àThis€appeal€arises€out€of€post„divorce€proceedings.€€TheÏissues€raised€by€the€appellant,€Lemuel€A.€Duckett€(Father),€causeÏus€to€focus€on€a€hearing€before€the€trial€court€on€October€24,Ï1994.€€At€that€hearing,€the€court€received€proof€with€respect€toÏtwo€pleadings„„a€petition€for€contempt€filed€by€Sheila€Ann€DuckettÏ(Mother),€and€a€petition€to€modify€filed€by€Father.€€In€herÏpetition,€Mother€claimed€that€Father€was€in€contempt€because€ofÏhis€failure€to€make€payments€on€a€child€support€arrearage€ofÏ$7,650€established€by€an€order€entered€April€20,€1994.€€Father,€onÏthe€other€hand,€sought€the€custody€of€the€parties'€only€child,€LeeÏBelton€Duckett,€who€was€17„1/2€years€old€at€the€time€of€theÏhearing.ÌÌà àà àFollowing€the€hearing,€the€trial€court€entered€an€orderÏon€November€22,€1994.€€As€pertinent€here,€the€order€found€FatherÏin€contempt;€decreed€that€he€was€to€pay€$100€per€week€on€theÏ$7,650€arrearage;€directed€that€he€"serve€two€(2)€days€in€jail€forÏeach€week€[in€the€future]€that€he€fail[ed]€to€make"€a€payment€onÏthe€arrearage;€awarded× ƒ. ××  ×€Mother's€attorney€a€fee€of€$2,000€to€beÍpaid€by€Father;€and€stated€that€the€court€"makes€no€orders€withÏrespect€to€the€custody€relief€sought€by"€Father.ÌÌà àà àFather€appeals,€raising€issues€that€present€theÏfollowing€questions:ÌÌÓÓà àà8 à1.€€Does€the€evidence€preponderate€against€theÏtrial€court's€finding,€in€its€order€of€AprilÏ20,€1994,€that€Father€was€$7,650€in€arrears€inÏhis€child€support?ÌÌà àà8 à2.€€Is€Father€entitled€to€a€credit€against€hisÏchild€support€arrearage€for€payments€made€byÏhim€for€the€benefit€of€his€son?ÌÌà àà8 à3.€€Did€the€trial€court€abuse€its€discretionÏin€awarding€Mother's€attorney€a€fee€of€$2,000?ÌÌà àà8 à4.€€Is€Father€entitled€to€a€credit€against€hisÏchild€support€arrearage€for€support€MotherÏshould€have€been€ordered€to€pay€following€theÏhearing€of€October€24,€1994?ÌÌÌÌÓÓà@ àIÌÌà àà àThe€parties€were€divorced€on€February€2,€1984.€€MotherÏwas€awarded€custody€of€the€parties'€minor€child.€€At€the€time€ofÍthe€most€recent€hearing,€Father€was€subject€to€a€court„orderedÏchild€support€obligation€of€$62€per€week.ÌÌà àà àThe€record€reflects€previous€attempts€by€Father€toÏobtain€custody€of€his€son.€€All€of€those€attempts€were€rebuffed€byÏthe€trial€court,€except€on€one€occasion€when€Father€was€awardedÏcustody€for€a€brief€period€of€time€on€an€òòex€parteóó€application.ÌÌà àà àOn€April€20,€1994,€the€court€entered€an€order€awardingÏMother€a€judgment€for€a€child€support€arrearage€in€the€amount€ofÏ$7,650.€€Father€filed€a€motion€to€alter€or€amend€that€award,€butÏthat€motion€was€denied€by€order€entered€May€25,€1994.€€TheÏpetition€for€contempt€now€before€us€came€next.€€It€was€filed€byÏMother€on€June€22,€1994.€€Father's€petition€to€change€custody€wasÏfiled€on€August€2,€1994.ÌÌà@ àIIÌÌà àà àFather€seeks€to€challenge€the€correctness€of€the€orderÏof€April€20,€1994,€finding€an€arrearage€of€$7,650.