 àà ` àMs.€¢Derryberry£,€who€has€a€bachelorððs€degree€from€MiddleÏTennessee€State€University,€was€gainfully€employed€for€a€majorityÐ p:1> Ðof€the€seven€years€of€the€marriage.€€Soon€after€the€parties€wereÏmarried,€Ms.€¢Derryberry£,€who€has€a€realtorððs€license,€worked€inÏreal€estate.€€Ms.€¢Derryberry£€then€obtained€employment€as€aÏparalegal€initially€at€¢Provident,€and£€then€at€ñ¡ñœñ¡ñ¢Healthsource£.ñ¡ñ›ñ¡ñ€ÏDuring€the€seven€years€of€the€marriage,€Ms.€¢Derryberry£€earnedÏapproximately€$30,000€a€year.ÌÌà  àà ` àMr.€¢Derryberry£€is€a€lawyer€licensed€to€practice€in€theÏState€of€Tennessee.€€Less€than€a€month€prior€to€this€marriage,ÏMr.€¢Derryberry£€left€his€position€as€a€senior€partner€with€the€lawÏfirm€of€Miller€and€Martin€in€order€to€open€his€own€practice.€ÏDuring€the€span€of€the€marriage,€Mr.€¢Derryberry£€earned€betweenÏ$155,000€and€$273,000€per€year€from€the€practice€of€law.ÌÌà  àà ` àMr.€¢Derryberry£€commenced€this€action€by€filing€aÏComplaint€for€Divorce€òòpro€seóó€in€the€Circuit€Court€for€HamiltonÐ à.€%( ÐCounty€on€March€14,€1997.€€Mr.€¢Derryberry£€alleged€as€grounds€forÏdivorce€irreconcilable€differences€and€inappropriate€maritalÏconduct€and€sought€an€equitable€division€of€the€marital€estate.€€ÌOn€May€28,€1997,€Ms.€¢Derryberry£€filed€her€Answer€to€Mr.Ï¢Derryberry£ððs€Complaint€for€Divorce€and€filed€a€Counter„ComplaintÏseeking€a€divorce€and€alleging€as€grounds€inappropriate€maritalÐ  :À04 Ðconduct€and€adultery.€€Ms.€¢Derryberry£€sought€an€equitableÏdivision€of€the€marital€estate,€alimony€and€an€award€of€all€legalÏfees€in€her€Counter„Complaint.Ì€€€€€Ìà  àà ` àThis€matter€was€heard€before€the€Trial€Court€on€JulyÏ31,€1997.€€On€that€date,€the€parties€stipulated€that€grounds€forÏdivorce€existed€in€favor€of€Ms.€¢Derryberry£,€and€the€stipulationÏof€grounds€in€favor€of€Ms.€¢Derryberry£€could€be€considered€by€theÏcourt€when€considering€alimony.€€Furthermore,€the€partiesÏstipulated€that€the€wife€was€entitled€to€rehabilitative€alimony.€ÏBoth€parties€also€agreed€to€the€items€of€property€and€debts€to€beÏdivided€between€the€parties€but€could€not€reach€agreement€as€toÏthe€value€of€such€property.ÌÌà àMs.€¢Derryberry£€was€awarded€her€separate€property€inÏRutherford€County,€as€well€as€any€appreciation€in€value.€€Ms.Ï¢Derryberry£€also€retained€a€Saab€automobile,€her€retirement€andÏother€bank€accounts,€and€various€personal€items.€€Ms.€¢Derryberry£,Ïas€previously€stated,€was€awarded€$41,500€from€Mr.€¢Derryberry£ððsÏretirement€accounts€pursuant€to€a€Qualified€Domestic€RelationsÏOrder.€€Each€party€retained€ownership€of€his€or€her€own€lifeÏinsurance€policies.€€Each€partyððs€daughter€from€a€prior€marriageÏreceived€€the€automobile€she€drove.ÌÌà  àà ` àMr.€¢Derryberry£€was€ordered€to€pay€all€debts€associatedÏwith€the€assets€he€was€awarded,€the€four€credit€cards€used€by€theÏparties,€the€amount€still€owed€on€the€automobile€driven€by€Ms.Ï¢Derryberry£ððs€daughter,€and€any€income€tax€owed€for€1996€and€1997.€ÏMs.€¢Derryberry£€was€ordered€to€pay€all€debts€associated€with€anyÏproperty€she€received,€as€well€as€bills€from€Saks,€ñ¡ñœñ¡ñ¢Proffittððs£ñ¡ñ›ñ¡ñ€andÏCellular€One.Ìà  àÌà  àà ` àFurthermore,€the€Trial€Court€ordered€Mr.€¢Derryberry£€toÏpay€Ms.€¢Derryberry£€rehabilitative€alimony€in€the€amount€of€$2,000Ïper€month€for€three€years.€€In€order€to€secure€the€payment€ofÏalimony,€Mr.€¢Derryberry£€was€ordered€to€name€Ms.€¢Derryberry£Ïbeneficiary€of€$75,000€of€his€life€insurance€policy.€€Mr.Ï¢Derryberry£€was€also€ordered€to€pay€Ms.€¢Derryberry£ððs€attorney€feesÐ  :À04 Ðwhile€court€costs€were€taxed€equally€to€the€parties.€€A€FinalÏDecree€was€entered€by€the€Trial€Court€on€August€27,€1997.ÌÌà  àà ` àOn€September€24,€1997,€Ms.