PetitionerisaninmateoftheTennesseeDepartmentofCorrections.TheBoardconductedaparolehearingforPetitioneron4October1994.ThehearingofficerdidnotrecommendPetitionerforparoleforthefollowingreasons:1)theseriousnessofhisoffense;2)heconstitutedahighriskforreoffendingifreleased;and3)heshouldcompletethesexoffenderprogram.TheBoardacceptedthisrecommendationandsentafinalparolehearingdispositionnoticetoPetitioneron15November1996. PetitionerthensoughtadeclaratoryorderfromtheBoard. .   ׀AstaffattorneyfortheBoardrespondedtoPetitionersrequestbyletterdated2April1996.TheresponsecharacterizedthecontentsoftheresponseasananswertoPetitionersrevisedPetitionandconsistedofalistofciteswithnoexplanation. Petitionerfiledhispetitionforwritofcertiorarion29April1996.ThegravamenofthepetitionwastheBoarddeniedPetitionerparolebaseduponthefacthehadnotcompletedasexoffenderprogram.PetitionerinsistedthisviolatedastipulationenteredintobytheBoardin Deanv.McWherter ,No.1:900027(M.D.Tenn.3June1994).Petitionercontendedhewasentitledtojudicialreviewundersection45322oftheUniformAdministrativeProceduresAct( UAPA) /   כandhewasentitledtoadeclaratoryjudgment. 0   כHeclaimedtheresponsefromthestaffattorneyconstitutedafinalorderforthepurposesofsection45322andadeclaratoryorderforthepurposesofsection45224.Finally,PetitionerrequestedacommonlawwritofcertiorariclaimingtheBoardactedillegallyandarbitrarily. TheBoardmovedtodismissthepetitionforlackofsubjectmatterjurisdiction.Thechancerycourtmadethefollowingfindings:1)thecourtlackedjurisdictionundertheUAPAbecauseTennesseeCodeAnnotatedsection45106(c)exemptstheBoardfromthejudicialreviewprovisionsoftheUAPA 1   ;2)PetitionersfailuretofilewithinsixtydaysoftheBoardsdecisiontodenyhimparoleprecludedanyreviewunderacommonlawwritofcertioraripursuanttoTennesseeCodeAnnotatedsection279102;3)theresponseofthestaffattorneywasneitheradeclaratoryordernorafinalorderoftheBoard;and4)thedeclaratoryorderprovisionsoftheUAPAdonotapplytotheBoardpursuanttoTennesseeCodeAnnotatedsection45106(c).Thereafter,Petitionerfiledanoticeofappealandpresentedthefollowingissues:&` ` xX&8 I. Whetherthechancerycourterredindismissingthepetitionforreviewbecauseitwasnottimelyfiled.8 II. Whethertheboardofparolesactedillegally,arbitrarilyandabuseditsdiscretionindenyingtheparoleoftheappellantbased,atleastinpart,onthefactthathehadnotcompletedasexoffenderabusetreatmentprogramwhen,infact,heenteredthedepartmentofcorrectionbeforesaidprogramwasinstitutedandwhethersuchdenialwasinviolationofthestatesownstipulationenteredbyitintheUnitedStatesDistrictCourtfortheMiddleDistrictofTennessee. PetitionerconcededinhisbriefthatthedeclaratoryjudgmentandjudicialreviewprovisionsoftheUAPAdonotapplytotheBoard.Nevertheless,hearguedtheresponsefromthestaffattorneywasadeclaratoryjudgmentandwastheBoardsfinalorderfromwhichthesixtydayfilingdeadlineforcommonlawwritsofcertioraribegantorun. Commonlawcertiorariisavailablewherethecourtreviewsanadministrativedecisioninwhichanagencyisactinginajudicialorquasijudicialcapacity. Davisonv.Carr ,659S.W.2d361,363(Tenn.1983).Thescopeofreviewunderacommonlawwritofcertiorariislimitedtotherecordandtoadeterminationofwhetherthereisanymaterialevidencetosupporttheagencysfindingsorwhethertheadministrativebodyhasexceededitsjurisdictionoractedillegallyorarbitrarily. Id.;Spuntv.Folwinkle ,572S.W.2d259,265(Tenn.App.1978). CourtsmayreviewanorderoftheBoardpursuanttoacommonlawwritofcertiorari. Thandiwev.Traughber ,909S.W.2d802,803(Tenn.App.1994).Apartyseekingreviewmustfileapetitionforawritofcertiorariwithinsixtydaysoftheentryoftheorderatissue. Id. ;Tenn.CodeAnn.279102(1980&Supp.1996).Thisrequirementisjurisdictional. Thandiwe ,909S.W.2dat804. ThefailuretofilewithinthestatutorytimelimitsresultsintheBoardsdecisionbecomingfinal,andoncethedecisionhasbecomefinal,theChanceryCourtisdeprivedofjurisdiction. Id.  Thechancerycourtfound: ThedecisionoftheBoardofParoleswasrenderedonOctober18,1995andbecamefinalonDecember18,1995.Therefore,thepetitionfiledonApril29,1996wasnottimelyfiled.AllowingPetitionereveryconceivablebenefitofthedoubt,itisapparentthecriticaldateisdeterminedbythedocumentwithwhichPetitionertakesissue,thefinalparolehearingdisposition.TheBoardinsiststhefinalparolehearingdispositionwhichisstamped15November1995isthefinalorderorjudgment.Weagree.Thus,thedatefordeterminingwhetherPetitionerswritofcertiorariwastimelyfiledwouldbe15January1996,sixtydaysbeyondthedateofthefinalparolehearingdisposition.Thepetitionwasnotfileduntil29April1996.Therefore,thechancellorcorrectlydeterminedthepetitionwasnottimelyfiledandproperlydismissedthepetitiononthebasisthatthecourtlackedjurisdiction. WecannotagreewithPetitionerscontentionthatthesixtydaysdidnotbegintorununtil2April1996,thedateoftheresponsefromthestaffattorney.Itisclearthattheresponseisneitheradeclaratorynorafinalorder.Theresponseisnotdesignatedasadeclaratoryorderdespitethefactthatadeclaratoryorderiswhatpetitionerwasrequesting.Moreover,theresponsewasonlysignedbyamemberofthelegalstaff.ItwasnotsignedbyanyoftheBoardsmembers.Finally,itisclearfromtheletterthatthestaffattorneywassimplyaddressingPetitionersconcernsasexpressedinhisrequestforadeclaratoryjudgment.ThisletterdoesnotconstituteanytypeoforderorjudgmentoftheBoard.