€€He€seeks€to€doÏthis€via€a€notice€of€appeal€filed€December€20,€1994.€€This€heÏcannot€do.€€In€order€to€contest€that€determination,€Father€had€toÍfile€a€notice€of€appeal€within€thirty€days€of€the€entry€of€theÏorder€denying€his€motion€to€alter€or€amend.€€òòSeeóó€T.R.A.P.€4(a)€andÏ(b).€€Since€that€order€was€entered€May€25,€1994,€Father€had€untilÏJune€24,€1994,€to€file€his€notice€of€appeal.€€His€notice€of€appealÏfiled€December€20,€1994,€came€too€late€as€far€as€the€order€ofÏApril€20,€1994,€was€concerned.€€It€became€final× ƒ/ ××  ×€and€is€not€subjectÏto€challenge€on€this€appeal.€€The€first€question€raised€byÏFather's€appeal€is€found€adverse€to€him.ÌÌà àà àFather€next€argues€that€he€is€entitled€to€a€creditÏagainst€his€arrearage€for€payments€made€by€him€for€the€benefit€ofÏhis€son€during€extensive€periods€of€time€that€his€son€was€livingÏwith€him€from€1989€to€October€24,€1994,€the€date€of€the€mostÏrecent€hearing.€€The€bulk€of€the€payments€for€which€credit€isÏsought€were€called€to€the€trial€court's€attention€in€Father'sÏmotion€to€alter€or€amend€filed€subsequent€to€the€arrearage€orderÏof€April€20,€1994.€€The€trial€court€rejected€that€argument€when€itÏrefused€to€alter€or€amend€the€April€20,€1994,€order.€€AsÏpreviously€noted,€the€order€of€April€20,€1994,€and€the€order€ofÍMay€25,€1994,€denying€Father's€motion€to€alter€or€amend,€were€notÏappealed€from,€are€now€final,€and€are€the€law€of€this€case.ÌÌà àà àDespite€its€earlier€ruling€on€the€"credit"€issue,€theÏtrial€court€permitted€Father€to€testify€at€the€most€recent€hearingÏas€to€payments€made€by€him€since€the€entry€of€the€May€25,€1994,Ïorder.€€There€was€minimal€documentation€as€to€those€payments;Ïhowever,€because€the€trial€court€received€evidence€on€the€post„MayÏ25,€1994,€payments,€we€will€review€Father's€issue€as€to€thoseÏpayments.ÌÌà àà àWe€start€our€analysis€by€observing€that€we€cannot€changeÏa€child€support€award€for€any€period€of€time€prior€to€the€date€ofÏfiling€of€a€petition€seeking€a€change€in€child€support.€€òòSeeóóÏT.C.A.€ðð€36„5„101(a)(5).€("Such€judgment€[for€child€support]€shallÏnot€be€subject€to€modification€as€to€any€time€period€or€anyÏamounts€due€prior€to€the€date€that€an€action€for€modification€isÏfiled€.€.€.")€€Father€acknowledges€our€lack€of€power;€but€arguesÏthat€we€can€allow€a€òòcreditóó€against€a€child€support€obligation€forÏpayments€made€by€a€non„custodial€parent€for€the€benefit€of€thatÏindividual's€minor€child.€€He€relies€upon€the€case€of€òòò òFreshour€v.ÏAumackó óóó,€567€S.W.2d€176€(Tenn.€App.€1977).ÌÌà àà àòòò òFreshouró óóó€is€not€controlling€here.€€In€that€case,Ïdisability€payments€due€an€incompetent€veteran€were€paid€by€theÏVeterans€Administration€(VA)€to€the€veteran's€former€wife.€€TheÏpayments€were€made€by€the€VA€pursuant€to€a€federal€statute€vestingÏit€with€discretion€to€make€an€incompetent€veteran's€disabilityÏpayments€"for€the€use€of€.