Ligonv.Ligon, 597S.W.2d310,310(Tenn.App.1979)(quoting Ligonv.Ligon ,556S.W.2d763,768(Tenn.App.1977)).Theissueofwhethertoawardattorney'sfeeswhenthewifeisfinanciallyunabletoprocurecounselisamatterthatiswithinthediscretionofthetrialcourt. Therecordbeforeusdoesnotestablishthatwifewasfinanciallyunabletoprocurecounsel.Thus,itwouldhavebeenappropriateforthecourttonotawardattorney'sfees.Thatissueisnotbeforeusonappeal.Wethereforeaffirm. Therefore,itresultsthatthejudgmentofthetrialcourtisinallthingsaffirmed,andthecauseisremandedtothetrialcourtforanyfurthernecessaryproceedings.Costsonappealaretaxedtothepetitioner/appellant.
