àThe€parties€married€April€15,€1983€and€were€divorced€by€finalÏdecree€entered€February€21,€1990.€€Two€children€were€born€of€theÏmarriage;€Victoria€€Nicole€Dwight,€born€November€1,€1983,€and€DanielÏAdam€Dwight,€born€June€11,€1986.€€Pursuant€to€the€final€decree€ofÏdivorce,€the€court€awarded€joint€custody€to€the€parties,€with€WifeÏhaving€primary€physical€custody.Ìà àOn€February€1,€1994,€Wife€filed€a€petition€to€modify€the€partiesððÍfinal€divorce€decree€by€increasing€the€child€support€awards.€€Wife€Ïalleges€that€the€œchildrenððs›€needs€have€increased€as€they€have€gottenÏolder,€and€that€Husbandððs€income€and€ability€to€pay€child€support€haveÏalso€increased,€constituting€a€material€change€in€circumstances.€€WifeÏseeks€to€increase€€Husbandððs€child€support€payments€to€an€amount€thatÏis€in€compliance€with€the€Child€Support€Guidelines€promulgated€by€theÏTennessee€Department€of€Human€Services.€€Tenn.€Comp.€R.€&€Regs.€tit.Ï10,€ch.€1240„2„4„.01€òòet€seq.€óó(1989,€revised€1994)€(Guidelines).€ÏAdditionally,€Wife€requested€that€she€be€permitted€to€take€the€childrenÏas€deductions€on€her€federal€income€tax€return,€and€that€Husband€pay€allÏattorney€fees€and€court€costs.€€Ìà àOn€September€15,€1994,€the€divorce€referee€entered€an€orderÏfinding€that€Husbandððs€income€had€not€increased€significantly,€but€thatÏthe€expenses€of€the€partiesðð€children€had€increased€significantly.€€TheÏreferee€raised€Husbandððs€child€support€obligation€to€$1,000.00€perÏchild,€per€month€and€ordered€Husband€to€pay€$3,000.00€toward€WifeððsÏattorneyððs€fees.€€On€October€20,€1994,€the€trial€judge€signed€an€orderÏincreasing€child€support€consistent€with€the€refereeððs€ruling,€andÏHusband€appealed.€€By€order€entered€November€22,€1994,€the€trial€judgeÍset€aside€his€previous€order€affirming€the€refereeððs€ruling€and€deniedÏWifeððs€petition€to€modify€child€support.€€Wife€perfected€the€presentÏappeal€and€presents€two€issues€for€review:ÌÓÓà8 àà8 à1.€€Whether€the€trial€court€erred€in€failing€toÏincrease€the€child€support€award?ÌÌà8 àà8 à2.€€Whether€the€trial€court€erred€in€failing€toÏaward€attorney€fees?€€€ÌÌÓÓ€à àHusband€is€employed€as€a€pilot€at€Federal€Express€Corporation€andÏwas€so€employed€at€the€time€of€the€divorce.€€In€1990,€the€year€of€theÏdivorce,€Husbandððs€annual€income€was€$128,326.00;€in€1991,€HusbandððsÏincome€was€$127,900.00;€in€1992,€$158,220.00;€and€in€1993,Ï$165,775.00.€€At€the€time€of€trial,€November€18,€1994,€HusbandÏpredicted€that€his€income€for€1994€would€be€between€$123,000.00€andÏ$126,000.00.€€In€explaining€this€reduction€in€income,€Husband€statedÏthat,€prior€to€1994,€he€was€a€first€officer€on€the€DC„10€airplane€andÏreceived€a€significant€amount€of€income€as€a€result€of€overtime€payÏ($41,200€in€1992).€€Husband€testified€that,€due€to€corporate€plans€toÏhire€additional€pilots€at€Federal€Express€in€1994€and€thereby€reduce€theÏnumber€of€overtime€hours€available€to€DC„10€pilots,€he€trained€for€andÏwas€awarded€a€position€as€captain€on€the€727€airplane.€€Because€he€hasÍa€lower€seniority€status€as€a€727€captain€than€he€had€as€a€DC„10€firstÏofficer,€Husband€is€lower€in€the€bidding€pool€and€is€not€able€to€get€asÏmany€overtime€hours.€€Ìà àTestimony€at€trial€revealed€that€Husband€does€not€exercise€hisÏvisitation€rights€on€a€regular€basis.