€.€.€[the€veteran's]€dependents."€€ThisÏcourt€approved€the€trial€court's€judgment€allowing€the€veteran€aÏcredit€for€the€VA€payments€against€his€child€support€obligation.ÌÌà àà àThere€are€differences€between€òòò òFreshouró óóó€and€the€factualÏpattern€in€the€instant€case.€€First,€and€foremost,€the€payments€inÏòòò òFreshouró óóó€were€made€to€the€custodial€parent,€the€one€to€whom€theÏchild€support€was€due.€€The€payments€in€the€instant€case€were€notÏpaid€to€the€custodial€parent.€€Second,€even€if€we€were€to€construeÏthe€judgment€in€òòò òFreshouró óóó€as€approving€a€retroactive€modificationÏof€a€child€support€award€(which€we€are€not€inclined€to€do),€thatÏcase€was€decided€before€the€enactment€of€the€quoted€part€of€T.C.A.Ïðð€36„5„101(a)(5).€€When€òòò òFreshouró óóó€was€decided,€a€trial€court€hadÏdiscretion€to€retroactively€modify€a€child€support€obligation.€ÏòòSeeóó€òòò òCrane€v.€Craneó óóó,€170€S.W.2d€663,€665€(Tenn.€App.€1942).ÌÌà àà àWhile€rejecting€Father's€reliance€on€ò òòòFreshouróóó ó,€weÏhasten€to€note€that€there€is€authority,€even€in€light€of€T.C.A.€ððÏ36„5„101(a)(5),€for€allowing€a€non„custodial€parent€a€creditÏagainst€that€parent's€child€support€obligation€"for€the€children'sÏnecessaries€which€are€not€being€supplied€by€the€custodial€parent."€Ïòòò òOliver€v.€Oczkowiczó óóó,€15€TAM€26„4€(Tenn.€App.,€May€18,€1990);Ïòòò òSutton€v.€Suttonó óóó,€16€TAM€12„9€(Tenn.€App.,€February€12,€1991);Ïòòò òNetherton€v.€Nethertonó óóó,€18€TAM€11„7€(Tenn.€App.,€February€26,Ï1993).€€However,€before€that€principle€is€applicable,€there€mustÏbe€a€dual€showing:€€(1)€that€the€payments€were€made€by€the€non„custodial€parent€for€the€child's€necessaries;€òòandóó€(2)€that€thoseÏnecessaries€were€not€being€provided€by€the€custodial€parent.€€ItÏis€clear€that€some€of€the€payments€made€by€Father€were€not€forÏnecessaries.€€For€example,€he€paid€for€his€son's€class€ring€andÏalso€contributed€toward€his€son's€vacation€trip€to€CentralÏAmerica.€€Those€payments€are€clearly€not€covered€by€the€principleÏat€issue.ÌÌà àà àFather€did€testify€that€he€paid€for€items€that€wouldÏclearly€be€classified€as€necessaries;€however,€much€of€thisÏtestimony€was€disputed€by€Mother.€€The€trial€court€resolved€theseÏissues€of€credibility€in€favor€of€Mother.€€The€credibility€of€theÍwitnesses€in€this€case€was€for€the€trial€judge,€not€us.€Ïò òòòGalbreath€v.€Harrisóóó ó,€811€S.W.2d€88,€91€(Tenn.€App.€1990).ÌÌà àà àWe€cannot€say€that€the€evidence€preponderates€in€favorÏof€a€finding€that€Father€provided€necessaries€that€were€not€beingÏprovided€by€Mother.€€There€was€testimony€from€Mother€that€sheÏprovided€these€needs.€€The€trial€judge€obviously€credited€thisÏtestimony.€€We€are€not€in€a€position„„based€on€a€"cold"€record„„toÏdisagree€with€his€assessment€of€Mother's€credibility.€€The€secondÏquestion€raised€by€Father's€brief€is€also€found€adverse€to€him.