Securityfiledamotionforsummaryjudgmentandsubmittedanaffidavitestablishingthat,despitethestatedintentioninSecurityslettertoEllers,aseconddeductiblehadneverbeenassessedagainstEllers.InoppositiontoSecuritysMotionforSummaryJudgment,EllerssubmittedanaffidavitstatingthatEllershadneverreceivedanycommunicationfromSecuritycontrarytotheoriginalletterstatingthatSecurityintendedtoassesstwodeductibles.
