause€Ìà àà àconnected€€with€€such€€claimantððs€€work.€€€Such€€disqualification€€shall€Ìà àà àbe€€for€€the€€duration€of€the€ensuing€period€of€unemployment€and€until€Ìà àà àsuch€€claimant€€has€€secured€€subsequent€€employment€€covered€€by€an€Ìà àà àunemployment€€compensation€€€law€€of€€this€€state,€or€another€state,€or€Ìà àà àof€€€the€€United€€States,€€and€€was€€paid€€wages€€thereby€ten€(10)€timesÌà àà àsuch€€claimantððs€€weekly€€benefit€amount.€€No€disqualification€shall€beÌà àà àmade€€€hereunder,€€€however,€€€if€€€such€€€claimant€€€presents€€evidence€Ìà àà àsupported€€by€competent€medical€proof€that€such€claimant€was€forced€Ìà àà àto€leave€such€claimantððs€most€recent€work€because€such€claimant€was€Ìà àà àsick€€or€€disabled€and€notified€such€claimantððs€employer€of€that€fact€asÌà àà àsoon€€as€€it€€was€€reasonably€€practical€€to€€do€€so,€òòand€returned€to€that€Ìà àà àemployer€and€offered€to€work€as€soon€as€such€claimant€was€again€ableÌÓÓÓÓà àà àto€€work,€€and€€to€€perform€€such€claimantððs€former€dutiesóó.€€(EmphasisÌà àà àsupplied)ÌÓÓÌà àIt€appears€that€the€focal€issue€before€the€administrative€agency€and€the€Trial€Court€wasÏwhether€the€employee€ð ðleft€claimantððs€most€recent€work€„„€without€good€cause€connected€withÏclaimantððs€work.ðð€€Petitioner€insisted,€and€insists€to€this€Court,€that€she€left€work€involuntarilyÏbecause€of€good€cause€connected€with€her€work,€i.e.€ð ðjob€stress.ðð€€The€employer€insisted€andÏnow€insists€that€the€underlying€cause€was€manic€depressive€syndrome€not€connected€with€theÏemployees€work€and€the€ð ðjob€stressðð€was€merely€an€aggravating€factor.ÌÌà àIt€appears€that€neither€the€Board€nor€the€Trial€Court€considered€the€portion€of€the€quotedÏstatute€which€delays€entitlement€to€benefits€until€the€sick€or€disabled€employee€has€recoveredÏand€applied€for€reinstatement.ÌÌà àòòCawthon€v.€Scott,óó€217€Tenn.€668,€400€S.W.2d€240€(1965)€involved€two€ladies€whoseÏclaims€were€consolidated€and€determined€together.€€One€resigned€because,€after€gall€bladderÏsurgery,€she€was€unable€to€sleep€because€of€the€hours€of€her€employment.€€The€other€resignedÏbecause€an€injury€suffered€off€the€job€caused€her€work€to€be€painful.€€The€Supreme€CourtÏaffirmed€the€denial€of€unemployment€benefits€and€said:ÌÓÓà àà à€€€€The€disqualifying€provision€of€€the€statute€under€considerationÌà àà àis€€that€€a€€claimant€€will€€be€eligible€€for€unemployment€insurance€Ìà àà àunless,€€ð ðhe€€has€€left€€his€€most€€recent€€work€voluntarily€withoutÌà àà àcause€€connected€€with€€his€€work.ðð€€€We€€think€it€is€reasonable€to€Ìà àà àsay€this€means€that€the€connection€with€employment€must€be€one€Ìà àà àof€cause€and€effect€in€cases€of€illness€or€disability.€€That€is€to€say,€Ìà àà àa€€causal€€connection€€between€the€employment€€and€the€illness€or€Ìà àà àdisability€is€required.ÌÌà àà à€€€€In€€the€€records€€under€€consideration€€there€€is€€no€€connection€Ìà àà àshown€between€€the€illness€or€disability€of€the€claimants€and€their€Ìà àà àwork.€€Mrs.€Cawthon€€underwent€a€gall€bladder€operation.€€Prior€Ìà àà àto€€and€€after€€the€€operation€she€was€nervous€and€unable€to€sleep€Ìà àà àduring€€the€€day.€€€Petitioner€Mrs.€West,€suffered€the€injury€to€her€ÌÓÓà àà àwrist€while€off€from€work.ÌÌà àIn€œòòThach›€v.€Scottóó,€219€Tenn.€390,€410€S.W.2d€173€(1966),€a€mechanic€wasÏdischarged€because€he€was€unable€to€do€part€of€his€work€due€to€a€congenital€double„curvatureÏof€the€spine.€€The€Supreme€Court€upheld€the€denial€of€unemployment€benefits.ÌÌà àIn€òòGuffey€v.€Scottóó,€217€Tenn.€707,€400€S.W.2d€705,€(1966),€claimant€was€terminatedÏbecause€of€her€pregnancy.€€The€Supreme€Court€affirmed€the€denial€of€unemployment€benefits.ÌÌà