ÌÌà àà àà àFather€questions€the€trial€court's€award€of€aÏ$2,000€fee€to€Mother's€attorney.€€This€matter€addressed€itself€toÏthe€sound€discretion€of€the€trial€judge.€€òòò òThreadgill€v.ÏThreadgilló óóó,€740€S.W.2d€419,€426€(Tenn.€App.€1987);€ò òòòDover€v.ÏDoveróóó ó,€821€S.W.2d€593,€595€(Tenn.€App.€1991).€€With€respect€toÏ$1,000€of€the€total€fee,€we€are€hindered€in€our€review€by€the€lackÏof€a€transcript€of€the€hearing€at€which€it€was€awarded× ƒ0 ××  ×.€€In€anyÏevent,€we€do€not€find€that€the€trial€judge€abused€his€discretion.ÌÌà àà àFinally,€Father€argues€that€he€is€entitled€to€a€creditÏagainst€his€child€support€arrearage€for€child€support€that€MotherÏshould€have€been€ordered€to€pay€at€the€October€24,€1994,€hearing.€ÏBefore€we€can€reach€this€issue,€we€must€"tackle"€a€moreÏfundamental€question„„what€did€the€trial€court€do€at€the€OctoberÏ24,€1994,€hearing,€or€what€should€it€have€done,€regarding€theÏcustody€of€Lee€Belton€Duckett€for€the€short€remainder€of€hisÏminority?€€The€answer€to€the€first€part€of€this€question€isÏdifficult€to€ascertain;€the€second€part€of€the€question€is€moreÏeasily€answered€and€that€answer€is€the€key€to€resolving€Father'sÏlast€issue.ÌÌà àà àWe€have€a€transcript€of€the€trial€court's€remarksÏfollowing€the€hearing€of€October€24,€1994.€€Actually,€thoseÏremarks€are€found€at€two€places€in€the€record.€€They€are€a€part€ofÏthe€transcript€of€evidence€signed€by€the€trial€judge€on€June€28,Ï1995;€those€identical€remarks€are€also€found€in€the€memorandumÏopinion€filed€in€what€used€to€be€referred€to€as€the€"technicalÏrecord"„„the€various€papers€filed€with€the€trial€court€other€thanÏthe€transcript€of€evidence€and€the€exhibits.€€Those€remarksÏinclude€the€following€colloquy:ÌÌÓÓà àà àMS.€RAMER:à0 àà à€€Your€Honor,€are€you€transferringÌà àà àà àà à€€custody€[to€Father]?ÌÌà àà àTHE€COURT:€€Temporarily.ÌÌÌÌÓÓThis,€of€course,€is€different€from€the€court's€decree€in€the€orderÏentered€following€the€hearing:ÌÌÓÓà àà8 àThe€Court€makes€no€orders€with€respect€to€theÏcustody€relief€sought€by€Lemuel€Duckett.ÌÌÌÌÓÓà àà àWhat€are€we€to€make€of€the€contradiction€in€these€twoÏdocuments,€each€of€which€was€signed€by€the€trial€judge?€€It€wouldÏbe€easy€to€simply€refer€to€the€well€known€rule€that€a€court€speaksÏthrough€its€judgments€and€orders€entered€upon€its€minutes,€andÏdismiss,€out€of€hand,€the€trial€judge's€comment€in€theÏtranscript/memorandum€opinion.€€òòSeeóó€òòò òPalmer€v.€Palmer,€ó óóó562€S.W.2dÏ833,€837€(Tenn.€App.€1977);€òòò òRogers€v.€Sainó óóó,€679€S.W.2d€450,€452Ï(Tenn.€App.€1984).€€The€problem€with€this€approach€is€that€itÏignores€the€fact€that€the€transcript€is€certified€by€the€trialÏjudge's€signature€to€be€a€true€transcription€of€his€remarks;€andÏit€also€ignores€the€fact€that€the€transcript€was€signed€some€sevenÏmonths€òòafteróó€the€order€was€signed,€i.e.,€June€28,€1995,€òòvis„a„visóóÏNovember€22,€1994.