DaisyMynattappealstheKnoxCountyChanceryCourt'sdismissalofherpetitionregardingtheConservatorshipofherdeceasedfather,DoyleThomasDotson.Ms.MynattcontendsthattheTrialCourterredinitsdenialofherpetitionfortheremovalofhersisterMarieDotsonIsomastheConservatorofMr.Dotson'sEstate.Ms.MynattadditionallycontendsthattheTrialCourterredinitsdenialofherpetitionforattorneyfees,forthelaborsofherattorney,JosephYancey,inthehandlingofmattersoftheConservatorship.  OnematterMs.Isom'smotiontodismissthisappealneedstobeaddressedattheoutset.Themotioncontendsthenoticeofappealwaspremature.Ourexaminationoftherecordpersuadesusthatthemotionisnotwelltakenanditisaccordinglydenied.̜  ThiscaseoriginatedonMay16,1988,whenMs.IsomfiledapetitiontobeappointedtheConservatorofherfather,DoyleThomasDotson.Ms.MynattstatedinheranswertothepetitionthatshehadnoobjectiontotheappointmentofhersisterasConservator.TheKnoxCountyChanceryCourtgrantedMs.Isom'spetitionandappointedherasConservatorofMr.Doyle'sEstateonJune21,1988.  Mr.DoylediedonJanuary24,1989,andthewillwasprobatedonFebruary15,1989.OnamotionbyMs.IsomforcourtapprovaloffinalaccountingandclosureoftheEstate,theChanceryCourtenteredanorderofreference,referringthecasetoaSpecialMastertoholdahearingontheissuesoftheclosing.  TheMasterheldahearingonJuly11,1989,andmadeanumberoffindingsoffactandlaw.TheMastermadethreefindingsthatarerelevanttothisappeal,whicharesummarizedasfollows:       (1)Ms.Mynatthadfiledaclaimfor$15,000inpaymentincompensationforbeingtheConservatoroftheEstate.TheMasterawardedheranetamountof$7,172forherservices.(2)Mr.Dotsonhadonhisperson$75,000incashatthetimeofhisdemise,whichMs.Isomhadwithdrawnfromthebankforhim.ThiscausedtheEstatelossesduetothelostinterest.(3)Asamatteroflaw,Ms.IsomwasrequiredtoreturntotheEstateasumof$6,664thatshehadtakenfromtheEstate.         Oneachoftheseissues,Mr.YanceyrepresentedMs.Mynatt.TheMasterdeferredtheissueofattorneyfeesuntilalaterdate.  Subsequently,onMay2,1990,StanleyIsom,Ms.Isom'shusband,filedaclaimagainsttheConservatorforatotalamountof$10,120forrenttocoverthetimewhichMr.DotsonlivedwithMr.andMs.Isom.Ms.Isom,theConservator,optednottofileanexceptiontothismotion.Ms.Mynatt,however,throughherattorneyMr.Yancey,filedanexceptiontothemotiononthegroundthatMs.IsomhadalreadybeencompensatedforthecareofMr.Dotsoninherhome.ThisrequestedcompensationwasdisallowedbytheMasterafteraJanuary1991hearingandsubsequentreport.  OnAugust2,1991,CharlesLockett,Ms.Isom'sattorney,filedaclaimforattorneyfeesandexpensesintheamountof$16,064.35forhisrepresentationofMs.IsomasConservator.Uponmotionoftheparties,theKnoxCountyChanceryCourt,onFebruary4,1992,referredtotheClerkandMastertwoissuestoberesolvedinthiscase:1.AttorneyfeesallowabletoCharlesD.Lockett?2.AttorneyfeesallowabletoJosephB.Yancey?  TheMasterheldahearingontheseissuesonDecember1,1991,andonMarch30,1992.Mr.YanceyrepresentedMs.Mynattintheproceedings.  TheMasterfiledhisreportonJune12,1992.Inhisreport,theMasteraddressedtheissuesofthetwoattorneys'fees.TheMasterawardedapaymentof$3,582.50tobepaidtoMr.LockettbytheEstateandConservatorshipofMr.Dotson,withtheremainderofthesefeesbeingpaidbyMs.Isom.TheMasterstated,however,concerningtheattorneyfeesofMr.Yancey,that,"Mr.Yanceypresentednopetitionforfeesoranyproofastowhathisfeewouldbe."TheMasterconcludedthatbecauseMr.Yanceypresentednoproofontheissueofhisattorneyfees,heshouldnotbeawardedanyfees.  Ms.MynattfiledexceptionstotheMaster'sreportonAugust3,1992,nearlytwomonthsafterthefilingofthereport.Themattersshequestionsinherexceptions,however,arenotraisedonappeal.OnOctober14,1994,Mr.YanceyfiledaclaimforattorneyfeesbasedonhisworkonbehalfoftheConservatorship,whichhasbeenpreviouslydescribed.  OnMay3,1996,Ms.MynattfiledapetitionforremovalofMs.IsomasConservatorofMr.Dotson'sEstate,pursuanttoT.C.A.3413108.ShearguedthattheremovalofMs.IsomasConservatorwouldbeinthebestinterestoftheEstate. l   ׀Ms.MynattadditionallyarguedthatitwouldbeinthebestinterestoftheEstatetoawardherattorneyfeesfortheworkofherattorney,Mr.Yancey.  