€€Husband€testified€that€his€childrenÏhave€spent€€one€to€two€weekends€with€him€since€the€partiesðð€divorce€inÏ1990.€€He€stated€that€he€has€exercised€one€full€week€of€visitation€withÏthe€children€in€three€of€the€last€four€years,€but€never€more€than€oneÏweek.€€According€to€Husband,€Wife€makes€it€difficult€for€him€toÏexercise€his€visitation€rights€by€frequently€canceling€scheduledÏvisitation€periods.€€Because€of€his€irregular€schedule€as€a€pilot,ÏHusband€often€exercises€his€visitation€for€a€few€hours€after€theÏchildren€get€out€of€school.€€He€testified€that€the€children€cry€and€insistÏon€spending€the€night€with€their€mother€when€he€suggests€overnightÏstays.€Ìà àAt€the€time€of€trial,€Wife€and€both€children€were€living€withÍHusbandððs€parents.œ× ƒ4 ××  ×›€€Wife,€who€has€a€GED€equivalent,€earns€an€hourlyÏwage€of€$7.03.€€Wife€stated€that€she€wanted€to€live€on€her€own,€butÏcould€not€afford€to€pay€her€expenses€as€well€as€those€of€her€childrenÏbased€upon€her€monthly€income€and€œHusbandððs›€child€support€payment.€€InÏa€deposition€taken€prior€to€trial,€Wife€testified€that€the€œchildrenððs›Ïneeds€could€be€met€with€between€$3,500.00€and€$4,500.00€per€month.€ÏAlthough€Wife€stated€at€trial€that€the€œchildrenððs›€individual,€personalÏneeds€did€not€exceed€$500.00€per€month,€per€child,€she€€testified€thatÏthe€$500.00€sum€does€not€include€the€œchildrenððs›€pro€rata€share€of€rentÏand€household€expenses,€groceries,€gasoline,€etc.€€Currently€HusbandÏpays€$550.00€per€month,€per€child,€as€well€as€medical€insurance€andÏtuition.€€Husband€requested€that€Wife€produce€receipts€evidencing€theÏœchildrenððs›€increased€needs;€however,€Wife€did€not€comply€with€thisÏrequest.€€Wife€did€testify€with€specificity€regarding€the€œchildrenððs›Ïincreased€needs€for€€clothing,€hair€care,€and€school€items€(such€as€lunchÏmoney,€miscellaneous€books€and€field€trips)€since€the€time€of€theÍpartiesðð€divorce.€€Ìà àAccording€to€Wife,€Husband€makes€no€effort€to€see€his€children.€ÏWife€denies€that€she€frequently€interferes€with€scheduled€visitationÏperiods.€€She€testified€that€Husband€treats€his€children€differently€thanÏhe€treats€the€child€of€his€current€wife.€€Wife€also€stated€that€HusbandððsÏcurrent€wife€is€not€nice€to€her€children.€€Wife€testified€that,€in€additionÏto€spending€very€little€time€with€his€children,€he€spends€very€littleÏmoney€fulfilling€their€wants€and€needs.€€Ìà àSince€this€case€was€tried€by€the€court€sitting€without€a€jury,€weÏreview€the€case€ò òòòde€novoó óóó€upon€the€record€with€a€presumption€ofÏcorrectness€of€the€findings€of€fact€by€the€trial€court.€€Unless€theÏevidence€preponderates€against€the€findings,€we€must€affirm,€absentÏerror€of€law.€€T.R.A.P.€13(d).€€Ìà àModification€of€an€existing€child€support€order€is€controlled€byÏT.C.A.€€ðð€36„5„101(a)€(Supp.€1995),€which€states,€in€pertinent€part:ÌÓÓà8 àà8 àIn€cases€involving€child€support,€uponÏapplication€of€either€party,€the€court€shallÏdecree€an€increase€or€decrease€of€suchÏallowance€when€there€is€found€to€be€aÏsignificant€variance,€as€defined€in€the€childÏsupport€guidelines€established€by€subsection(e),Ïbetween€the€guidelines€and€the€amount€ofÍsupport€currently€ordered€unless€the€varianceÏhas€resulted€from€a€previously€court„orderedÏdeviation€from€the€guidelines€and€theÏcircumstances€which€caused€the€deviation€haveÏnot€changed.