€¢Derryberry£€filed€a€Motion€toÏRecover€Discretionary€Costs,€and€a€Motion€to€Alter€or€Amend€FinalÏDivorce€Decree.€€In€her€Motion€to€Alter€or€Amend,€Ms.€¢Derryberry£Ïsought€additional€rehabilitative€alimony€due€to€her€loss€ofÏemployment€arising€from€staff€reduction€at€ñ¡ñœñ¡ñ¢Healthsource£.ñ¡ñ›ñ¡ñ€€Ms.Ï¢Derryberry£€also€asked€the€Trial€Court€to€award€her€a€more€sizableÏportion€of€Mr.€¢Derryberry£ððs€retirement€accounts€based€upon€theÏinequitable€distribution€of€the€marital€estate.€€Ìà ÐWilliams€of€Tenn.,€Inc.óó:Ð `6-0 ÐÒ°ÒÒ°ÒÓÓThere€is€ample€authority€for€the€proposition€that€aÏjudge€is€not€to€use€from€the€bench,€under€the€guise€ofÏjudicial€knowledge,€that€which€he€knows€only€as€anÐ  :À04 àMotions€to€Alter€or€Amend,€provided€under€Rule€59.04€ofÏthe€Tennessee€Rules€of€Civil€Procedure,€may€be€granted€(1)€whenÏthe€controlling€law€changes€before€a€judgment€becomes€final,€(2)Ïwhen€previously€unavailable€evidence€becomes€available,€or€(3)Ïwhen,€for€sui€generis€reasons,€a€judgment€should€be€amended€toÏcorrect€a€clear€error€of€law€or€to€prevent€injustice.€€òò¢Helton£€v.Ð Ðat€hand,€Ms.€¢Derryberry£ððs€position€at€¢ñ¡ñœñ¡ñHealthsourceñ¡ñ›ñ¡ñ€had€beenÏeliminated€leaving€her€without€employment.€€Even€though€Ms.Ï¢Derryberry£€suggested€¢that£€the€future€of€her€position€atÏ¢ñ¡ñœñ¡ñHealthsourceñ¡ñ›ñ¡ñ£€was€uncertain,€her€loss€of€employment€is€sufficientÏnew€evidence€for€the€Trial€Court€to€entertain€her€Motion€to€AlterÏor€Amend.€€Furthermore,€this€unfortunate€circumstance€wouldÏjustify€entertaining€Ms.€¢Derryberry£ððs€motion€in€order€to€preventÏinjustice.ÌÌà  àà ` àMr.€¢Derryberry£€also€alleges€that€the€Trial€Court€erredÏin€granting€Ms.€¢Derryberry£€additional€interest€in€his€retirementÏfunds.€€As€stated€previously,€after€thorough€review€of€theÏrecord,€we€find€the€division€of€the€Trial€Court€to€be€equitable,Ïand,€therefore,€find€the€first€issue€raised€ñ¢ñforth€ñ¢ñby€Mr.€¢Derryberry£€toÏbe€without€merit.ÌÌà Ð(¢Tenn.Ct.App£.1996).€€While€the€courts€may€consider€fault€inÏawarding€alimony,€¢ñ¡ñœñ¡ññ£ñspousalñ£ññ¡ñ›ñ¡ññ£ñ£€ñ£ñsuñ¤ñpportñ¤ññ¥ñchñ¥ñ€awards€should€not€be€punitive.€€òòBrown€v.Ð  2@), ÐÌà  àà ` àIn€the€case€at€hand,€during€the€course€of€the€marriage,ÏMr.€¢Derryberry£€made€between€$155,000€and€$273,000€a€year€from€theÐ  :À04 Ðpractice€of€law.€€Conversely,€Ms.€¢Derryberry£€made€approximatelyÏ$30,000€a€year€both€during€and€prior€to€the€marriage.€€Ms.Ï¢Derryberry£€testified€that€she€now€seeks€to€further€her€educationÏby€enrolling€in€law€school.€The€rehabilitative€support€awarded€byÏthe€Trial€Court€was€granted€in€order€to€provide€Ms.€¢Derryberry£Ïthe€opportunity€to€achieve€this€goal.€€Such€an€award€fallsÏsquarely€within€the€expressed€purpose€of€rehabilitative€support.€ÏAs€there€is€little€question€as€to€either€Ms.€¢Derryberry£ððs€need€orÏMr.€¢Derryberry£ððs€ability€to€provide€support,€we€find€that€theÏevidence€does€not€preponderate€against€the€Trial€Courtððs€award€ofÏrehabilitative€support€in€the€amount€of€$2,000€a€month.€€We€findÏno€abuse€of€discretion€in€the€Trial€Courtððs€alimony€decree.ÌÌà  àà ` àMr.€¢Derryberry£€also€contests€the€Trial€Courtððs€award€ofÏ$4,000€in€attorneyððs€fees€to€Ms.€¢Derryberry£.€€Mr.€¢Derryberry£Ïcontends€that€the€trial€court€erred€in€granting€fees€consideringÏthe€assets€Ms.€¢Derryberry£€received€in€the€division€of€propertyÏand€the€lack€of€liquid€assets€on€his€part.ÌÌà  àà ` àIn€divorce€actions,€awards€of€attorneyððs€fees€areÏtreated€as€alimony.€€òò¢Gilliam£€v.€¢Gilliam£óó,€776€¢S.W.2d£€81,€86Ð à.€%( Ð(¢Tenn.App£.1988).€€In€determining€whether€to€award€attorney'sÏfees,€the€trial€court€should€again€consider€the€relevant€factorsÏin€¢T.C.A.£€ðð€36-5-101(d)(1).€€òò¢Houghland£€v.€¢Houghland£óó,€844€¢S.W.2d£Ð €4 +.