Afterahearing,theKnoxCountyChanceryCourtenteredanorderonNovember14,1996,andorderedtheConservatortoclosetheConservatorshipEstate.TheChanceryCourtadoptedtheMaster'sreportintotoandoverruledMs.Mynatt'sexceptions.TheChancellorheldthatthepetitiontoremovetheConservatorwasdenied"inasmuchasthematterstobeconcluded,otherthanproperlyclosingtheconservatorship,areintheestate." m   ׀TheChancelloralsodeniedMs.Mynatt'spetitionforattorneyfeesfortworeasons:       1)thegrantingofthefeehasalreadybeenaddressed,and2)thepetitiontoremovetheConservatorhasbeendeniedthusnotgivingrisetotheotherreliefprovisionsinT.C.A.3413[108][sic](d)(5).       Ms.MynattappealsthisorderandopinionoftheChancellor.  ThefirstissuethatMs.MynattraisesonappealisthattheChancellorerredindenyingherpetitiontoremoveMs.IsomasConservatorofMr.Dotson'sEstate.Ms.MynattreliesonthelanguageinT.C.A.3413108(a)whichstates,"[a]conservatorappointedunderthischaptermaybedischargedorhaveitsdutiesmodifiedifthecourtdeterminesthat...itisinthebestinterestofthedisabledpersonthattheconservatorshipbeterminated."  SinceMr.DotsonwasalreadydeadatthetimeMs.MynattfiledherpetitiontohaveMs.IsomremovedasConservator,thepetitionisuntimelyandirrelevant,sincethedeathofthewardterminatedtheConservatorship.T.C.A.3413108(e)states,"[w]henthedisabledpersondies...theconservatorshipshallterminate."Therefore,sinceshefiledthepetitiononMay3,1996,andMr.Dotsondiedin1989,thepetitionwasuntimely.IfMs.MynatthaddesiredtoremoveMs.IsomasConservator,sheshouldhavefiledthepetitionwhileMr.Dotsonwasstillalive.WeconcludethattheChancellorwascorrectindenyingherpetitionandinrulingthattheonlyunfinisheditemintheConservatorshipproceedingwasitsclosing.  ThesecondissuethatMs.MynattraisesisthattheChancellorerredsincehefailedtofileafindingoffactinconjunctionwiththehearingonthepetitionfortheremovaloftheConservator.ShereliesonT.C.A.3413108(d),whichstatesthat"[u]ponconclusionofthehearing,thecourtshallenteranordersettingforththecourt'sfindingsoffact."Assuming,arguendo,thattheChancellorwasinerrorbynotfilingafindingoffactafterthishearing,theerrorwouldbeharmlessbecausethefilingofthepetitionwasuntimelyinthefirstplace.  ThefinalissuethatMs.MynattraisesonappealisthattheChancellorerredindenyingherpetitionforattorneyfeesfortheworkthatMr.YanceyperformedrelatingtoMr.Dotson'sConservatorship.Ms.Mynattwasnotentitledtoattorneyfeesfortworeasons.First,theissueofMr.Yancey'sfeeswereconcludedattheMaster'shearingofwhichareportwasfiledonJune12,1992.TheMaster'sreportstatedthatneitherMs.MynattnorMr.Yanceyputonanyproofconcerninghisfees.LocalRule17oftheKnoxCountyChanceryCourtstatesthat:       @ RULE17.APPLICATIONFORFEES  AllapplicationsforCourtapprovaloffeesforattorneys,administrators,executors,conservators,guardiansandothers,exceptindomesticrelationsmatters,shallbesupportedbyswornstatement,settingforthindetailtheamountsoughtandthebasistherefor.       However,thereisnoproofintherecordthatMs.Mynattatanytimeputonanyproofofherrequestedattorneyfees.Furthermore,Rule22oftheKnoxCountyChanceryCourtstatesthat,       @ RULE22.CLERKANDMASTERREPORTS  OrdersofreferencetotheMastershallbeinaccordancewithRule53oftheTennesseeRulesofCivilProcedure;provided,atranscriptoftheproceedingsandoftheevidenceshallbedeemedwaivedunlesstheorderofreferencespecificallyrequiresatranscriptoftheproceedingsandoftheevidence.       TheChancellor'sorderofreferencefailedtomentionthetranscriptoftheproceedings.Therefore,atranscriptastothehearingrelatingtoattorneyfeesisnotpartoftherecord,andwemustpresumethattheChancellor'sfindingswerecorrect.Leekv.Powell,884S.W.2d118(Tenn.App.1994);Sherrodv.Wix,849S.W.2d780(Tenn.App.1992);Danielv.MetropolitanGovernment,696S.W.2d8(Tenn.App.1985).Additionally,Ms.Mynatt'sexceptionstotheMaster'sreportwereuntimely n   ׀anddidnotraiseanexceptiontotheissueofMr.Yancey'sfees.  Ms.MynattfiledherpetitionforattorneyfeesinconjunctionwithherpetitiontohaveMs.IsomremovedpursuanttoT.C.A.3413108(d)(5)thatthecourthasthepowerto"grantanyotherreliefthecourtconsidersappropriateandinthebestinterestofthedisabledperson."Shearguedthatitwouldbeinthebestinterestofthedisabledpersontograntherattorneyfees.However,thisprovisioninthestatuteisbasedontheassumptionthatthe"disabledperson"isstillalive.Therefore,thepetitionforattorneyfeesunderthisprovisionwasproperlydenied,andtheChancellordidnotabusehisdiscretionindenyingthispetition.
