àFrom€January€2,€1991€through€September€of€1994,€the€Plaintiff€was€employedÍas€a€tax€assessor€in€the€office€of€the€Defendant,€Bob€Patterson.€The€building€at€whichÏthe€Plaintiff€worked€was€owned€by€Venture.€ÌÌà àDuring€his€employment€with€the€Defendant€Patterson,€the€Plaintiff€experiencedÏvarious€health€problems€including€coughing,€irritation€of€the€skin,€itching€and€otherÏrelated€illnesses.€The€Plaintiff€compiled€a€diary€describing€the€health€problems€that€heÏexperienced.€€In€his€diary,€the€Plaintiff€stated€as€follows:€Ìœ›ÓÓà8 àà8 à[m]y€employment€began€in€the€Trusteeððs€Office€on€JanuaryÏ2,€1991.€€During€the€spring€of€1991,€under€theÏadministration€of€Bob€Patterson,€there€was€[sic]€variousÏconstruction€projects€in€the€office€which€entailed€extensiveÏrenovations€of€the€Delinquent€Tax€Department,€of€which€IÏwork.€€During€this€renovation€period,€I€began€experiencingÏcoughing,€irritation€of€the€skin,€itching€and€other€relatedÏillnesses.ÌÌà8 àà8 àI€began€to€notice€my€surroundings€and€realized€that€fibrousÏmaterials€were€blowing€out€of€the€ceiling€where€repairsÏwere€being€made€and€where€a€new€wall€was€beingÏconstructed.€€When€I€brought€to€the€attention€of€theÏconstruction€crew,€that€material€was€falling€from€the€ceilingÏand€blowing€over€the€office,€they€immediately€draped€plasticÏaround€the€specific€area€where€they€were€working€in€anÏattempt€to€contain€it.€€When€the€work€was€finished,€theyÏfailed€to€correct€the€problem€with€this€material,€now€blowingÏfrom€the€vents.ÌÌà8 àà8 àI€first€saw€my€doctor€during€this€same€time€period€on€May€3,Ï1991,€and€was€diagnosed€as€having€an€upper€respiratoryÏinfection€which€was€repeatedly€brought€on€because€I€wasÏcontinuously€breathing€in€this€substance.ÌÌà8 àà8 àò òIt€was€not€until€November€13,€1992€that€I€realizedÏthat€my€illness€was€caused€by€a€substance€withinÏmy€place€of€employment.€€ó óI€had€recurrences€onÏNovember€26,€1991,€November€2,€1992,€November€18,Ï1992,€March€1,€1993,€March€3,€1993,€March€18,€1993€andÍApril€26,€1993.€€(emphasis€added)€ÌÌÌÌÓÓà àOn€November€13,€1992,€the€Plaintiff€stated€in€his€diary€that€he€spoke€with€hisÏemployer€ð ðconcerning€fibers€of€insulation€that€ha[d]€been€blowing€out€of€AC€[sic]€ventsÏfor€months€since€renovation€of€office.ðð€€€On€November€16,€1992,€the€Plaintiff€noted€inÏhis€diary€that€he€made€a€visit€to€the€employee€health€clinic€and€informed€the€doctor€ofÏthe€ð ðfiberglass€insulation€exposure€in€Trustees€Office.ðð€€The€Plaintiff€further€stated€in€hisÏdiary€that€he€returned€to€work€on€November€16,€1992€and€was€ð ð[a]dvised€to€contact€aÏpersonal€doctor.ðð€€Ìà àOn€November€18,€1992,€the€Plaintiff€visited€his€primary€physician,€Dr.€Joseph€E.ÏAllen.€€The€Plaintiff€showed€Dr.€Allen€samples€of€the€fibrous€pollutants€which€came€outÏof€the€vents€in€the€Plaintiffððs€office.€€Dr.€Allen€advised€the€Plaintiff€that€exposure€toÏfiberglass€insulation€ð ðcan€cause€serious€health€problems.ðð€€€Dr.€Allen€further€advisedÏthe€Plaintiff€that€breathing€such€contaminants€would€cause€respiratory€problems.€€ÌÌà àOn€February€16,€1993,€the€Plaintiff€informed€his€employer€of€the€ð ðcontinuingÏproblems€with€insulation€blowing€out€of€air€conditioning€vent.ðð€€€On€February€17,€1993,Ïthe€Plaintiff€contacted€the€Occupational€Safety€and€Health€Administration€regardingÏthe€contaminants€that€the€Plaintiff€was€breathing€at€work.€€The€Plaintiff€also€informedÏInterstate€Realty€Company,€the€management€company€for€€Venture,€of€the€problemsÏthat€the€Plaintiff€was€experiencing.€ÌÌà àDr.€Allen€wrote€the€Plaintiff€a€letter€dated€March€3,€1993€stating€that€the€PlaintiffððsÍð ðexposure€needs€to€be€eliminated.ðð€ÌÌà àAt€some€point€prior€to€December€20,€1993,€the€Plaintiff€consulted€an€attorney,ÏJack€V.€Delany,€about€a€potential€workerððs€compensation€claim€against€the€DefendantÏPatterson.€€In€a€letter€dated€December€20,€1993,€Delany€informed€the€Plaintiff€of€theÏone€year€statute€of€limitations€for€personal€injury€actions.€In€his€letter€to€the€Plaintiff,€Mr.ÏDelany€stated:€€ð ð[s]ince€Dr.€Allen€first€went€on€record€as€diagnosing€you€as€sufferingÏfrom€occupational€lung€disease€on€March€3,€1993,€you€have€until€March€2,€1994€toÏpursue€this€matter€further.ðð€ÌÌà àThe€Plaintiff€filed€his€complaint€on€August€25,€1994.ÌÌà@ àò òLAWó óÌÌà àThe€issue€before€this€Court€is€whether€the€one€year€statute€of€limitations€forÏpersonal€injury€actions€bars€the€Plaintiffsðð€cause€of€action.€€€The€Plaintiffs€argue€thatÏtheir€cause€of€action€did€not€accrue€until€August€25,€1993€when€the€PlaintiffððsÏpulmonary€specialist,€Dr.€William€Potter,€confirmed€the€initial€diagnosis€of€the€PlaintiffððsÏprimary€physician,€Dr.€Allen,€and€informed€the€Plaintiff€that€he€was€suffering€from€anÏoccupational€lung€disease.€€ÌÌà
