MohamedAliappealsanorderoftheTrialCourtdenyinghismotionforreliefunderRule60oftheTennesseeRulesofCivilProcedure,denyinghisrequesttoappointhimcounselanddenyinghismotionseekingsanctions.  ThiscasewasinitiatedbycomplaintfiledonJanuary16,1990,allegingthePlaintiffwassexuallyassaultedwhileundertheinfluenceofadrugadministeredbytheDefendantwhowasatthattimeapracticingphysicianinWashingtonCounty.AnanswerwasfiledbycounselfortheDefendantonFebruary16,1990.ThecasewasthereaftertriedonMay29,1991,aftercounselfortheDefendant,onthesamedate,movedandwaspermittedtowithdrawascounsel.AjudgmentwasenteredonJune3,grantingMs.Duggercompensatorydamagesintheamountof$1,500,000andpunitivedamagesintheamountof$2,500,000.  TheRule60motionwasfiledonMay22,1994,andresolvedbytheTrialCourtbyorderenteredJuly12,1995.Thisordercontainedthefollowingpertinentinformation:     1. Indefendant'sMotiontoSetAsideJudgmentbyDefaultfiledJune3,1991, l   ׀herecitesthathewas"absentfromtheUnitedStates...betweenJune,1990andOctober,1992."DefendanthadfledtheUnitedStatesafterbeingchargedcriminallyinthissamematterandhavingmadebond.ItwasonlyafterhisrecapturebybondsmeninEgyptthathereturnedtotheUnitedStates.DefendantwillfullylefttheUnitedStatestoavoidcriminalprosecution.ThisMotionwasfiledMay27,1992,somenineteenmonthsafterhisreturn.Thereisnofactualorlegalbasistosetasidethedefaultjudgment,norwastheMotionfiledwithinareasonabletime.SeeT.R.C.P.60.02.Defendant'sMotiontoSetAsideJudgmentbyDefaultis,therefore, DENIED .      Beforeaddressingthemeritsoftheissuesraised,wepointoutthatcontrarytoMr.Ali'smotionthejudgmentheseekstosetasideisnotadefaultjudgmentbecausealthough,asalreadynoted,hiscounselhadwithdrawntheanswerwhichhadbeenfiledwasstillviable.  Turningtothemerits,wenotetherearetwofataldeficienciesastoMr.Ali'sRule60motion.First,theallegationsrecitenofactsjustifyingsettingasidethejudgment,merelyconclusion:        @ MERITORIOUSDEFENSE  (1.)AsshownintheinitialanswerfiledbyMr.JamesT.Bowman,attorneyatlaw,onbehalfoftheDefendant,therearemeritoriousdefensesforhim.SeePattersonv.RockwellInt'l,665S.W.2d96(Tenn.1994). ....@  SETTINGASIDE  (4.) AjudgmenttakenbydefaultwasnotauthorizedbythefailureoftheDefendanttoappearinpersonorbycounselatthetimethecaseiscalledfortrialwheretherewasonfilehispleasputtinginissuetheessentialavermentofPlaintiff'sdeclaration,andwithdrawalofdefendant'sattorneyfromthecasedidnothavetheeffectofwithdrawingthepleas.See Martinv.Kirk ,3Tenn.Civ.App.(3Higgins)595(1913).@ EXTRAORDINARYCIRCUMSTANCEANDEXTREMEHARDSHIP  (5.) TheDefendantallegesthatheis"exempt"fromtheoneyearlimitthatbarsreliefunder Rule60.02 Tenn.R.Civ.P.,duetohisextraordinarycircumstancesandextremehardships. Furthermore,theDefendantallegesthathequalifiesforreliefunderthe"anyotherreason"clauseof Subdivision(5) ofsaidRule.      Secondly,themotionwasnotfiledwithineitherthe"reasonabletime"orthe"oneyear"limitationspecifiedintheRule.  WehaveconsideredtheotherissuesraisedbyMr.Alirelatingtoappointmentofcounselandimpositionofsanctionsandfindbothtobewithoutmerit.  Inconclusion,wehavenotoverlookedMs.DuggersinsistencethatthisisnotafinaljudgmentinthattheCourtreservedthequestionregardingagarnishmentissuedsubsequenttothejudgment.WedonotbelieveacontroversyregardinggarnishmentisamultipleclaimcontemplatedunderRule3oftheTennesseeRulesofAppellateProcedurewhichproscribesappealsunlessjudgmentsarefinal.Indeed,ifsuchwouldbaranappealitisconceivablethatanappealastotheunderlyingcasecouldbedelayedformonthsoryearsbycontinuouslitigationregardingthevalidityofgarnishments.