ÌÌà àà àWe€note,€in€passing,€that€the€order€memorializing€theÏaction€taken€at€the€October€24,€1994,€hearing€was€prepared€byÏMother's€counsel€and€served€on€Father's€counsel€pursuant€to€Tenn.ÏR.€Civ.€P.€58× ƒ1 ××  ×.€€We€also€note€that€Father€filed€a€motion€followingÏthe€entry€of€that€order€that€included€the€following€request€forÏrelief:ÌÌÓÓà àà8 àLemuel€Duckett€seeks€modification€andÏalteration€of€the€signed€Order,€pursuant€toÏRule€59€of€the€Tennessee€Rules€of€CivilÏProcedure,€to€make€it€consistent€with€theÏactual€decision€of€the€Court.€€The€Order€asÏsigned€does€not€dispose€of€the€issue€ofÏcustody€and€the€Court€clearly€awarded€custodyÏof€the€parties'€minor€son€to€Lemuel€Duckett.ÌÌÌÌÓÓThe€record€does€not€indicate€that€this€request€was€ever€acted€uponÏby€the€trial€court.ÌÌà àWhile€we€are€not€sure€what,€if€anything,€the€trial€courtÏintended€to€do€with€respect€to€Father's€request€for€a€change€ofÏcustody,€we€believe€that€the€pleadings€and€proof€require€aÍdisposition.€€òòSeeóó€T.R.A.P.€36.€€The€evidence€clearly€indicatesÏthat€this€17„1/2€year€old€boy€had€lived€the€majority€of€the€pastÏfew€years€with€his€father;€that€he€was€a€senior€at€Ootewah€HighÏSchool,€a€school€located€in€the€area€where€Father€resided;€that€heÏwanted€to€live€with€his€father;€and€that€there€is€no€indicationÏthat€a€change€of€custody€would€be€harmful,€in€any€way,€to€theÏchild's€welfare.€€We€find€that€the€proof€preponderates€in€favor€ofÏa€finding€that€the€child's€best€interest€dictates€that€his€custodyÏbe€changed€from€Mother€to€Father,€effective€August€2,€1994,€theÏdate€of€filing€of€his€petition€to€modify.€€Father€clearly€provedÏthat€a€change€of€custody€was€appropriate.ÌÌà àà àFor€all€of€the€foregoing€reasons,€so€much€of€the€trialÏcourt's€order€of€November€22,€1994,€as€purports€to€take€no€actionÏwith€respect€to€Father's€petition€for€change€of€custody€is€herebyÏvacated.€€This€matter€is€remanded€to€the€trial€court€withÏinstructions€to€enter€an€order€modifying€the€order€of€November€22,Ï1994,€to€accomplish€the€following:Ìà àà à1.€€Changing€the€custody€of€Lee€Belton€Duckett€fromÏMother€to€Father€effective€August€2,€1994.Ìà àà à2.€€Relieving€Father€of€his€child€support€obligations€toÏMother€effective€August€2,€1994.Ìà àà à3.€€Establishing€the€child€support€due€from€Father€forÏthe€period€from€April€20,€1994,€to€August€2,€1994.Ìà àà à4.€€Establishing€all€payments,€if€any,€made€by€Father€toÏMother€on€the€child€support€from€and€after€April€20,€1994,€andÏapplying€same€against€the€total€arrearage€found€by€the€trialÏcourt.Ìà àà à5.€€Determining,€in€compliance€with€the€Child€SupportÏGuidelines,€the€child€support€that€was€due€from€Mother€to€FatherÏfor€the€period€beginning€August€2,€1994,€and€ending€when€the€childÏreached€his€majority,€or€graduated€from€high€school,€whicheverÏoccurred€last,€pursuant€to€the€provisions€of€T.C.A.€ðð€34„11„102(b);€and€applying€the€amount€so€found€as€a€credit€againstÏFather's€child€support€arrearage.ÌÌà