€€ÌÌÓÓCurrently,€a€ð ðsignificant€varianceðð€is€15%.€€ò òòòSeeó óóó€Tenn.€Comp.€R.€&€Regs.Ïtit.€10,€ch.€1240„2„4„.02(3);€ò òòòTurner€v.€Turneró óóó,€919€S.W.2d€340,€343Ï(Tenn.€App.€1995).Ìà àT.C.A.€€ðð€36„5„101(e)(1)(Supp.€1995)€provides:ÌÓÓà8 àà8 àIn€making€its€determination€concerning€theÏamount€of€support€of€any€minor€child€or€childrenÏof€the€parties,€the€court€shall€apply€as€aÏrebuttable€presumption€the€child€supportÏguidelines€as€provided€in€this€subsection.€€If€theÏcourt€finds€that€evidence€is€sufficient€to€rebutÏthis€presumption,€the€court€shall€make€a€writtenÏfinding€that€the€application€of€the€child€supportÏguidelines€would€be€unjust€or€inappropriate€inÏthat€particular€case,€in€order€to€provide€for€theÏbest€interest€of€the€child(ren)€or€the€equityÏbetween€the€parties.€€ÌÌÓÓà àIn€its€ð ðOrder€on€Appeal€from€Referee,ðð€the€trial€court€found€thatÏthe€Guidelines€probably€would€not€apply€to€the€instant€case;€but€even€ifÏthey€did,€the€presumption€contained€in€the€Guidelines€had€been€rebuttedÏbecause€œHusbandððs›€current€income€of€$123,000.00€to€$126,000.00€isÏactually€less€than€his€income€at€the€time€of€divorce;€$128,386.00.€€Ìà àThe€trial€court,€citing€T.C.A.€ðð€36„5„101(h),€stated€that€the€lawÏdoes€not€require€partiesðð€provisions€for€support€to€meet€the€GuidelinesÏin€a€marital€dissolution€agreement,€as€long€as€adequate€provision€isÏmade€for€the€children.€€€T.C.A.€ðð€36„5„101(h)€(Supp.€1995)€states:ÌÓÓà8 àà8 àNothing€in€this€section€shall€be€construed€toÏprevent€the€affirmation,€ratification€andÏincorporation€in€a€decree€of€an€agreementÏbetween€the€parties€as€to€€support€andÏmaintenance€of€a€party€or€as€to€child€support.€€InÏany€such€agreement,€the€parties€mustÏòòaffirmatively€acknowledgeóó€that€no€action€by€theÏparties€will€be€effective€to€reduce€child€supportÏafter€the€due€date€of€each€payment,€and€thatÏthey€understand€that€court€approval€must€beÏobtained€before€child€support€can€be€reduced,Ïunless€such€payments€are€automatically€reducedÏor€terminated€under€the€terms€of€the€agreement.€Ï(Emphasis€added.)ÌÌÓÓIn€the€instant€case,€neither€the€partiesðð€marital€dissolution€agreementÏnor€the€final€decree€use€the€language€contained€in€T.C.A.€ðð€36„5„101(h),Ïas€that€statute€requires.€€Thus,€the€agreement€does€not€effectivelyÏdeviate€from€the€Guidelines€under€T.C.A.€ðð€36„5„101(h).€€œTherefore,Ïdeviation€requires€the›€trial€court€œmake›€a€written€finding€that€theÏGuidelines€would€create€an€unjust€or€inappropriate€result.€€T.C.A.€ðð€36„5„101(e)(1).€€€No€such€finding€was€made€at€the€time€the€final€decree€€ofÍdivorce€was€entered.€€Finally,€there€is€a€rebuttable€presumption€in€thisÏstate€that€the€amount€of€support€established€by€the€Guidelines€isÏproper;€there€is€no€requirement€that€the€obligee€spouse€prove€that€theÏchildrenððs€needs€are€equal€to€the€amount€provided€for€in€the€Guidelines.€ÏT.C.A.€ðð€36„5„101(e)(1).€€Ìà àOur€review€of€the€record€reveals€that,€although€Husband€hasÏcomplied€with€the€partiesðð€original€agreement€from€a€financialÏstandpoint,€he€has€not€exercised€visitation€as€contemplated€by€theÏagreement.€€€The€partiesðð€agreement€contemplates€visitation€asÏfollows:ÌÓÓà8 àà8 àHusband€shall€be€entitled€to€reasonableÏvisitation.