LauraDavisappealsthatportionofadivorcedecreewhichawardedcustodyofKristin(minorchildoftheparties,whowasjustoverthreeandahalfyearsoldatthetimeoftheinitialhearingbelow)toherfather,JohnnyDouglasDavis.ShealsocontendstheTrialCourtwasinerror"infailingtodeletefromthefinaljudgmentthoseprovisionsaddedbyhusband'scounselbutnotorderedbytheJudge."WenoteinthisconnectionthatthejudgmentwaspreparedandsignedbycounselforMr.DavisandwasnotapprovedbycounselforMs.Davis,andneversubmittedtoher. o     Mr.DavisalsoappealstheTrialCourt'sorderinasubsequentproceeding,whichdeniedhisapplicationforaninjunctiontoprohibitunsupervisedvisitationbyMs.DaviswithKristin.  AmotiontomodifythefinaldivorcejudgmentwasfiledbyMs.DavisonDecember22,1994,andthereafter,byorderenteredApril18,1995.ChancellorInman,onhisownmotion,transferredthecase"totheHonorableWilliamJenkins,asJudgebyInterchange."JudgeJenkinsultimatelyruledonthemotiontomodify,aswellasthepetitionseekinganinjunction.  Astotheissueofcustody,weconcludethisisanappropriatecaseforaffirmanceunderRule10(a)ofthisCourt.  Inreachingourconclusionweareaware,asinsistedbyMs.Davis,thattheTrialCourtmayhavemisstatedthedatescertaininappropriateactionsbyMs.Davistowardthechildoccurred,andalsothattestimonywaseliciteduponcrossexaminationfromwitnessestestifyingtoMs.Davis'inappropriateaction,whichwouldtendtodiscredittheirtestimony,viz.,failuretoadviseMr.DavisofMs.Davis'conductpriortothedivorcesuitbeingfiled.However,itisclearfromtheChancellor'smemorandumopinionthatheaccreditedMr.Davisandtheotherwitnessesrelativetoherinappropriateconductwhenhestatedthefollowing:        Thevariouswitnesseswhotestifiedtotheseincidentswereallpersuasiveandallmanifestedagenuineconcernforthewelfareofthisthreeyearoldchild.         GiventhepresumptionofcorrectnessastofactualfindingsoftheTrialCourtmandatedbyRule13oftheTennesseeRulesofAppellateProcedure,andthedeferencetheappellatecourtsaccordtrialcourtsinevaluatingthecredibilityofwitnesses,wefindthattheevidencedoesnotpreponderateagainsthisawardofcustody.    AstoMs.Davis'secondissue,shecomplainsthattheTrialCourt'smemorandumopiniondidnotmakeaspecificdeterminationastovisitationand,consequently,thedetailedvisitationsetoutinthedecree(seeappendix)waserroneouslypreparedbyMr.Davis'counsel.  TheChancellor'smemorandumopiniondoesprovidethefollowing:         IV.VISITATION  Wifeshouldhavethestandardvisitationscheduleofthiscourt,withwhichcounselshouldbeintimatelyfamiliar.Thatscheduleshouldbeinsertedintothejudgmentwithspecificity.         TheChancellorobviouslyhadastandardvisitationschedulewhichheemployed, p   ׀eventhoughitisapparentlytrue,asMs.Davis'counselpointsout,itisnotapartofthelocalrules.  Inanyevent,theTrialCourt,bysigningthedecreeasprepared,notwithstandingthefactitwasnotsubmittedtocounselforMs.Davis,clearlyshowsthatthiswasthevisitationscheduleheenvisioned,andhisfailuretoplaceitinhismemorandumopiniondoesnotimpairitsvalidity.  Subsequenttothedivorcedecreebeingentered,Mr.DavisfiledapetitionseekingtoenjoinMs.DavisfromhavingunsupervisedvisitationwiththechildbecausethechildhadsufferedadogbitefromMs.Davis'dogwhilevisitingher,andalsobecauseMr.DavisbelievedMs.Davis,whoisaregisterednurse,hadbeenunnecessarilyadministeringshotstothechild.  TheTrialCourtgrantedaninjunctiontopreventthechildfrombeinginthepresenceofMs.Davis'dogwhilevisiting,butdeniedMr.Davisanyfurtherrelief.TheproofastotheadministeringofshotstoKristinconsistedoftestimonyofwitnessesquotingKristinandthedenialofMs.Davis.  BecausetheevidencedoesnotpreponderateagainsttheTrialJudge'sfindingoffactrelativetothisissue,weconcurinhisdenialofaninjunctiontoprecludeunsupervisedvisitation.  Inconclusion,wepointoutthatifinfactthereisaproblemwithvisitation,transportationorotherwise,Ms.DavisisatlibertytofileapetitionintheTrialCourtseekingappropriaterelief.