€€Such€reasonable€visitation€shallÏinclude€but€not€be€limited€to€the€following:€€Ìà8 àà8 àa.€€Each€weekend€beginning€Friday€afternoonsÏafter€school€until€Sunday€night€after€church.Ìà8 àà8 àb.€€Alternate€holidays€.€.€.€Ìà8 àà8 àc.€€Four€weeks€during€the€year,€but€notÏnecessarily€in€the€summer€or€consecutively.€€ÌÌÓÓWife€contends€that€the€trial€court€erred€in€overruling€the€decision€ofÏthe€divorce€referee€and€failing€to€award€Wife€child€support€at€leastÏequal€to€an€amount€called€for€in€the€Guidelines€based€on€the€fact€thatÏthe€children€never€spend€the€night€or€a€weekend€with€their€father,€or€goÍon€vacation€with€him.€€€€Ìà àThe€Child€Support€Guidelines€were€promulgated,€òòinter€aliaóó,€toÏprovide€equitable€child€support€awards€and€to€ensure€that€when€parentsÏlive€separately€and€there€is€a€difference€in€the€parentsðð€economicÏstatus,€children€share€in€the€higher€standard€of€living€enjoyed€by€theirÏparent.€€Tenn.€Comp.€R.€&€Regs.€tit.€10,€ch.€1240„2„4„.02(2)(b)(e).€€€ÏSignificantly,€the€Guidelines€are€intended€to€provide€a€ò òminimumó ó€baseÏfor€determining€child€support€obligations.€€Tenn.€Comp.€R.€&€Regs.€tit.Ï10,€ch.€1240„2„4„.02(6).€€Ìà àThe€Guidelines€allow€an€upward€deviation€where€the€non„custodial€spouse€exercises€ð ðless€than€average€overnight€visitation.ðð€ÏThe€Guidelines€state:ÌÓÓà8 àà8 àThese€guidelines€are€designed€to€apply€toÏsituations€where€children€are€living€primarilyÏwith€one€parent€but€stay€overnight€with€theÏother€parent€at€òòleast€as€oftenóó€as€every€otherÏweekend€from€Friday€to€Sunday,€two€weeks€inÏthe€summer€and€two€weeks€during€holidaysÏthroughout€the€year.€.€.€.€In€situations€whereÏovernight€time€is€divided€more€equally€betweenÏthe€parents,€the€courts€will€have€to€make€a€caseÏby€case€determination€as€to€the€appropriateÏamount€of€support.€(Emphasis€added.)ÌÌÓÓTenn.€Comp.€R.€&€Regs.€tit.€10,€ch.€1240„2„4„.02(6)(7).€€Similarly,€whereÍovernight€time€is€divided€òòlessóó€equally€between€the€parents,€the€supportÏaward€should€be€adjusted€appropriately.€€Ìà àThe€Guidelines€further€provide€œthat›€since€the€percentage€awardsÏin€the€Guidelines€are€a€œminimum›€the€court€òòshallóó€increase€the€childÏsupport€award€for€the€following€reasons:ÌÓÓà8 àà8 àIf€the€child(ren)€is/are€not€staying€overnightÏwith€the€obligor€for€the€average€visitationÏperiod€of€every€other€weekend€from€FridayÏevening€to€Sunday€evening,€two€weeks€during€theÏsummer€and€two€weeks€during€holiday€periodsÏthroughout€the€year,€then€an€amount€shall€beÏadded€to€the€percentage€calculated€in€the€aboveÏrule€to€compensate€the€obligee€for€the€cost€ofÏproviding€care€for€the€child(ren)€for€the€amountÏof€time€during€the€average€visitation€period€thatÏthe€child(ren)€are€not€with€the€obligor.€€ÌÌÓÓTenn.€Comp.€R.€&€Regs.€tit.€10,€ch.€1240„2„4„.04(1)(b).€€Certainly€theÏrationale€contained€in€these€provisions€is€equally€applicable€whereÏchild€support€payments€òòbelowóó€the€Guideline€amount€have€been€awarded.€€€Ìà àWhile€we€recognize€that€Husbandððs€irregular€schedule€as€a€pilotÏprevents€him€from€exercising€some€visitation€and€that,€at€times,€WifeÏhas€made€it€difficult€for€Husband€to€see€the€children,€we€stress€thatÏthe€best€interest€of€the€children€is€this€Courtððs€paramount€concern.Ïò
